Greta Van Susteren asks if anyone is demanding that Justices Prosser and Bradley step down.

"Are any of the newspaper asking for them to step down? People have very serious disputes and their whole lives depend on decisions on the Supreme Court, and this isn't fair to the people. Are newspaper editors saying they got to go?"

The answer from her guest, Jason Stein of the Milwaukee Journal Sentinel:
You are right this is sort of funny, but no joke. One thing that I've heard the time when this all came out Governor Walker talked about the possibility of having an appointed rather than elected court. And that didn't go anywhere. It didn't seem like that proposal -- seems like it would be dead on arrival in our legislature. But certainly there's been a number of people saying, look, this can't go on. Something has got to change.
Total failure to answer the question!

Should Prosser and/or Bradley resign?
Yes. Both.
Yes. Bradley.
Yes. Prosser.
Yes. Prosser, Bradley, and at least one more.
Yes. They should all resign!

By the way, I'm hearing a rumor that Justice Crooks might resign. I don't know what that's about, but I was just reading about the 1995 election that originally brought Justice Bradley to the court. She defeated none other than Patrick Crooks in that election, and Crooks (who later won election, in 1996), was the conservative in the race, with the backing of Gov. Tommy Thompson and many Republicans. Bradley had the liberal backing, including the AFL-CIO. Both candidates portrayed themselves as "strict constructionists," and Bradley emphasized judicial independence and the importance of keeping the judiciary above politics. Crooks criticized her for her unwillingness to talk about how she would decide even cases that had been decided in the past. (Sorry for the absence of links there. I'm reading old newspaper articles, and they are not up on line.)

Crooks — who now votes in a bloc with Chief Justice Abrahamson and Justice Bradley, reaching liberal outcomes — called himself "the conservative for the court." When Bradley cited judicial ethics as her reason for refusing to address the issues, he said, after he lost: "I think it's unfortunate we didn't have a chance to show there was a clear, ideological difference between the two of us... It's important for the public to have a sense of candidates' judicial philosophy and how they go about making decisions." Bradley, by contrast, said she won because she refrained from labeling herself and Crooks did not. She said: "I think people ended up not wanting those kinds of conservative labels in a Supreme Court race... You have to be careful not to politicize the court."

A mere 3 years after joining the court, in 1999, Crooks considered resigning. He told the editorial board of the Milwaukee Journal Sentinel that the problem was the “way Chief Justice Shirley Abrahamson is running the court.... abusing her position by micromanaging the court system, making unilateral decisions on administrative matters that should come to the full court, and jeopardizing the court’s neutrality by awarding grants to groups with lobbyists and social agendas."

Crooks, you may remember, was the only justice who was not present for the "chokehold" incident. He had gone home for the day. On another occasion — in 2008, when Justice Bradley allegedly hit Justice Gableman in the head for calling the Chief "Shirley" — Crooks was — allegedly — reading the horoscopes. Crooks was born May 16, 1938. That makes him a Taurus. It says here: "Can you take the day off? Now is the perfect time to do just that. If you’re locked in for some level of responsibility, you can still make the most of your freewheeling energy by creating a party atmosphere." So... no announcement today, probably.

ADDED: From the investigative file (and relevant to Crooks's attitude toward the recent incident):
Justice Crooks said early in his tenure as Supreme Court Justice, he recalls a meeting in which Justice Prosser had called him a "viper" in an aggressive manner. Justice Crooks believed it was sometime around the fall of 1999 when Chief Justice Abrahamson was running for re-election for supreme court. Justice Crooks said he was not supporting her re-election at the time, and Justice Prosser was. It was during a meeting with the other Justices that Justice Crooks stated he was not going to support the Chief Justice's re-election. Justice Prosser had stood up and aggressively called him a "viper" during that meeting because he was not supporting the Chief Justice.  Justice Crooks recalled Justice Prosser had walked out of the room, and slammed the door hard enough to cause the glass to vibrate.    Justice Crooks said he had never forgotten that incident, and believes since then things have been either just as aggressive from Justice Prosser, and in some cases they have escalated.

