A reporter asked Defense Secretary Chuck Hagel Sunday whether Bergdahl had left his post without permission or deserted -- and, if so, whether he would be punished. Hagel didn't answer directly. "Our first priority is assuring his well-being and his health and getting him reunited with his family," he said. "Other circumstances that may develop and questions, those will be dealt with later."
How conspicuously evasive can you get? Other circumstances and questions have developed. That's why the question was asked.
Another senior Defense official said Bergdahl will not likely face any punishment. "Five years is enough," he told CNN on condition of anonymity.
One translation of that is: We have determined never to air the facts of this case.

There is precedent for just moving on, from Korea and from our actions in former Yugoslavia.  I do agree with Drill SGT in that he is a Jerk, but he is OUR Jerk.

Bigger than spending money on an investigation into Sgt Bergdahl, which will accomplish little in the long run, is the question of why the Administration didn't reach out to Congressional Leadership before announcing the exchange.  The law was plain.  This operation didn't happen over night.  The Administration deserted in the face of possible controversy.

I doubt there are going to be White House photo ops on this one. Too much risk that the troops might not comply with the gag order.

It's unclear why getting this guy released became a priority after 5 years. Considering what they gave up in the swap, it must have been a pretty big priority. They say they determined that his life was in danger. How the hell do they know? Any more than in the past? Did they really think Obama was going to be able to bask in glory on this one? I suppose it could simply be out of personal concern for Bergdahl but why now?

Saw the father's press conference. Conspiracy aside, he and his son are poster children for the left's view of Bush's Afghan war. So if the son really deserted after a certain disillusionment, he would be welcomed like a hero by the left. He would be welcomed like a hero for emptying Gitmo of 5 inmates so the closing will be expedited by that much. For Obama, this is yet another chance to slap the military and the right and provide a certain satisfaction to his base.

Because the facts of this case are that the Obama Admin needed something to move the VA Scandals off the front page of papers and lead story on TV.

The Carney thing was pretty creative as a one day distraction but didn't have the required sustained "pop"

So this deal was made.

Once again the Obama Administration will be shown not to have thought something fully through in all it's ramifications.

Can't wait to see what Obama does at the D-Day Commemorations as he struggles to talk about troops. Sacrifice, justice, patriotism in a way that doesn't reignite a VA brushfire. It will have to be pretty "audacious" to his hydra-headed scandals under control.

If we are doing a prisoner exchange in this manner (as we certainly don't negotiate with terrorists, but nothing is wrong with exchanging legal enemy combatants), then it follows that the Islamic chaps are in fact legitimate prisoners of war and as such, their detainment in Cuba was perfectly legal this entire time. Furthermore, they can be detained without even so much as a token trial, for as long as a state of war exists between the USA and Al Qaeda.

The only way this makes sense is that he was NOT a deserter, that the reason he was spending so much time with the Afgans prior to leaving is that he was a spy who was trying to become a mole, and this was all cover.

The alternative, that he truly was a deserter and we just traded 5 senior Taliban for him, is so horrific a thought, that the Obama administration could truly be that blind, that i simply cannot accept that, even given my utter lack of confidence in them.

Just as Ambassador Steven's death was about a CIA op gone bad (hence why it cannot be spoken of truthfully), there just has to be more to this story.

One thing the administration, with their lack of military experience, may not have understood is if the guy did desert then the people in his platoon are not going to be jumping for joy. People in combat don't fight for their country or freedom or democracy. When you are actually in combat your fighting for your fellow soldiers and they are supposed to have your back. Bergdahl betrayed them and put their lifes in danger and probably killed some of them.

I agree with the first of the Drill Sgt's comments. Even though he was a flake or a fool, he was one of us and we should have done what it takes to get him released. There's an argument to be made that his obvious defects make his ransom all the more virtuous. We look out for everyone, not just for the heroes......Also he was in a forward position. Chronic mortal risk can fuck with your head. Perhaps his erratic behavior was caused by stress. It's possible. I'd like to hear his side of the story before making a judgement......I can't help but think that Reagan drove a better bargain with Iran-Contra. Those five prisoners will kill some more people before they themselves die. Best case scenario is that their victims will be be moderate Afghan officials or maybe just some little girl who wants to learn how to read........But anyway our guy is free, and that's a fact on the ground.

My concerns about this (in order from least to greatest):

1) Trading prisoners with non-state actors before hostilities have ended creates a market for future hostage-taking and greater danger for US servicemen and women as well as any civilians.

2) Five for one seems like we got the short end of the trade. I’m unclear why it was important that this deal be made since it seems like we gave more than we got.

3) I haven’t read the statute but if what’s being reported is correct, the administration was required by law to consult with Congress (not get their approval – just to let them know) and does not appear to have done so. Even if you think that the statute is an unconstitutional restriction on the power of the President to command the armed forces (as some have argued about the War Powers Act), unless and until it is repealed or struck down by the courts, the President is obligated to try to follow it. That being said if time was of the essence and they had to complete the exchange in say fourteen days, they should have notified Congress as soon as possible (even if not 30 days in advance) to make a good faith effort to comply with the statute.


