Mike Lee — lawyer, former federal prosecutor, and current member of the Senate Judiciary Committee — has a lot of questions about the Mar-a-Lago raid...

... so many that he lost count. I'll copy them all, and don't think I skipped one (he jumped from "Third" to "Fifth" [ADDED: and from "Tenth" to "Twelfth"]):

As a lawyer, former federal prosecutor, and current member of the Senate Judiciary Committee, I have a few questions about the FBI’s raid of Mar a Lago. First, did Attorney General Garland personally sign off on this action?

Second, why break into the safe rather than seize it, take it into custody, and then seek a warrant to open it?

Third, why obtain and execute a search warrant rather than first seeking the items in question either through an informal process or with a subpoena? 
Fifth, perhaps there’s something here we don’t know—something that, once known, will clarify the reasons for the raid. If there is, FBI needs to bring forward the justification for this unprecedented action—as soon as possible. But if there isn’t, we’ve got problems at the FBI.

Sixth, classification authority belongs to the president of the United States — and NOT to bureaucrats at the National Archives.

Seventh, if this turns out to be the product of the growing political weaponization of federal law enforcement agencies, shouldn’t this incident cause all Americans to be even more outraged by the Democrats’ plan to hire an additional 87,000 agents?

Eighth, how is this aggressive action defensible in light of the FBI/DOJ treatment of Hillary Clinton, who was never subjected to a raid like this, even though she (1) mishandled classified material, and (2) destroyed evidence?

Ninth, what should we make of the fact that this is occurring while FBI and DOJ have taken no discernible action regarding (for example) flagrant violations of the law by (a) Hunter Biden, or (b) pro-abortion extremists threatening Supreme Court justices at their homes?

Tenth, why should we assume that the FBI is above targeting Republicans when it creates documents like this one, which encourages agents to be suspicious of people who display the Betsy Ross Flag or the “don’t tread on me” Gadsden Flag?

Twelfth, shouldn’t all Americans be suspicious of the FBI based on its use of warrantless “backdoor searches” under Section 702 of the Foreign Intelligence Surveillance Act (about which Christopher Wray expressed very little concern when I questioned him at last week’s hearing)?

These questions should all have been thought of and considered in advance. What are the answers?

Sixth, classification authority belongs to the president of the United States — and NOT to bureaucrats at the National Archives.

SO AN EX-PRESIDENT HAS THE AUTHORITY TO TAKE WITH HIM ANY DOCUMENTS HE WANTS? AND THE AUTORITY TO RECALLISFY DOCUMENTS AFTER HE LEAVES OFFICE? DON"T THINK THAT IS THE LAW.

Seventh, if this turns out to be the product of the growing political weaponization of federal law enforcement agencies, shouldn’t this incident cause all Americans to be even more outraged by the Democrats’ plan to hire an additional 87,000 agents?

The Russian Dossier was used by the FBI to conduct a multi-year investigation into a sitting President. No question they will have faked evidence of wrong doing by Trump to support this raid. The question is will it be more plausible than the Steele Dossier? I don’t think so, because they haven’t shown proficiency in doing so.

The opportunity to avoid where we are today, was after the fraudulent election in 2020. The Supreme Court cowered and refused to hear the Texas vs. Pennsylvania case.

Althouse openly blogged that she hoped they would refuse to hear the case, even though it was a completely valid lawsuit and argument. "Moving on" from corruption only allows it to grow bigger and stronger. That is what has happened.

You don't have a fair, clean, voting system when most states follow sane, traceable, auditable election laws...and the purple ones to rogue in blue metropolitan areas. Now we live with the consequences of those that hid from the obvious 2020 fraud.

If you think the Supreme Court did damage overturning Roe, that's a nothing burger. Refusal to address voter fraud in a time of crisis more than likely has ended our Constitutional Republic.

It's probably too late. Half of American has been successfully programmed to believe 2020 was the "cleanest election ever". And even liberals who don't believe it support voter fraud and the elimination of due process for their enemies. Take the population of Madison, WI and Dane County for example.

By all appearances, the FBI has been conducting an investigation and surveillance of Donald Trump since before he was elected, while he was President-Elect, and throughout his presidency under conditions that have since been determined to be fraudulent including:
- False filings with FISA
- Using unverified claims by the opposition to justify an investigation
- Altered written remembrances of interviews with major national security figures 5+ weeks after the interview, while refusing to record the interview.