Anyway, a long time ago there was a TV series called DALLAS. Or DYNASTY. And, they had a season end ... where Larry Hagman (?) ... who was Helen Hayes' son in real life ... gets killed. (Where the character gets killed.)

Oh, well. Starting again in October, Larry Hagman's still there. But the writers came up with "that was only a dream" sequence.

I'm sure by now ... that all the colleagues, together, realize the "choke hold" drama did not work.

Oh. And, Mark Bradley added a tidbit to the media ... saying his wife cries a lot. Two to three minute spurts. Before she can collect herself, again.

While "grandma's" mask has been tacked on. And, she's gonna have to come up ... when the Wisconsin Supreme's next season begins ... with some sort of "collegiate agreement."

If there were blackboards in the various chambers ... We'd probably see Bradley tasked with writing her "I'll never do that, again," sentence on the blackboard. Hundreds of times.

Crooks, meanwhile may resign. So the appetite to see if that's handled by a "special election," or a governor's appointment ... will probably be the season opener, ahead.

Holding the Supreme Court to Non-Political Standards is a Walt Disney World Fantasyland.

The Supremes can over rule the standing laws that protect property rights from the collectivist's dreams almost at will.

Therefore the Supreme Court majority is the first place a Re-distributor goes for power.

I no longer think they should keep it private. Let everyone know all about how dramatic they are.

I bet most McDonalds in Madison are run with more dignity and professionalism, and the people deserve to know that.

They should simply shut down this court. Let the lower courts work out a way to settle different interpretations.

WI needs a complete fresh start. It's time for a major reform, and I think a new final court filled with governor appointmees that are approved by a bipartisan committee and then voted on by the legislature.

Neither should resign, but based on what I've been reading, Bradley is right that Prosser should go to anger management - he seems to need it almost as much as she does.

Get them together with some of the protesters you've been taping. Maybe they can get a group discount.

Who should? Both. Bradley for charging with fists raised and involving law enforcement in the "chokegate" incident she provoked. Prosser for a documented pattern of childish antics including name calling, door slamming, and temper tantrums.

Who is more deserving of a forced resignation? Bradley, by a wide margin.

Who will resign or be forced to resign? Neither.

Most of it goes to Madison, and all of it (and a whole lot more) comes from state taxpayers so I really don't think she can complain.

Is there any reason why the justices have to ever be in the same room except to hear oral arguments? Are even oral arguments absolutely necessary? I think these people should never talk to each other ever and just stay in their offices . . . preferably in different buildings.

Not sure what you mean. About 1/2 of the property tax bill goes to the City and about 1/2 to Madison schools, with smaller percetages going to other entities (county, vocational school, the state).

So (assuming the google worked re Madison rates), her place is assessed at about $580M. That seems about right of a lawprof.

Being to lazy to look up housing values, I can only assume that half a million and change buys a fairly nice place in Madison.

I have worked with hundreds of people over the years in the business environment, and often issues are serious enough to have devastating affects on peoples' livelihoods and their families' futures, yet I have never seen people treat each other like this over disagreements at their job. The only people I know who act like this are children and drunks. Do they serve tequila at the court?

It just reinforces what I've learned through experience: that education, and credentials are nearly worthless in evaluating a person's character, or surprisingly, even their ability to do most jobs effectively, since most require the ability to work together and be honest and unemotional in your thinking.

This is most disappointing in a supreme court. The average citizen jury could probably do a better job with a lot less wasted paper and animus. Hell, a Jerry Springer audience could do it with less animus.

Just because you feel emotions and they are "truthful" doesn't mean you should show them.

Most of the time we shouldn't even be feeling anger. I know some people believe that it's a motivator but it also gets in the way of thinking clearly, which should be motivation enough.

