"Judge Delays Trump’s Sentencing Until Nov. 26, After Election Day."

The NYT reports.

As I predicted.

The NYT assesses this development: "It is unclear whether sentencing Mr. Trump in September would have helped or harmed him politically; his punishment could have been an embarrassing reminder of his criminal record, but could have also propelled his claims of political martyrdom."

Could have? Ah, yeah, maybe ….

Since the real crime is lese majeste, the judge needs to see if Trump wins the election, since that will require a sentence enhancement. Same with Jack Smith's case:Trump's election converts the charge of inciting an insurrection into high treason, turning it into death penalty case.

Merchan just proved this whole trial was a political matter. But I guess we don't have our Bastille Moment.

I think somebody looked back to the mug shot fallout and decided not to make Trump even more of a folk hero than he already is. Trump wearing the Nelson Mandela look was, I assume, a sane Dem strategist's nightmare regardless of how much the rank and file idiots wanted it.

Good decision by Judge Merchan. Trump will be sentenced on November 26, which is fine. It will be chaotic enough from now until Election Day, we don’t need more. If Trump loses, which I think he will, sentencing him on Nov.26th will just give him a bit of a reprieve, then he can serve out the rest of his sentence. If he wins, he will still be sentenced on the 26th which is before he would be sworn in to take Office. So he could serve his sentence from Nov.26 to Inauguration Day.

Smart move by the Wrecker's Party lawfare tacticians. In the ensuing post election chaos, when the most pressure is on DJT, he'll be summoned to court. It's a shame that the Stupid Party can't do this kind of thing when they're in power. Think about it: Who appoints a partisan Dem to be their #2 DoJ official? Who recuses right when they are needed? It doesn't really work if the only people who think it's legit are delusional cat ladies who were going to vote against Trump anyway. The effect of the lawfare on everyone else is to make them more inclined to support Trump, not less, probably by a ratio of about 5 to 1. Look how far he's bounced back in terms of his reelection chances from January '21 to today.

No matter the outcome of the election, this goes in the trash afterwards. "Sentencing delayed pending appeal", etc., etc.

Gusty Winds said...

They must be confident in the upcoming voter fraud operation. Harris gets installed, Trump goes to prison after the election. This wasn't an independent decision by the judge. Then they go after Elon Musk.

Gusty Winds said...

Do we really believe Merchan made this decision all by himself? He railroads Trump during the trail. That was all coordinated outside the court. Now he magically decides to delay sentencing all on his own? Bullshit.

Dogma and Pony Show said...

I think pushing back sentencing until after Election Day means no jail time for Trump regardless of the outcome. If Trump loses, there will be no reason for Merchan to seek to imprison him. If Trump wins, he won't have the guts to try it.

Keep in mind that what the judge has been doing is unethical, bordering on criminal. He starts off being massively conflicted, with his daughter pulling in $millions$ from various Dem sources to her company based on her father’s handling the case. Then add in that he will ultimately be reversed. The only question is what court will be doing it, and how hard he is slammed down. His verdict is one of the largest Due Process violations I have seen. Start to finish. The charges shouldn’t have survived a preliminary motion to dismiss, probably with sanctions against the state. Up through the jury instructions, that didn’t require the jury to agree n a single charge, enhancing the alleged crime from a misdemeanor to a felony (and goring that none of the additional charges were triable against Trump in the first place). Then, the judge refused to reconsider the verdict after allowing potentially immune Presidential testimony and actions into evidence, after the SCOTUS opinion on Presidential Immunity.

Why the potential legal exposure to the judge? Because he has been openly interfering in a Presidential election. Will his own immunity protect him? Maybe not, given the egregiousness of his actions and abuse of office.

"The jungle drums must be beating really loud to not do this before the election. I'm just really disappointed that no serious, constitution following judge has not put a stop to this nonsense."

That's precisely why Merchan delayed. Its all reached a point where the higher level courts would immediately have to step in and smack Merchan down after he's gotten away with complete and total violation of Trump's rights as well as violation of the constitutional issues.

I personally was hoping he would sentence Trump to jail immediately as it would have blown up in the New Soviet Democratica's faces, which is, and lets not kid ourselves, the ONLY reason Merchan delayed.

Drago said...

"If Trump loses, there will be no reason for Merchan to seek to imprison him."

I beg to differ. Its been made quite clear by the dems/left/GOPe/deep state/lawfare alliance that they will not stop until Trump is in prison, his family is in prison, his companies are destroyed and all of Trump's supporters and allies are imprisoned as well.

The New Soviet Democraticals are out for full power now, and the jig is up on their doubletalk. They have nothing left to lose by pushing full steam ahead to rid themselves of all their enemies, legalize their 25 to 30 million illegal alien voters, pack the Supreme Court and get rid of our first and second amendment rights.

They don't even bother hiding it anymore, like Starmer in the UK, Macron in France, the entire EU cabal in Brussels, etc.

Rabel said...

"If Trump loses, there will be no reason for Merchan to seek to imprison him."

I have to say that that doesn't accurately reflect the motivations of his persecutors.

Also, FWIW an appeal can't begin until after sentencing.

I get why judges do this. But I think that they’re abiding by norms that their audience doesn’t care about.

