The chattering and overtalking on TV is so annoying, I say, and then Meade is watching on mute with close captioning. He declares it to be very amusing because he's focusing on the facial expressions.

Speaking of TDS, I just read a poll from the Harvard Crimson that said that 88% of their faculty think that Trump is doing a 'very poor' job as President. I know, you're as shocked as I am. Another 8% said he was doing a 'poor' job, 2% said he was doing an 'okay' job and 1% said that he was doing a 'good' job.

82.76% of the faculty describe themselves as either 'very liberal' or 'liberal', 15.22% describe themselves as 'moderate', and 1.63% describe themselves as 'conservative' or 'very conservative'. Over 1000 faculty members were surveyed.

So to be clear, your presumption is that in fact the quotes are true; those senior White House and ex-White House staff really did insult Trump in the ways quoted, and they were fired for it.

For my part, like you, I believe that all of the quotes are probably true, as well. Tillerson and Cohn never (falsely) denied the reports. Priebus did, as I recall; I think he was probably lying. Not sure about the McMaster quote. I do think that there is good reason to believe that top people say those things, because they are true.

So these have to be very specific and well defined.
More, they are given messaging, in coordination with other "news" outlets, and have to make use of that as specified.
And then, in their format, they have to pretend to a "natural" conversation with others within the constraints above, while not contradicting each other or the messaging.

Its a really tough job if you think about it.

I know from your comments that you are a doctor, and have done expert witness work. You must know, as I do, that those records are the legal property of the doctor. The patient can have copies, but not the originals. And forget for a moment as to how some security guys for Trump can walk in without any papers, no authorizations, no HIPAA-compliant papers, and just walk out with patient records.

It's a helluva story, isn't it?

If a patient moved and asked for records to be sent to the new doctor, I sent them. I usually dd not keep copies unless I expected them to return.

The law, very simply, is that licensed medical practitioners are legally obligated to maintain records for their patients. As such, those records are the legal property of the practitioner. If that patient sued you for malpractice later, and you had no records, what would you attorneys say? Your office manager would know better. Chuck, I had one malpractice suit in 40 years, that accused me of using Red Cross blood to save an 18 year old's life in 1986 before AIDS was identified in blood. Eight years later, he developed AIDS.

As for records, have you tried to find medical records on anybody lately ? The law is that records must be kept on children until they are 18. It doesn't happen. I don't like it but your ideas of medical records retention are 25 years our of date.

I honestly can't remember but I think we sent the whole packet unless they planned to return. I also strongly encouraged all patients to keep a copy of their own records.

I will attempt to expand the incredibly obvious point that I made above @ 8:42 AM.

Michael Kelso (played by Ashton Kutcher) and Jackie Burkhart (Mila Kunis) are characters assured by their own physical attractiveness (PA) that they will be universally successful (US). Both are the butts of many jokes, both by their friends on the show and by the adults on the show. Their conceit about their own PA and its attendant benefits is risible. Everybody can see the flaw in the logic that PA will necessarily prove itself long-term advantageous as the high school students enter the real world.

Those characters represent an archetype. They are not unique in the world of entertainment. In fact, the characters who fill this archetype are so numerous that explaining the value of the beautiful and ditzy character who attributes US to PA is unnecessary to all but the most extraordinary of fopdoodles.

Everybody gets the joke that equating PA to achievements in any other area of life is foolish. Nobody has to explain the joke because there is no causal relationship between PA and US. (The converse of the marginally attractive or unattractive nerdy character similarly needs no explanation. It too is an archetype.) At most there is correlation between PA and some other achievements but the characters, as archetypes, cannot see past their own assumptions that PA leads to universal success.

Even beautiful people get the joke that beauty does not lead to US.

But smart people - and especially those who believe their own press clippings about intelligence - CANNOT get the joke. Smart people believe that their Native Intelligence (NI) will lead to US. And that is EXACTLY the same conceit that is so obviously wrong when PA people (Kelso and Jackie on the show) think all of their successes will flow from their most favorite characteristic about themselves.