And despite this, the FBI has never brought charges against Trump related to criminal actions. By contrast, multi-year long investigations have explicitly cleared him of wrongdoing on several occasions.

What has the FBI or the DOJ done to restore trust? Why is now an armed raid required and what new action by Trump required such?

I'm growing increasingly concerned that the DOJ is not held accountable by the executive over multiple administrations.

An ethical Department of Justice and FBI concerned with the well being of the American people and protecting the constitution, would have put this type of effort into investigating the 2020 voter fraud.

Instead, we know they are part of the fraud. Trump and the Americans who sent this outsider to Washington now must be stamped out and punished. We will see if the independent self-governance spirit of Americans still exists. I don't think it does.

In 2022 America, self-preservation is a more valuable virtue than self-sacrifice. The way we behave today shows zero concern for the freedom and future of our children. This is most evident in the education establishment, and at Universities ripping kids off to support bloated administration.

My guess is many America First/MAGA supporters will disappear off social media and go into "hiding". They have now approved 87,000 new IRS agents to go after these people, further weaponizing the IRS. Likely, this will all be a successful voter suppression effort.

I'll go vote in the WI primary today, but I know even inside me there is a part that just wants to say "fuck it". Let them have what they want. "I just want to get my kicks before the whole shithouse goes up in flames".

My first thought was that the FBI hates and fears Trump so much that they've gone rogue, but on reflection, it's clear that somebody higher up must have approved this. I suppose Biden did "approve" the raid in the sense that when he was told it was going to be done he didn't object, but it does make one wonder just who is actually calling the shots in the White House.

Why didn't DOJ prosecute Hillary Clinton? Because they didn't want it to be thought that we were a third world country where those who win elections prosecute the losers. Not prosecuting wasn't necessarily a bad choice for the government to make. People who offer the "two wrongs don't make a right" line now to defend the raid, would have been loudly screaming that prosecution of Clinton meant that Trump was becoming a dictator. You know it, I know it, and they know it themselves.

Well, Jim5301, apparently history started last night for you... (For example - isn't there now an investigation into H. Biden's possible influence peddling? Why yes there is - but didn't we have the very evidence used to open that investigation literal years ago? And is that investigation not being narrowly focused on only Hunter's potential wrongdoing rather than including the actions of the President, who after all would have to play along in order for the scheme to work?)

Many of Lee's questions were predicated on what has happened already, but your answers, such as they were, demand that we all give the Federal apparatus a level of benefit of the doubt that we might have before they showed themselves to be partisan clowns.

Or we might not have, because there is no requirement that citizens show any sort of respect for or deference to the federal bureaucracy or the party currently in the executive branch. But, for instance, when you hear that the IRS is given license to "investigate" (or, as pretty much all Americans see IRS investigations, "harass") people flying a Gadsden flag, your response is, "they probably deserve it"?

Do you hear yourself? Do the usual exercise: if the parties were reversed, would you feel the same way? Because I myself have little sympathy for your side, but I'd damn well see these actions as dangerous to the Republic if they were leveled at them - if, for instance, the IRS received guidance that they should pay special attention to people sporting pussy hats. If, for instance, the FBI under Trump had conducted a raid on Obama's civvy home on no better evidence and with no better justification than what we've seen here.

Comey took classified data home when he left office. Agents simply went and got them back. H. Clinton had tons of classified on her personal phone and server and nothing happened at all. I bet Obama took some with him. They want nevertheless to indict a former pres on this basis so he cannot run again and jail him if they can. This is very serious. The law was never meant to lead to the arrest of a former pres. Trump really makes them crazy.

An amusing thought I had today:
We need to get rid of the Civil Service laws, and fire every single Democrat getting a Federal gov't paycheck
This is not a "moderate" thing to do
However, we know that pretty much all the "squishes" are corrupt.

Destroying the records would be a far more serious crime than what Trump's accused of.

So if you honestly want Trump in jail, giving him the chance to hang himself by doing so is far and away your best bet.

The only reason to do it this way is because you know there's no real crime, so you want to create the appearance of one.
