Dershowitz versus Mueller and Painter.

I'm seeing this billed as a Dershowitz "melt down," but I think Painter is the one who creates the tension by interrupting Dershowitz and introducing the accusation of lying.



Dershowitz wants to speak (with passion) about prosecutorial ethics, and he criticizes Mueller, but Painter insists on policing a don't-impugn-Mueller ethic that's incredibly aggravating. Painter also has a louder, clearer microphone. I don't know if that's by design, but it is MSNBC.

Ritmo is mad at everybody, but I suspect he is mad at himself, mostly.
Or at least that is the character he is playing on Althouse blog.
As a general rule, you should stay away from people who are angry at themselves. People like that enjoy enveloping others in their own psychoses.
But its fun to bait Ritmo, until it becomes tiresome. Sometimes you get rewarded by a weird pseudo-scientific theory, as when a half-educated phlebotomist tells you that Jews have different colored blood than gentiles.

"Ellis cut to the chase and told the special counsel their intention was really to get Mueller to “sing” to get Trump. “I’ve been here a long time. The vernacular is to sing,” he said.

Ellis admonished the special counsel, saying he was seeking “unfettered power” — something the founding fathers fought against. “What we don’t want in this country is we don’t want anyone with unfettered power,” Ellis stated. “So it’s unlikely you’re going to persuade me that the special prosecutor has unlimited powers to do anything he or she wants,” the judge said.

Dreeben said Mueller is following both the May and August 2017 orders from Rosenstein, who oversees Mueller. But Ellis shot back that the order he was given had 75 percent of the August memo was redacted.

“I have that right here, and I’m glad you raised it because 75 percent of it is blocked out, redacted. Why don’t I have a full copy it,” Ellis asked."


I think everyone knows why 75% of the order is blocked out.

Mueller is watching his legacy circle the toilet.

More importantly though I wonder if Mueller and Comey and Rosenstein ever got together to talk about leaking classified information to he press in order to get Mueller appointed special council?

@Achilles - my guess, right now, is that the Mueller investigation is in the process of falling apart. It is under legal attack from multiple directions. Two, maybe three, federal judges (Ellis being the latest) have seriously questioned the basis for the investigation and the tactics being employed. One big problem is that it violates DoJ regulations, which require evidence of a specific crime that the DoJ is too conflicted to investigate itself, for an independent prosecutor to be appointed. There never was such a crime, and no evidence that the DoJ couldn't have investigated such if there had been. Instead, Rosenstein authorized an open ended counterintelligence investigation of what was supposedly bipartisan investigation of Russian collusion, but actually was only ever aimed at the sitting President, and not his losing opponent (whom we now have proof did collude with employees of the Russian govt). Rosenstein does not appear then to have had the legal power to do what he did, in appointing Mueller as a special prosecutor. The situation did not qualify for such an appointment, under the legally controlling rules and regulations in place at the time (and still in place today). Without such, the actions of the special prosecutor and his team are illegitimate, essentially ultra vires. And this is important because,in the normal scheme of things, DoJ prosecutions are under the control of US Attorneys, who are "Officers" requiring Senate Confirmation under Art II Sect II, Par II. Mueller is, at best, an "inferior Officer", who, thus, has significantly less discretion. Essentially little different than AUSAs that report to, and are responsible to, USAs. And are fully controlled by DoJ rules and regulations (that he and his team seem to routinely violate). This is part of what Judge Ellis touched on Friday.

Because Mueller and his team are inferior officers, thus having significantly less discretion than USAs, they can do nothing that is not specifically authorized by DoJ rules and regulations, or by order of their supervising Senate confirmed "Officer", who is DAG Rosenstein. The problem here is that they are refusing to provide that legal justification for their actions, in the form of an unredacted order by Rosenstein. And since their legal qualifications for bringing suit against Manafort have been questioned by the defendant, Due Process requires that they prove such to the satisfaction of the court. And, indeed, I would argue that not only is the judge entitled to see and review this evidence of legal authorization to prosecute the defendant, but so is the defense. Arguing that the redacted portion of the order is classified is unpersuasive, since this is a criminal, not a counterintelligence case. And, esp since the criminal suit was not the inadvertent result of a counterintelligence investigation, but, rather, was the resurrection of a criminal case that the DoJ had decided not to prosecute years ago. Indeed, it appears that the only connection between the counterintelligence investigation and this criminal prosecution is that Manafort, years later, worked for the Trump campaign. Probably not helping their case is the example that came out last week where the DoJ was caught red handed redacting information supplied to Congress, in its oversight capacity, not for national security reasons, but rather to save itself from embarrassment. So, the prosecution's "trust us, we are the DoJ, of course this is authorized, but national security won't let us show you our authorization to you" isn't working, for good reason.

Watched Mark Levin tonight on his Sunday show on Fox News. Such a difference from the screaming and like that he engages in on his talk show. Very measured, clinical, and almost academic. The first segment discussed the legal underpinnings of the Mueller investigation. And part of it was was that DoJ (OPR?) guidance (written under Nixon, and reiterated under Clinton) essentially says that the DoJ cannot prosecute a sitting President. And shouldn't investigate him, absent proof of him being involved in actual crimes. And they have no jurisdiction whatsoever to investigate him for possible impeachment - that is a purely Congressional prerogative and responsibility (though they probably can ask for help from the FBI, etc, but obviously have not here). Since DoJ policies prevent prosecuting a sitting President, and Separation of Powers prevent building an impeachment case, WTF are Mueller and his team doing? Obviously not counterintelligence, since they are ignoring obvious collusion by Crooked Hillary and her team with Russian govt. employees, AND a number of their prosecutions (including many of the charges against Manafort) obviously have nothing to do with Russian collusion, having occurred well before the Trump Presidential campaign.

Moving away from Skype. There is a good argument that ethically Attorneys shouldn't use it for talking with clients, due to its lack of serious encryption AND ownership by Microsoft. Wire has strong encryption and isn't owned by a huge multinational corporation. I think that because of that ownership, as well as that these programs operate by sending packets across the Internet, that the NSA very likely acquires all Skype conversations, archives them at its massive computer facility in Utah, and makes them available to federal agencies (and until discovered by the audit ordered by Adm Rogers, also to certain contractors) under FISA Title VII.

As a note there, Internet services utilizing chained packets, such as email and Skype like communications are hard to intercept, even by the Feds, because different packets can, and often do, travel by different routes, only to be reassembled at the destination. And not acquiring all of the packets in a session can make even partial reassembly problematic, since important session level information is typically found in the first packets of a session. The Feds, with their FISA Title VII databases, bypassed this problem by going to the major companies providing Internet services, and acquired much of that traffic at its source or destination, where partial session packet reassembly is handled automatically by the protocol layers. As well as acquiring cell phone and land line call records directly in real time. Thus, if you use Gmail, Yahoo, etc, for email, or the person sending it to you does, then the NSA very likely has those emails archived. But they are far less likely to have such archived if the email servers at both hands are in private hands. So, just as you probably shouldn't ethically be using Gmail for professional email if you are an attorney, you probably shouldn't be using Skype for identical reasons.

Some of the stylistic similarities between Toothless and Pee Pee were too strong to ignore, like the assumption of intellectual superiority (without anything substantial to support it) coupled with signs of lunacy. I've been here for only two name changes, but the dementia seemed to increase when "Toothless" became "Pee Pee." Is that par for his course, Birkel? In any event, thanks for confirming my suspicions.