Trumpists will find any procedure that holds Trump accountable in any way to be illegitimate. Trying to frame process that’s legitimate to them is a sucker’s game.

Like trying to convince a Democrat that the 2016 election was legitimate. Or the 2000, for that matter.

Mike (MJB Wolf) said...

Or maybe they are just so damned stupid they can't help it. Let's face it, Obama set a bad Democrat trend when he dug to the bottom of the Senate and pulled old Joe out to be his VP. It proved the old adage that Type Bs always pick Cs and Ds for staff because they are afraid of being shown up. Well now we now the D type can dig even farther down and pick Es and Fs. Kamala is so insecure she picked the dumbest emotional support governor she could find. I thought Hochul was lacking brain cells but I'm really impressed by how dumb Walz is. There cannot be another governor with a lower functioning brain than him. He makes AOC look sharp. He makes Liz Warren look principled. And has been oft noted, he makes other 50-year-olds look 35 next to his alcohol-damaged face.

No. WHEN Trump loses, sentencing will be the tool to dissuade Trump from claiming fraud. They need leverage to cut a deal and they've been working to create it for many years.

Mike (MJB Wolf) said...

The whole trial was illegitimate. It was like charging someone for jaywalking but filing each step the perp takes to cross the road as a separate count so that he's charged with say 34 counts of jaywalking instead of one.

There are no other examples of such count-stacking you can find. So of course it's illegitimate. And all you have to do to prove me wrong is show one other person in all of NY State's history that was charged in this way for "improperly accounting for an expense" (which is a misdemeanor).

Just one example. Surely if it's on the up-and-up there's at least one other case that's at least similar.

It would the intellectually smart thing to do, yes, but not politically smart. The verdict will get overturned eventually because the case was completely illegitimate, but the political goal was the conviction itself. Of course, the conviction didn't work the way the Democrats and Merchan had hoped but that is water under the bridge now- a sunk cost.

“I am writing to you concerning potential ethical issues with respect to Acting Manhattan Supreme Court Justice Juan Merchan. On May 21, 2024, I filed a complaint against Justice Merchan concerning his presiding over the pending criminal case of former President Donald J. Trump. The New York State Commission on Judicial Conduct (the Commission) rejected the complaint on July 3, 2024. As of today, President Trump is scheduled for sentencing on September 18, 2024, at which he faces up to 136 years’ imprisonment. New information has come to light that merits a fresh look into Justice Merchan’s conflict. Neither the Appellate Division nor the Advisory Committee on Judicial Ethics could have known about this material when they issued opinions as to Justice Merchan’s continuing to preside over President Trump’s case.”

“On July 21, 2024, President Joe Biden announced that he would not seek a second term. Within a few days, Vice President Kamala Harris was anointed to become the Democrat Party’s nominee for the presidency. During his campaign, President Biden used one company, Amazon Web Services (AWS), for the campaign’s web hosting services.1 President Biden’s campaign paid AWS throughout 2023 through the suspension of his campaign in July 2024. On August 20, 2024, Vice President Harris’s campaign submitted its first Federal Election Commission (FEC) report that documented expenses and donations through July 31, 2024. In the report, specifically on Form 3P, line 232, a July 30, 2024, disbursement appears in the amount of $468.00 from Vice President Harris’s campaign to Authentic Campaigns Inc. (Authentic) for web hosting services. This indicates that one of the very first things that Harris did upon taking over the Biden campaign infrastructure is to hire this firm, Authentic.”

“Authentic is a digital consulting and marketing firm that services Democrat candidates. Loren Merchan, Justice Merchan’s daughter, is its president. Vice President Harris changed web hosting companies from AWS to Authentic immediately after becoming the presumptive Democrat presidential nominee. As the FEC report’s filing did not occur until August 20, nearly a month after the Harris campaign and Authentic had begun doing business, no one in the public, including the Commission, could have known of the relationship. This is merely the beginning of a new contract with a new campaign, regardless of the amount reimbursed. Sure, there’s an immediate benefit, but this is a play at a potential larger benefit for Authentic and Merchan down the road.”

“The Code of Conduct, specifically § 100.3(E)(1)(d)(iii), dictates that a judge must recuse from a case where a relative up to and including the sixth degree has a financial interest in the outcome of the case. Ms. Merchan is related to Justice Merchan in the first degree. Authentic has a newly active financial relationship with Vice President Harris’s campaign. President Trump’s sentencing, an event which will garner worldwide media coverage, is imminent.”

“This event, a month and a half prior to the November 5 election, could have a profound impact on that election; indeed, some states will have commenced mail voting by that date. Given this revelation of a brand-new conflict of interest for Judge Merchan, I respectfully request that the Commission engage in a fresh inquiry concerning Justice Merchan’s conflict and take any appropriate action resulting from it.”

Bruce Hayden said...

Note that the rule uses the word “must” instead of “may”. Marchan MUST recuse himself if his daughter has a financial interest in the case. She does. And, of course, that conflict of interest can be put on the back burner until Trump is sentenced. And after the election the conflict of interest essentially disappears.

The reason the judge delayed the sentence is because it was too obvious to have put him in jail. He'll be sent to jail AFTER November 9th.