People with NI actually believe that NI will lead to better decision making that people with average intelligence. But there is no proof for that outside of the CONCEIT that overly smart people carry around with themselves.

My example above with Bob McNamara is precisely on point. Smartest guy in the room got a helluva lot of people killed because he was conceited about one thing and thought that one thing gave him more and better than anybody else in the room. And his conceit went so far that he kept people out of the room who could have told him he was full of shit.

But Bob McNamara wouldn't have gotten my observation either, Chuck, fopdoodle extraordinaire. So you have that going for you.

Every single week, in active litigation, I am dealing with letter requests for records, subpoenas for records, qualified protective orders, and HIPAA issues.

Yes, I think Trump's doctor is nuts. I thought that the letter over his signature, about how Trump would be the healthiest individual to ever occupy the presidency, was nuts. I think Trump is nuts. I think the whole situation is nuts. In other words; it is all quintessentially Trump.

But the clearest thing in all of it -- what everybody seems to agree on -- is that it really does look like Trump's security guys took all of the original records. There is just no way that that is proper, except if they are going to claim some security thing. It is what they will have to do. I just love the story, because it is such a reminder of what the private life of Circus World Trump is like.

One of the great selling points for the CHCS and VistA systems was easy customizability for local SOPs. Which meant, of course, that records recorded at one clinic or DoD hospital were unlikely to be compatible with the data formats at another DoD clinic, much less at the VHA.

Cedars-Sinai is a UCLA teaching hospital with all the doctors on staff also holding clinical faculty positions at UCLA. The EHR at the two institutions are not compatible.

I'm going to see if we can get chuck a contract obtaining records for the DoD at Phoenix and LA MEPS as he seems much more successful than we are.

Or maybe he doesn't know any better. When I was an intern in 1967, I had a patient with a surgery as a two month old in 1932. I got his medical records from Worchester and Boston Childrens Hospitals.

Does anyone think that is possible now ?

One more thing, chuck. I did videotape all my 1,000 lap choles before I retired in spite of hospital attorney request. I kept the tapes for a month until I was sure there was no complication, then offered them to the patient. About half took them.

I did the same with the 500 lap appys I did. One little kid took the tape of his appendectomy to school to share.

It was a sensation in Laguna Beach. That was when those procedures were very new and few were aware of them.

Questions were raised about the legality of the seizure. Patients have a right to a copy of their medical records but the original physical record belongs to the doctor, said Dr. Matthew Wynia, director of the Center for Bioethics and Humanities at the University of Colorado.

“If a patient wants a copy, they can have a copy, but they don’t get the original. Patients can also ask for their records to be transferred to a new doctor, but that also involves making copies (i.e., transferring the information), not literally packaging up the originals and sending them off,” Wynia said in an email.


It boils down to something like "Presidential Security." But then when has this ever happened in the past? Where the Secret Service goes to a president's doctor's office and takes all the records, including originals? I don't even think that there will be records of this being a Secret Service operation. It was a "Trump Security" operation. Keith Schiller, another big bodyguard-type guy, and Alan Garten of the Trump Organization.

HIPAA is just one relevant law. The laws governing the duty to maintain records on current patients is a state-level legal scheme, except for special issues like Medicare. But the state laws are all alike, insofar as they all require doctors to maintain records. And because the laws require the doctors to maintain those records, the records are the legal property of the doctor. Again, the patient can have copies. But only copies. (There are some more exotic procedures dealing with things that might require "originals," like old analog mammograms and such, but they are so rare as to be irrelevant to Trump's case.)

I don't know why, Big Mike, you would be busting Dr. Bornstein for releasing Trump's records without authorization. Keith Schiller, working for Trump, just took the damn records without an authorization. And hell yeah that is wrong; wrong on the part of Keith Schiller. Bornstein should've called the cops on them.