At this point, I have no opinion about the character of the man who we got back. I would suggest continuing to ask questions and demand answers but hold off on speculation until more concrete facts have been made public. There is probably going to be a lot of misinformation that comes out initially and it would not surprise me if some of the rumors were planted to get the President’s critics to overreach and potentially accuse an innocent solider of being a deserter.

CNN reported that their sources in the Pentagon claimed the deal was done now because of Bergdahl's deteriorating health situation.

This deal was apparently under discussion for the last two years. I would think Congress probably knew about the terms of the deal, but not necessarily when it would be executed.

When it was the case of the football star/special forces hero who was killed in the crossfire, the left demanded the whole story,not just the sanitized version. When it was Jessica Lynch, the left demanded the full version and not the sanitized version.
So lets have the full version here. The guy is a deserter. And what should have been a 4 day operation turned into a month long affair searching for him. And people died because of it. According to some taliban they spoke to he went off in search oft the taliban, ostensibly to join them.

I will venture a guess as to why. The Democrat party is perceived as soft on military matters. This reputation began when the Left decided to spit on returning soldiers during the Vietnam era. It was cemented in place as the few Democrat politicians who were favorable to the military died off and faded away. Senator Scoop Jackson comes to mind.

And that rep, already lousy, has been reinforced by our incompetent POTUS, the leader of the Democrat Party, who didn't even know how to pronounce "Corps." He has given Iraq, a relatively stable ally due to a war won by Bush, back to the enemy. Ditto, Afghanistan. Now the VA scandal and Obama's clumsy management of the scandal is making a bad reputation worse.

To Obama, it probably seemed like a win/win situation. Our only known "POW" would be returned, showing Obama to be a man who cares for soldiers and that pesky Gitmo would be relieved of five of its tenants. It was the decision of a man whose staff and advisors are filled with Lefty ideologues whose only real expertise is in spouting third-generation watered down Marxism and trying to impose the same to the rest of us.

But was he really a POW? The videos I've seen show a healthy adult male who, except for a minor contusion on one eyebrow, seems none the worse for wear.
It seems more likely to me that he was a deserter. Deserters are NOT POW's, even if they find out what they deserted to is no bed of roses.

Why is it an either/ or situation on his release? We can be proud that he returned, honoring our commitment to not abandon our forces that are held by the enemy, just as we can question if the deal that brought him back was fair or sensible. We can also ask him to explain how he managed to be captured and then make the decision on whether to prosecute or just brand him a loser or a hero. Men died trying to retrieve this man, so those questions need to be answered.

Sec Hagel's comment on "5 years is enough" is baloney though - he is trying to cover up what appears to be a bad deal.

It's looking more and more like Obama actually thought he would gain a favorable opinion from this – that the military, vets, retirees and the public at large would actually give him points for this move. Perhaps he also thought that anyone who objected would be stepping into a brilliant trap brilliantly conceived by him.

The Trap: Those objecting, such as GOP politicians, would diminish their own standing in the court of public opinion and cause Obama's standing to rise. Why? Because they would be picking on an heroic POW rightfully and righteously returned home.

Only those woefully unaware of the military culture, those who cannot pronounce "Marine Corps" correctly, those who cannot disguise their contempt for all matters military, those who probably did not even take the time and trouble to research the facts already known about Bowe Bergdahl would ever think such a thing.

Furthermore, I don't believe this controversy will go away soon. Unless I miss my guess Bergdahl's parents, who could be straight out of the cast of Portlandia, a funny series I catch when I can, are not the type of folks who compliantly recede into the background once their usefulness is over. They are anti-war and their son is anti-war and I believe we will be hearing from them for some time. Face time on cable, book deals, speaking engagements in safely liberal venues – all are in the offing for the Bergdahl family. That bitch, Fame, is truly seductive.

If, during the administration of Teh Obama, you happen to desert and actively collaborate with Muslim extremists and then can be "traded" for Al Qaeda leaders.

That's gonna get you some real positive face-time before any promotion boards under the guidance of obama admin lawyers.

Wasn't a hero promoted in a movie, Wag the Dog, that turned out to be a reprobate? I don't remember the story line that well, but seems like the Pres was trying to stop some public resentment so they created a hero, Willie Nelson wrote a song -- Old Shoe.

UCMJ ARTICLE 85. DESERTION

(a) Any member of the armed forces who–
(1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;
(2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or
(3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another on of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States; is guilty of desertion.
(b) Any commissioned officer of the armed forces who, after tender of his resignation and before notice of its acceptance, quits his post or proper duties without leave and with intent to remain away therefrom permanently is guilty of desertion.
(c) Any person found guilty of desertion or attempt to desert shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct, but if the desertion or attempt to desert occurs at any other time, by such punishment, other than death, as a court-martial may direct.

To the left, deserters are heroes. I believe that the Obama administration is sincerely surprised at the backlash.