I don't like the philosopher king model at all. I think the federally appointed judges and justices are not performing very well, especially at the top. Little abuses turn into huge antidemocratic errors that we are stuck with for centuries.

On the other hand, WI's way is just terrible.

I'm trying to think of a least-bad solution. Term limited appointees is one.

Some sort of reform seems necessary, but it's not my state. Texas elects her judges, and we certainly have our share of problems (Keller) but nothing like this, IMO.

Both should step down. I also think an ethics investigation should be conducted to determine whether any justices leaked stories in an attempt to undermine the reelection campaigns of their colleagues. Any justice participating in this type of political maneuvering should also step down

I don't get it. We know now that Walker's reforms saved the jobs of so many WI teachers.

So a few union shills don't get ridiculous and unfair compensation. So what? Who cares (other than them)?

I'd rather have more teachers paid a fair wage than a few elites paid too much while the system fails and the state runs out of money.

What's so hard to understand about that?

The easy way out is to take the attacker and the attacked and sanctioning them both for "bothering us."

Justice is deserved for men and women at the Justices level too. So far nothing but campaign slanders for political consumption has been churned out by Opposition Fiction researchers.

How come Greta didn't try to interview Bradley? Didn't Bradley say she "could go around this court, and outside it's circle of influence?"

For Greta that would mean people might actually tune in her show and watch?

But we all know when you're elected to office examples abound that we're gonna get stuck.

Voting is not like buying stuff at Macy's! No complaint windows. And, no place to return anything.

Walker promised property tax freezes and Politifact says the promise has been kept. The Legislature passed a freeze with a "sunset" provision, but Walker vetoed the limitation making the change permanent.

Trad. guy--don't you find it a bit amusing (sadly so) that all the the macho teabuggers have no problems siding with Prosser, a male who has a record of verbally abusing women, and who now is accused of assaulting Miss Bradley? Misogynists, or in tech. terms, punks, like their carny-in-chief, Rush Limblow. Politics aside, it's fairly obvious Prosser's got issues, and I doubt very much Miss Bradley would just have invented the story.

Real trial, sarge joto. Not a show trial. Just have Lord Prosser's victims testify.

Americans once held a healthier attitude towards our courts. And, judges really were held in high esteem.

Of course, in what I remember as the old days, it didn't take months to have a criminal case presented. And, in civil court you'd wait for a turn. But quite a number of cases got handled in one day.

Retired folk, (who didn't play chess in the park), would be the old-timers who hung around at courthouses. And, if juries were short ... they'd be approached and asked to serve.

Of course. Long ago. And, far away. Now.

But I thought the bedevilment of the system began when kids saw their mothers crying. And, suddenly they became the pawns in custody battles. I knew these kids would grow up feeling the courts stunk to high heavens.

And, that in reality there are no Perry Mason's. Faith got lost.

Here? People have even added a loss of religious faith to the list of losses. But I don't know.

I think we got the AGE OF REASON when the printing presses of Europe were able to put books into people's hands. And, this added to the discussions people then had.

The Internet? It sure is keeping us safe! Considering what happened to our media. (But the media's lost business. So the rule of thumb that satisfying customers ... has also been somewhat disproved.)

And, then? We got to Affirmative Action. Which should have been a great success. And, this, too, has not worked out.

I read a book about FDR's court. How all his appointments did not get along with each other. And, each one held a different point of view. Though the court, itself, became liberal. From that book I came away admiring Justice Black. But not Frankfurter. And, while Justice O'Douglas (sp?) was supposedly brilliant ... he got along with no one. And, used to take his court papers with him. And, go fishing.

The idea we now need teamwork "to get along?" I think that's terrible!

But you do need RESPECT. The people who "do it" ... need to develop a lot more respect for their colleagues. Not because it leads to arguments. IT SHOULD LEAD TO ARGUMENTS. But the arguments shouldn't involve idiots.