Now, to the extent that Dr. Bornstein was chatting with a reporter about Trump's prescription for Finasteride (for hair growth), I ALREADY SAID THAT IT SEEMED LIKE A SCREWBALL VIOLATION OF PATIENT PRVIACY LAWS. I'm not defending the doctor on that. I said so already.

Eddie Joe Reddick learned the procedure while on a trip to Paris with his wife. She wanted to go to museums and he decided to watch some surgery. That where he first saw a lap chole. When he came home, he went to a friend, a GYN in Georgia (Barry MacKernan) who did a lot of laparoscopy. Barry taught Eddie Joe, as he taught me a couple , of years later, to do the procedure.

The Europeans were well ahead of us in that technique. I went over a couple of times to learn more about it.

I did my first lap chole about 1988, soon after Reddick. The guy who was ahead of most of us is Ed Philips at Cedars. They built him his own OR. Last I checked he had done over 18,000 and that's years ago.

I retired after back surgery in 1993.

I think he retired very well off.

The universities were very slow to adopt this technique because it was for patient comfort and they could care less about that.

The demand was patient driven . I had doctors' relatives coming from other states for a while.

I had a doctor call me on a Friday afternoon to ask if I could see his 9 year old daughter who he thought had appendicitis.

She did and I took her appendix out that night.

She went to the same private school in San Juan Capistrano that all our kids went to. The school nurse was even a doctors wife.

She heard Monday morning that this kid had had her appendix out Friday night and she called the hospital to see how she was.

The kid was in class. That's what drove the demand.

No, I never bagged a common duct but I did operative cholangiograms on every case. There were a couple where I might have injured it without the cholangiogram.

Ed Philips did 100% cholangiograms, too.

The cholangiograms took more time but if you did them routinely, it was a minor delay.

A lot of poorly trained people went into this and I did a lot of expert witness testimony all over the country for a while.

I am actually not aware of Trump's attorneys saying that it was an "amicable" collection of records. The doctor in question describes his impression of it all as being like a "raid."

No matter what; absent something unusual, it is standard for patients to get COPIES of their medical records. NOT THE ORIGINALS. And yet that is what happened. By all accounts, that is what happened. Trump's former personal bodyguards went to the office unannounced, as it opened in the morning, walked in, and without any authorizing documents, simply took the Trump records.

That's crazy-weird, to the point of illegality. But it is the President of the United States that we're talking about. If the claim is that it was a presidential security issue, then I might understand. But then, you would think that it would be a Secret Service operation, with law enforcement support, and some legal paperwork. And that also appears to not have happened.

Ed Philips had his OR equipped with an x-ray machine to do routine cholangiograms. I never got that courtesy but I still did every one. I think there were four cases I could not get the catheter in. As you do it more frequently, it is easier and faster.

No wonder you were doing lots of depositions.

I have for years complained about people giving lectures about how they do not do the safest thing because they are bragging about how they don't need it. I have talked to a couple after their lecture and chastised them for telling lesser trained surgeons to avoid the safest option.

If it was an "illegal raid", why didn't the doctor call the cops or the local security force? Surely a respected physician with a fund of wealthy and influential patients has access to a security service provided by the administration of the building where his high-profile medical practice has its offices. He could have picked up a phone and called for security to eject those intruders, but he didn't. One wonders why.

How did those intruders get access to the files? Weren't they locked or otherwise secured from prying eyes and hands? My own doctor has a file room, quite large it is too. It has a glass wall, and the shelves containing the folders are clearly visible to anyone standing at the receptionist's window. However, the room is secured with a magnetic lock. Only persons with the appropriate authorization can even enter the file room, let alone have any access to a given file folder. Surely the good Dr. Bornstein took similar measures to protect his patients. If he did, someone voluntarily let those intruders into his file room. That would be an offense against the privacy of his entire clientele, would it not? If I were a patient of Dr. Bornstein I'd be talking to my lawyer about a lawsuit. But no details about his file security have emerged. One wonders why.

