"She is a Harvard-trained lawyer who broke the law."

Oh, come on. Why would someone who went to Harvard Law School know what all the piddling little statutes and ordinances are? Elite law schools are for teaching high level concepts. Specific rules are for the little people.

Remember, Obama said: "I do have an obligation to make sure that I’m following some of the rules." Some of the rules. He went to Harvard Law too. Don't you see? You pick some rules that it will serve your interests to follow, follow those, and then preen about your amusing law-abidiness.

It's only her husband that's the chief law enforcement official in the country, not her. She shouldn't be held to the same standard. You know, that standard that is presiding over tens of thousands of military votes being completely, utterly disenfranchised. I've not heard any fixes for this yet. Just finger pointing.

I think this could be reworked to express the way Althouse has come to dislike BHO:

Take out the Midwest small town stuff, and replace it w/ whatever it is BHO has done or not done which has so shocked Althouse (because apparently she wasn't listening (or was selectively listening) during the campaign).

Voting polls are like a church confessional in my experience [and I am from Philly]. You go in and you vote with a kind of calm and reverence around you and inside the poll itself. Most people are quiet and keep to themselves.

How many times have you seen TV footage of some candidate and his spouse voting early in the morning? I have never seen any act like they are campaigning.

Maybe the Obamas are feeling the heat.

True, all too true. But a Harvard-trained lawyer would know not to flaunt it. A better defense for the FLOTUS, and something that any Harvard-trained lawyer would think of instantly, is that her brief encounter with another voter wasn't electioneering in any relevant sense, and it's not what the statute was aimed at. Everyone knew who she was, and in context, her role was mainly belle of the ball. A brief conversation with someone she didn't know, touting her husband's team, was merely being gracious in the formal, accepted manner of American politics.

There hasn't been a single day where I've regretted casting my BHO vote, i.e. I never think 'wouldn't we be better off if only McCain had won.' Not one day.

That's not the same as claiming BHO is infallible. I wasn't one of those folks singing BHO tribute songs as I drove around w/ BHO's image airbrushed on my car.

Early voting appears to have different rules, because the Illinois legislature made an additional electioneering rule for early voting. Only electioneering is prohibited, campaigning and political discussion (prohibited on Election Day inside polling places) is not:

(10 ILCS 5/19A‑70)
Sec. 19A‑70. Advertising or campaigning in proximity of polling place; penalty. During the period prescribed in Section 19A‑15 for early voting by personal appearance, no advertising pertaining to any candidate or proposition to be voted on may be displayed in or within 100 feet of any polling place used by voters under this Article. No person may engage in electioneering in or within 100 feet of any polling place used by voters under this Article. The provisions of Section 17‑29 with respect to establishment of a campaign free zone apply to polling places under this Article.
Any person who violates this Section may be punished for contempt of court.

None if you show up in your precinct polling place and vote on election day. Early voting is different because there are far fewer polling places, making the chance that one of the election workers knows you personally quite small.

(b) In conducting early voting under this Article, the election judge or official is required to verify the signature of the early voter by comparison with the signature on the official registration card, and the judge or official must verify (i) the identity of the applicant, (ii) that the applicant is a registered voter, (iii) the precinct in which the applicant is registered, and (iv) the proper ballots of the political subdivision in which the applicant resides and is entitled to vote before providing an early ballot to the applicant. The applicant's identity must be verified by the applicant's presentation of an Illinois driver's license, a non‑driver identification card issued by the Illinois Secretary of State, a photo identification card issued by a university or college, or another government‑issued identification document containing the applicant's photograph. The election judge or official must verify the applicant's registration from the most recent poll list provided by the election authority, and if the applicant is not listed on that poll list, by telephoning the office of the election authority.

*One of the poll workers on election day may challenge your identity. In that case if another voter, known to the pollworkers will swear that you are who you say you are, then you can vote.

Jim Allen, public information officer at CBE, noted that Fox News and other media outlets had taped Obama’s visit to the polling place and “nothing could be heard.”

He stated that it was Mr. Campbell who “initiated contact with Mrs. Obama not the other way around,” and added, “Electioneering is only punishable if someone is approaching voters, warned to move out of the election zone, and then persists.”

Therefore, if anybody violated the law, it would have been Campbell, the voter who approached the first lady, Allen suggested.

I lived in Chicago when Harold Washington beat that alcoholic, Jane Byrne. You should have seen the polling places. My precinct captain was @ our house 2-3 times a week, bringing tins of cookies, bottles of wine, etc. On election day he was in the polling place politicking as were others. Yeah..it's wrong, but you have to know Chicago. This is not even small potatoes, it's half a french fry[which our health nut first lady was seen eating]. Lighten up, prof. There are much bigger fish to fry.

As I linked, the pool report from the Sun-Times didn't contain anything about Michelle being "inside the voting center". Yet, Drudge reported the complete opposite:

According to a pool reporter from the CHICAGO SUN-TIMES at the scene, the conversation took place INSIDE the voting center, not far from the booths.

What facts to you believe they have been presented with? I have found no account that claims the conversation took place outside the polling place. According to Drudge, the pool reporter says it happened inside. The pool report does not state this, but maybe Drudge has contacted the reporter directly. And a Chicago elections official has disputed the content of the first lady's statement, saying it was not electioneering. He did not dispute where the conversation took place.

So again, what facts are you referring to?

My first reaction was that she should make a brief mea culpa, apologize and move on. It was a silly, thoughtless thing to do, but the harm was minimal--until she stonewalled the apology. Now a minor blunder is another Let Then Eat Cake moment.

As scandals go, this falls somewhere below trivial. A few moments of conversation may be a technical violation, but it's worth no more than a stern warning at worst. Continuing in the face of a warning or passing out pamplets are the sort of violations we're really supposed to pursue. My dad was an election worker most of his life, and I did a turn as an election observer, so I take these laws seriously; but I've heard worse "violations" than this in every election line I've ever been in. As long as it's a short, discreet conversation and not active promotion, it's no big deal.

And comparing this to the NBPP case only trivializes the NBPP case.

A lot of people (libertarians especially) complain that we're outlawing way too many things that just shouldn't be the state's business. I think this is one of those.

But we don't know exactly where she was during the conversation, and whatever she said, from what we know, wasn't breaking any laws. If anyone broke the law, it was what the other guy said who she was talking to! You certainly wouldn't know that if you just read the title of this post.

Nor would you know that if you actually read the reports, since only one person in one report said that, while the statement attributed to her in other reports would appear to be a violation on her part.

This is a trivial matter. I don't know if she did or did not break the law, and even if she did the correct response is a polite warning.

When I was in high school, I planned on getting an MBA. I was under the impression that the elite exposure in Ivy League would teach me how to be (basically) a successful financial criminal - and how to keep it just this side of legal.

It was pure instinct at that point since my family was professional, but naively so - not super-connected, but I was correct in the long run. Derivatives and the financial shenanigans Jon Stewart castigated Mad Money Guy for were exactly what I had in mind in my half-formed, semi-clueless, pubescent way.

I suppose it's cynical, but even as a kid, I couldn't imagine anything else being the point of an Ivy League education.

Unfortunately, my truth-oriented, engineering-derived genetic code came back to bite me on the ass big time and I have failed to fully live up to my supersmart, skeevy exploiter of the weak-minded youthful ideals.