If we had doctors the way we have lawyers none of us would have good health! We've allowed the law to get corrupted ... becasue there's no price for playing politics.

And, we should also do "law" FASTER. Faster, please. What needs to change is the music.

What needs to grow (back) is a sense that we can respect those who are tasked to perform what goes on in our courtrooms.

This once existed. And, in my time it existed!

Sure. There was a judge I read about. Who had a desk. He'd push the front door towards the person sitting opposite at his desk. And, this person dropped money in.

CROOKS.

We've always had them.

But back then they didn't read horror-scopes.

(Meade that was wonderful of you to tell us what's in today's paper ... for Crooks. He wasn't a Christmas present. But I'm guessing he's born into the house Sagittarius. Oh, if we only had a House of Competence!)

After reading the Sheriff's report, I think Bradley's behavior was indefensible—especially after the incident. It doesn't take much inference to conclude that she deliberately misrepresented the facts and then arranged (or allowed) her version of events to become public to smear Prosser. As I've said before, the fact that her set-up of Prosser collapsed of its own hysterics, doesn't make it any less malicious.

Prosser should publically apologize for his role in the incident (I think it's likely he could have defused it early on) and Bradley should quietly resign.

It would have been far more interesting had Abrahamson written for the majority. In that case, I could see van Susteren perhaps holding a some kind of familial grudge.
But the high court found in favor of the elder van Susteren, and Abrahamson was in the minority. It's interest is historical and it does show that the two familes crossed paths in the past.

Rehnquist's rules limited the amount of time you got when you asked to speak ... at Monday's conference.

As to this particular situation ... Bradley (who said she'd go outside ... and around her colleagues) ... had been asking for "anger management" punishment to be meted out to Prosser.

I am not sure how that works, but it seems to me that a group, even if independently elected, if it has a head, that head is responsible for the welfare of the group. Ergo, the one to go there is Abrahamson. Unlikely to happen, but in a reasonable world, wouldn't Abrahamson have already resigned in disgrace for the group she stewards? I do not know anything about her except that she leads the group. Why haven't the other justices peered her out, or at least tried? Why haven't WI voters recalled her, or tried? But civil Battery is from an old original writ of Trespass vi et Aramis which is a quasi criminal intentional tort.

Georgia was an original 13, so our State "recieved" English Common Law and that writ reached our code of Statutes as a trespass intentional tort called Battery. As a newcomer, Wisconsin may not have used that approach.

Under a Battery action the jury could find $1 damage but award attorneys fees, without limit, and punitive damages in the Jury's enlightened conscience.

As for a slander action, a finding of actual malice would be necessary because B did not call P a criminal.

And that is unlikely to happen since Bradley had a plausible reason to tell her side of the bumping together incident.

Nope, she's a pathological liar and potential drug abuser who, according to police testimony, has repeatedly threatened and physically struck her fellow justices.

Also, no surprise that Crooks is desperate. Both Abrahamson and Bradley, given that they violently abuse and attack men, have likely given him no choice. It's quite possible that they have stated that, unless he does as they say, they will accuse him of sexual harassment, just like they tried to do Prosser.

You know, I think this situation was spontaneous combustion. Prosser was in Bradley's outer office because 4 justices were looking for their chief.

The "issue" was the Legislature's use (or non-use), of a Public Notice Law. And, the opinion was supposed to be published.

I think Ann Walsh-Bradley spontaneously erupted. From some reports, she was actually at her desk's computer NOT paying attention ... when Prosser said he was very disappointed in the Chief Justice.

As to heights, here, folks. People come in various and sundry sizes. Nixon was short, I think. But I also think his height is irrelevant to the story that the press can destroy people.

Shirley Abrahamson has been elected for decades. She knew how to go over to every group of people she ever saw. Stopping her car, sometimes, to get out. Introducing herself. And, shaking hands. And, telling everybody they had just met her. She did this even after she won her first time. It was her "schtick."