My personal physician has a similar lock on the door between his waiting and reception area and the various examination, laboratory, and equipment rooms within. No one gets back there without being buzzed in, as they say. My doctor is a poor man in comparison to a medico like Harold Bornstein, who enjoys a lucrative practice with billionaire patients, yet he can afford security measures that would have thwarted Trump's men which apparently the wealthy Dr. Bornstein cannot. A simple lock would have stopped those intruders unless they used a battering ram or pulled out SMGs and threatened to kill non-cooperators. Did they? One would think Bornstein would have included those juicy details in his "rape" story. Why not? Was it because Bornstein allowed them into the secure areas, that he unlocked the doors himself? No information so far. One wonders why.

Bornstein also told the press that he prescribed medication for Donald Trump's hair loss. Why? Is Trump undeserving of the privacy afforded to every patient of every physician by the terms of the Hypocratic Oath, ... Into whatsoever houses I enter, I will enter to help the sick, and I will abstain from all intentional wrong-doing and harm, especially from abusing the bodies of man or woman, bond or free. And whatsoever I shall see or hear in the course of my profession, as well as outside my profession in my intercourse with men, if it be what should not be published abroad, I will never divulge, holding such things to be holy secrets, not to mention the ordinances of the New York State Board of Medicine? It seems to me Bornstein has laid himself bare to a lawsuit on at least two torts. He failed to protect Trump's records from those intruders. How was he to know if they were legitimate or not? Did they show Secret Service IDs? Not according to LLR Chuck. How does one know a Trump bodyguard from an MSNBC flunkey posing as one? Is Bornstein dumber than a box of rocks? Or is he a conspirator perpetrating a hoax? No one at CNN has asked the doctor what measure he took to ascertain the intruders' true identities. One wonders why.

I've known a couple of "celebrity doctors" and, if they don't die of overdoses as Stephen Ammerman, Don Simpson's doctor, did they are not very trustworthy. And often not very competent.

On August 15, 1995, Ammerman was found dead in the pool house on Simpson's estate. It was later determined that Ammerman died of an accidental overdose of cocaine, Valium, Venlafaxine and morphine.

I think you have me confused with someone else. I've been one of the biggest Trump supporters here at Althouse in Althouse comments since before he got into the race in June 2015. Admittedly, he was a third choice initially behind Rand Paul (Great ideas but maybe a bit weak) and Cruz (Great ideas but has citizenship issues). After a couple month's watching him, he became my first choice.

My love of President Trump grows daily. As I keep saying, I am not tired of winning yet. I think he has a shot at being an all time greatest president. I can't think of a single thing to complain about in his presidency.

Since I have been pretty vocal about this all along, I have no idea what you are talking about.

As to his wealth, he reported, in his official financial filing, something over $9bn net worth. If he had materially mis-stated it, his opposition in both parties would have been all over it like stink on shit.

Yet people keep giving lower numbers. The woman at the WHCD did a whole bunch of "Trump is so broke..." Audience "How Broke is he?" She "So broke that..."

If he was worth $9bn in 2015, I would question how he got to $3bn today or to broke as she would have it. I suspect, given the economy, his $9bn is somewhat more today.

Saying something different, without any evidence, just seems like FUD to me. Lots of people are, but why you?

Re the doctor, if any doctor of mine was selling my personal, medical information, I would probably do exactly what President Trump did. I would send a lawyer to take custody of my records since the doctor obviously can't be trusted with them.

I would send someone along to be a witness. If I had someone big, so much the better to help schlep the stuff away. I might also have someone standing by in the hall with a handcart in case of need.

If questioned, I would state that I am not claiming ownership of my client's records. The doctor can have access at any time for any legitimate reason. I am simply removing them for safekeeping and, if the doctor wants, he can take me to court. I would be happy to explain to a judge what I did and why and let the judge determine whether I should give the records back or perhaps deposit them with the court for safe keeping.

I would do this even if the doc was not selling my info, just giving it away. I use the word "selling" because my understanding is that, in return for giving out the info, he received something of value, even if just publicity.

I would then sue the bejeezus out of him with criminal and civil charges. I would do everything possible to ruin him financially and reputationally.

