"A California man carrying at least one weapon near Brett M. Kavanaugh’s Maryland home has been taken into custody by police after telling officers he wanted to kill the Supreme Court justice..."

"... according to people familiar with the investigation. The man, described as being in his mid-20s, was found to be carrying at least one weapon and burglary tools, these people said, speaking on the condition of anonymity to discuss an ongoing investigation.... Two people familiar with the investigation said the initial evidence indicates that the man was angry about the leaked draft of an opinion by the Supreme Court signaling that the court is preparing to overturn Roe. v. Wade..."

AND: This is absolutely right: "So Long As Dobbs Remains Undecided, The Lives of the Justices Are At Risk/The Dobbs 5 should immediately issue an unsigned per curiam order, with an opinion to follow, even over the Chief Justice's objection" (Josh Blackman at Volokh Conspiracy).

But Sotomayor would never sign on to something like that (Breyer and Kagan - and RGB would), because she has indicated in words and actions that abortion is a holy sacrament which must be preserved at all costs.

I think, were Roberts in the majority, if indeed Roe is going to be overturned (still to be shown), the opinion would have been released the day of the leak. I think Roberts has held it back in an attempt to change the outcome.

How can you even state the holding of Roe in one sentence?

You could say "judgment for the petitioner" or "judgment for the respondent - peace out," but any serious explanation of what that means for the next case down the line would take more than a line - more than a page, even.

Unless of course the Court stops publishing 100 pages of dicta with each decision, and lets lower courts use common-law analogization and distinction again. But this is a funny case to start with.

I would "alter procedure" by arresting Schumer for incitement. He specifically warned Kavanaugh two year ago. This is another James Hodgkinson case. We've never seen the correspondence between him and Senator Durbin.

'Ruth Sent Us' doxxed all of the Conservative Justices. Again- threats are what the Left does. Threats of violence.
In 2020 the Left threatened all out mayhem if Trump won the election.
Today the Left threatens all out mayhem if the Supreme Court comes out with a ruling to remove Roe v Wade.

And even though the Democrats and our Department of Justice regularly tells us that it is White Supremacists who we have to be worried about, it seems the actual threats, damage, and carnage is almost always coming from the Left.

Despite the games that our President, the DoJ, and Homeland Security people play, the reality is that the Left is full of crazy people who constantly threaten the nation at large. Their next step of anarchy- if taken- will unleash things no one is going to want to see. This is not play time any longer. IF we get through the Biden years without any major event I'll be shocked. That we don't act on these things, and in fact, encourage them (as so many Democrat leaders and media people have done) is beyond reprehensible. Ultimately there will be a price to pay- either in the streets or at the ballot box.

This is absolutely WRONG. The justices have had this case for six months now. Time for Sotomayor to get off the pot with her hysterical dissent. There is no reason the entire full opinions cannot be released come the next opinion day.

The Court's minority is entitled to know the majority's reasoning, and the majority is entitled to dissent's reasoning, so that opinions may be responded to and adjusted accordingly. Releasing a per curiam with opinions to follow is a Charlie Foxtrot method of constitutional law. The judgment might actually change between the time of the PC and subsequent opinions.

Releasing a PC now lets the insurrectionists win.

According to police the suspect arrived in front of Kavanaugh's house in the early morning in a taxi carrying a bag. In the bag he had a Glock 17 9mm pistol, a "tactical" knife, zip ties, duct tape, various tools useful for breaking into a house and he had covered his shoes to either muffle his footsteps or avoid leaving prints.

When he saw the US Marshalls on guard he turned and walked away. Then down the street he called 911 and said he was suicidal and admitted to wanting to kill Justice Kavanaugh. He was arrested there.

Certainly appears he was ready to do something and might have been scared off by the presence of the US Marshalls.

Here is a link to the FBI affidavit supporting the arrest of Nicholas John Roske. He got out of a taxi in front of Kavanaugh’s house, carrying a briefcase containing a Glock, magazines and ammo, a knife, a tactical light, etc etc. He admitted wanting to murder Kavanaugh because of the leaked draft opinion (written by Alito!).

It's well established precedent that if a judge dies before a decision is released, the judge's vote doesn't count.

So delaying the release of the decision is tantamount to encouraging people to murder one or more of the 5 before the decision is released

"The arrest of this individual proves these threats to the Justices' lives are horrifyingly real, and it's unconscionable for House Democrats to leave their families without police protection for even one more day," said Republican Sen. John Cornyn of Texas in a statement. "Speaker Pelosi must keep the House in session until they pass my bill."


She should get all kinds of fucking questions about the safety of Supreme Court Justices and why she's slow-walking this bill.

Second, although under questioning he mentioned being upset with the draft Dobbs opinion, said he acted because he was upset with the Texas school shooting and picked a target he thought would write a loose second amendment opinion.

Of course God has given us free will. And anybody can do anything. But this is strange...

When Mr. Roske arrived and saw the two deputy marshals, who were standing next to their parked car, he started walking down the street, according to the affidavit.

Soon after, the Montgomery County Emergency Communications Center received a call from Mr. Roske, who said he was having suicidal thoughts and had a firearm in his suitcase, according to the affidavit.

He said he had traveled from California to Maryland “to kill a specific United States Supreme Court justice,” the affidavit said.

Officers from the Montgomery County Police Department arrived and found Mr. Roske still on the phone with the communications center.

Mr. Roske was taken into custody without incident...

I doubt very much that she wants people to assassinate Justice Kavanaugh. It's the opposite of what she wants. She has to know, as a politician, that assassination swings public opinion way the hell away from what the assassin wants. Politicians on the side of the assassin are acutely embarrassed. And they all know it looks bad.

It's more accurate to say she didn't care and she wasn't thinking about it.. If you had asked her, she probably would have said, "Other things are more important right now."

It's when you are not thinking, and not paying attention, that the little voice that runs your subconscious does its work.

Obviously there is a big political fight over this. But there's also, I think, a spiritual fight going on as well. Pelosi is in a fight with her church about whether she can have communion. I'm sure she's angry about that. But (obviously) letting assassins kill your enemies is not the way to go.