Like kissing babies. Everybody in Wisconsin probably could recognize her on the street. Since she made it a point of doing this. (Bella Abzug, from NYC, did this by wearing hats. And, working Second Avenue.)

As long as people voted for Shirley I can't really see why her political philosophies (which are very liberal), should get her fired. Or dismissed. That's the job OF the People.

ON the court, however, (and I learned this when I learned about Rehnquist. And, how Sandra Day O'Connor ran circles around him!) ... O'Connor not only "gave her vote" ... she gave it in return for writing majority opinions! Rehnquist was more doctrinaire.

Again. We've had some doozies who've been elevated to high places. (In particular, the book on FDR's court was grand in explaining not just the laws that got passed ... but HOW these men ... all with big egos ... developed an angle different from the rest.)

No one will find out who leaked. No journalist would want to give up this name.

All we have for evidence is that Bradley tried to force her colleagues in going after Prosser on a FAKED criminal charge. But this fell flat.

You just can't ask for resignations. I think that harms our Constitution more than anything!

I also believe that karma somehow comes into play. And, because of KARMA ... we can wait out a few lousy politicians.

Here? I think voters, who NEVER paid attention to the legal skills that any particular candidate possessed (or didn't possess) ... Has become educated.

That's enough. I don't ask for more.

That Shirley Abrahamson wears her grandma's mask? You bet! PERFECTED HER PERFORMANCE. But she's not in the majority on that court!

Bradley? She'll have to deal with her colleagues. I think she's lost something.

Just as I think KELO took out Souter! And, he quit. Not just leaving damage in his wake. But leaving his reputation in tatters.

All of them care about that!

Americans learn. Where at first, I think, all they do is get surprised.

Having information makes tremendous gains ... after people become alert to what they didn't even know was a problem.

Given time, People who vote, will begin looking at candidates with sharper eyes.

Interesting - Slander is harder to prove in the American legal context. For slander I believe he would have to prove her words were literally not truthful. I think in the USA it's a high bar to prove slander & it would be difficult if his hands were literally on her neck.

Not sure, but I also believe it would have to be proven that she said something in some sort of public forum with the intent to harm reputation. In the investigation she keeps talking about anger management - so again, hard to prove. Doubtful he'd get damages and he wouldn't come across as an angel, so I doubt it would sell well to a jury.

Hard to beieve this comedy show is still going on--not much of import going on in WI--ice fishing season is over and deer season hasnt started--It will all end when deer season starts and wisconsinites get down to important shit.

Wisconsin--at least the Madison branch, is rapidly becoming a long running comedy show--you people are really fucked up

I'm not a lawyer. But I don't think Prosser can pursue a civil suit.

He can't prove who "leaked" this story beyond the walls of the courthouse.

And, inside the courthouse Bradley could have yelled out "MY PANTS ARE ON FIRE" ... Instead of what she said.

Prosser can't sue her for the Tubbs demonstration, either. Because he didn't write up any report.

Now, there's another reality test.

Ann Walsh-Bradley is super crazy. Walking away is the BEST option.

Next time? I'll bet Prosser walks away ... And, when he starts going ... he increases his pace!

Bradley's still got a problem.

The job of these "supreme-O's" is to VOTE on cases already decided "below." I think if Bradley makes known there's a case she supports? All her colleagues look at the ceiling. Or do other stuff. So no one comes along and offers a "second."

We shall see, though.

I know the FIRST MONDAY in OCTOBER ... starts the ball rolling up at our DC supremes. And, sometimes, I think it's gonna be hard for some of them to get up in the mornings ... let alone complete their terms.

Most Americans really begin to pay attention only after Labor Day, anyway.

While the press will always claim "it's a nail biter."

If Obama tanks? He should stay away from Dealey Plaza. And, Biden is no great protection! He looks like a clown. But that's our system.