I am not a lawyer, of course, so I don't know how well this would work from a legal perspective. I do know that if physically able, I would take the records, let my lawyer hold them and take my chances in court.

Correct; I think that Dr. Bornstein did not call the police. I think he was not there when it happened. I expect that perhaps somebody called Bornstein, or spoke with Bornstein's wife/office manager, and no one decided to call the cops. They might very well have known who Keith Schiller was (like Stormy Daniels knows who Keith Schiller was), and knew that he was Trump's guy. I expect that they were told what was happening, and why. Doesn't make it legal.

Exactly. Except the story isn't "bullshit" at all. The essential story is that Trump's people came and took possession of all of the records on Trump within the office of Dr. Bornstein. And that story was confirmed by Sarah Sanders yesterday.

Now, I can see why Bornstein didn't want to make any more of a fuss about it. If he filed a police report, Trump might point out that Bornstein might be guilty of a patient-privacy violation in connection with Bornstein's nutjob interview after that nutjob letter assessing Trump's health went out.

My guess is that Trump and Bornstein are as eager to get law enforcement's assistance in such matters, as the Soprano and Corleone families would have wanted law enforcement's help.

You're the one leveling allegations, it's up to you to provide the evidence. I'll put you a simpler case. I posed several questions, which you declined to answer. I'll be more apt to think well of you if you can answer these. How did the "goons" grab records protected by locks? Did they batter down the door to the file room? Did they threaten the doctor? If he wasn't there as you claim, how could they have intimidated him into opening those locks? I'm inclined to believe they did threaten to file a complaint against Bornstein with the Medical Board, which would certainly have made the good doctor feel intimidated and inclined to cooperate. The records are, as you have stated ad nauseam, the physician's property. However, you are in error in that those records are not chattels. They cannot be disposed of like other property. The physician can relinquish those files to the patient for any number of reasons. A court order may be involved, but nothing prevents a physician surrendering a patient's record voluntarily and without the formalities of an order.

1. Dr. Bornstein sure doesn't sound like this was voluntary. Keith Schiller (armed, no doubt) and another big guy, and a Trump Organization lawyer?
2. It is legal insanity, for a doctor like Bornstein, dealing with a lawsuit-crazed lunatic like Donald Trump, to give up his only copies of original treatment records.
3. As I mentioned already; there are innumerable ways to transfer copies of records in the normal course of medical practice. This was not normal, in any way.

Now, I don't put much stock in any serious legal reasoning here. I don't think that Dr. Bornstein had time to call a lawyer. If he had, the lawyer -- any good lawyer -- would have told him not to relinquish the records. A good lawyer would have also told him not to do an interview and talk about Trump's Propecia prescription.

Funny the doctor didn't say that. Even NBC with all their undisguised animus toward Trump didn't include that tidbit — strains credulity, as the lawyers say.

It is legal insanity, for a doctor like Bornstein...
On the contrary, it absolves Bornstein of responsibility for the security and completeness of the records.

So what? I am licensed to carry, but I don't show up armed where it's likely to contravene the property owners' policy or cause other problems. The doctor mentions no guns. How do you square that with narrative? Why do you feel it necessary to add details not in evidence?

On second thought, don't bother. The reason is obvious, isn't it?

Not voluntary in the sense of here, out of the goodness of my heart, are your patient records, Mr. Trump, but certainly voluntary in the sense of a bargain, as in give me my records or I'll sue you and I'll have your medical license on a platter, which is what voluntary generally means in lawyer-speak.

I had never considered the possibility that Dr. Bornstein would willingly just give his only original records to patient-Trump willingly. But you are right, that could have happened.

You should have as it is the only interpretation that fits the facts as they as known. But being yourself and following your agenda, that was out of the question.

The Democratic National Committee is less partisan than Chuck.

Yes he takes his direction and talking points from them but he always take it to a greater extreme.

Generally if you want to find out what the DNC's position is you just need to read Chuck's comments.
