At last, it's Muellerday.



ADDED: I watched for the first 40 minutes, then bailed. Too much yelling by congresspersons. Too much stammering and "will you repeat the question" from Mueller. Mueller's testimony is the report. He's said that before and he's saying it again, over and over. With such a dull central character, the theatrical routine is boring and annoying.

I don't remember him calling foul on that before this televised circus.

Here is the comment I wrote a couple of nights ago at MeaninginHistory about what I expected from today's hearing:

"I expect the Mueller hearing to be a big fat nothingburger for all involved.

(1) I don't think Mueller ever had any intention of veering off the highway of his report, and I think this letter he wrote asking what the parameters are was Mueller's way of passing the buck back to Barr since he knew exactly what the DoJ's advice was going to be- even I could have written that DoJ letter and I am not even a lawyer or a government employee. So, after the hearing, the Democrats plan is to blame Barr for Mueller's lack of new detail, and for Mueller's lack of advice to impeach Trump.

(2) Though I do think the Republicans on the two committees plan to grill Mueller with really difficult questions, I expect Mueller to refuse to answer most of them, refer to the report, claim he doesn't recall, or, in the most dire circumstances, fake a stroke."


The only part I got wrong is that Mueller might not really have to fake a stroke- he seems to already be actually suffering from one.

That's probably true and the law says that's how it works, but how do you square that claim with Hillary's private server, smashed cell phones and deleted emails? I think some of the Repubs did a great job. At a few points I felt like giving the old man a hug out of my deep compassion, but it's still just theater. Maybe the IG and Barr will deliver some real justice eventually. It seems pretty clear that the crimes of the FBI are there, very serious, and well documented. Of course that means nothing in government work.

Of course it is. But the list that you provided doesn’t list any examples of Obstruction. None. Zip. Zero. Nada.

For those of you who have bee through this before please skip over this because it is a rehash of what I have said before.

The examples of possible Obstruction listed in the Mueller report don’t rise to the level required by either the courts or the DoJ. One thing missing is that they put together several Obstruction statutes in a way that essentially turned the specific intent requirement (Mens Rea) into a general intent requirement. Instead of having to prove that the action taken was done in order to Obstruct Justice, all that is required under the revised Weissman/Lawfare interpretation is that the action was intentionally taken. A good example of this is the firing of Comey. The Mueller prosecutors proposed this as Obstruction because Trump potentially affected the Russian collusion probe by firing Comey. The general intent is that Trump intended to fire Comey, and did. But Obstruction of Justice requires the specific intent (Mens Rea) of doing an act that Obstructs Justice, and that was impossible in the case of firing Comey, because Comey repeatedly lied to Trump about him being under investigation for colluding with the Russians. Trump couldn’t have Obstructed Justice there, because he couldn’t have had the specific intent to hinder that investigation, because he didn’t know that there was an ongoing investigation, because he had been lied to by the head of the FBI.

The Weissman/Witte Obstruction cstatutory interpretation on display in Part 2 of the report was cobbled together taking clauses out of context and ignoring long standing rules of statutory interpretation. The best explanation of what I hey were attempting to do and why it wouldn’t fly in any courtroom in the country, is probably found in Barr’s June 2018 memo to ((then) DAG Rosenstein, where he essentially eviscerates their theory. It should surprise no be that it was rejected by AG Barr, DAG Rosenstein, and maybe most importantly, the Office of Legal Counsel (OLC), whose job it is to interpret criminal statutes for DoJ prosecutors.

And that was the real reason why Mueller and his team of prosecutors refused to opine whether or not Trump had Obstructed Justice. Because if they had tried to, AG Barr’s question to SC Mueller would have been “Why don’t you think that you are bound by OLC statutory interpretations as the rest of DoJ is? Also, maybe, “Can you cite a single case accepting your statutory interpretation?” And the required a do-over in according to relevant DoJ statutory interpretations and court jurisprudence. By doing it the way that they did pretending that they couldn’t opine on whether the actions by Trump were unlawful as Obstruction of Justice, they were able to include all that dirt in their final product without having to acknowledge that it wasn’t legally Obstruction of Justice.

But I would also dive into his meetings with Christopher Steele and Glenn Simpson starting several months earlier, in late summer of 2016, and what he was told by those two about their motivations, funding, and corroborations.

I watched a bit of the hearing near the end, and it was really obvious that Mueller was not in charge, did not write the report himself, and that there was no crime committed by the President and his team.

So I fully expect the Democrats to find some other 'issue' to scream about to try and drum up impeachment fever.

This will not change anything in DC.

As has been sadi, all the Demcrats need to do to beat DJT is to not be crazy, and they are not capable of doing that.

I am on a message board that leans far, FAR left. I avoid all political threads there, because after 2016, it was total insanity for a while. But when politics is set aside, it's a nice group of people. If I ever disclosed voting for DJT (which I did whilst holding my nose in 2016 and will do so with enthusiasm next year), I would be run out of there on a rail.

Mueller discredited himself, not the President. Remember Mueller is the reason the investigation was seen as non-partisan and credible. Impeach an elected President based on an "investigation" whose credibility was guaranteed by that bumbling old man? Ridiculous! Why ever did they hold the hearings? Probably Nadler was too stupid to notice anything unusual about Mueller's reactions. Or suppose it was all an act. That means that Mueller, like one of those aging racketeers stumbling into court from a prison, felt he needed the protection of such an act from Bill Barr's DOJ investigations. It would mean he was certain Trump was going to be re-elected.

2. Trying to muddy the water before the IG report comes out.

Notice that this is happening in the summer when a lot more people tend to ignore the media. The timing of this charade mitigates its disaster.

The original answer really wasn't what the talking heads and Inga claimed, but now even that talking point disappears.

I would love to hear Inga give a rational and non-damning explanation for Mueller's ludicrous claim of knowing nothing about Fusion GPS. You know, the creators of the dossier used as justification for, well, everything related to his probe.

I suspect Inga will not answer this, and will ludicrously claim that our amazement at this jaw dropping claim is unwarranted and a "nothingburger".

There are clear answers to many of those questions that Mueller could have given, including very innocent ones, but he didn't do so, and you do have to ask, "Why didn't he?"

It is harder to prep a witness to lie and obfuscate without opening them up to perjury charges. I also think that the left has a lesser ability to put themselves in their opponents' shoes and think about what that opposition might do in response- it is one the problems with being inundated the echo chamber of the mainstream media. Someone on the right has dealt with that echo chamber their entire lives- it makes a real difference.
