About the Kavanaugh accusation, Trump says "I don't want to play into their hands."

I think the Democrats believed the Kavanaugh accusation would play out differently, that Republicans would resist and obstruct, but Trump saw how they were playing and chose not "to play into their hands."

Here's the quote in context:



"I feel so badly for him that he's going through this, to be honest with you. I feel so badly for him. This is not a man that deserves this... this should have been brought up long ago and that's what you have hearings for, you don't wait until the hearing is over and then all of a sudden bring it up. When Senator Feinstein sat with Judge Kavanaugh for a long period of time a long, long meeting. She had this letter, why didn't she bring it up? Why didn't she bring it up then? Why didn't the Democrats bring it up then? Because they obstruct and because they resist. That's the name of their campaign against me. Resist. And they just obstruct. And, frankly, I think they're lousy on policy and in many ways they're lousy politicians, but they're very good on obstruction. And it's a shame. Because this is a great gentleman. With all of that, I feel that the Republicans, and I can speak for myself, we should go through a process, because there shouldn't even be a little doubt. There shouldn't be a doubt. Again, they knew what they were doing. They should have done this a long time ago, three months ago, not now. But they did it now. So I don't want to play into their hands."

You can think about how the hand would have played out if the Republicans had been the ones to "obstruct and... resist." I think that's what the Democrats pictured, when they waited until after the hearings: "They did it now." Trump sees that as a deliberate play, and he's not going to let it work the way they planned. After what they did... "we should go through a process." That's surprising. Now, what are they to do?

I think they are scrambling. Today, we see that the accuser, Christine Blasey Ford, might not appear at the scheduled hearing — "Kavanaugh’s Accuser Has Yet to Confirm Appearance at Monday Hearings" (NYT):
The mysterious silence from Dr. Blasey and her lawyers was another turn in a drama that has gripped the Capitol since Thursday....

Dr. Blasey, thrust suddenly into a spotlight that she never sought, has been inundated with vulgar email and social media messages, and even death threats.... Dr. Blasey, who has two teenagers, has moved out of her house, is arranging for private security for herself and her family, and is effectively in hiding, [an unnamed person close to her told the NYT]....

Democrats and Republicans, meanwhile, are clashing over the scope and shape of the hearings. Mr. Grassley said Judge Kavanaugh and Dr. Blasey would be the only witnesses, prompting pushback from top Democrats, who are demanding an F.B.I. investigation to search for additional witnesses or evidence, and to avoid the specter of a “he said, she said” debate that will not get at the truth.

One possible witness is a friend of Judge Kavanaugh’s, Mark Judge, who Dr. Blasey said was in the room with Judge Kavanaugh when the assault occurred. Mr. Judge had told the Judiciary Committee that he does not remember the episode and has nothing more to say, seemingly foreclosing the possibility of an additional witness interview, at least for now.
He could be asked about his problems with alcohol-induced amnesia, his observation of Kavanaugh's drinking, and any alcohol-induced amnesia he saw in Kavanaugh, and he could be pressured to admit that he's unreliable as a witness to the nonoccurrence of any event from his heavy-drinking years.
“We have two diametrically opposed stories,” Senator Chuck Schumer of New York, the Democratic leader, said on the Senate floor. “My view: Professor Ford is telling the truth. But if you don’t want the hearing to be just a ‘he said, she said’ affair, an independent investigation, a background check by the F.B.I., is essential.... We must not repeat the mistakes of the Anita Hill hearings,” he said. “They were rushed, and they were a debacle.”
That is, once the hearing was scheduled, Democrats switched to saying they didn't want it. And Blasey (Ford) seems to have become unavailable. Going public with the accusation now looks a bit like a bluff. But — not wanting to play into their hands — the bluff was called. And now they want a new deal: an independent investigation. Trump rejected that (in the clip above).

Anita Hill has been brought in, with an op-ed in the NYT, saying the Clarence Thomas hearings were not done right and the Senate needs to handle the woman's allegations about sexual misconduct properly this time. She says "The job of the Senate Judiciary Committee is to serve as fact-finders, to better serve the American public, and the weight of the government should not be used to destroy the lives of witnesses who are called to testify." But her idea of fact-finding is not for the Senators to question Blasey directly, according to Hill, who says:
Select a neutral investigative body with experience in sexual misconduct cases that will investigate the incident in question and present its findings to the committee. Outcomes in such investigations are more reliable and less likely to be perceived as tainted by partisanship. Senators must then rely on the investigators’ conclusions, along with advice from experts, to frame the questions they ask Judge Kavanaugh and Dr. Blasey. Again, the senators’ fact-finding roles must guide their behavior. The investigators’ report should frame the hearing, not politics or myths about sexual assault.
So the new hand has been dealt. How do you not play into that? I'm using Trump's idiom. If it seems wrong, let's talk about that.

ADDED: This post caused me to do a fair amount of research into the phrase "play into their hands." I'm not sure what the original metaphor is, but you can see from the post that I assumed it was poker. Anyway, the phrase means to do something that unwittingly advantages your opponent.

In my search, I ran across the phrase in the famous and tragically hilarious NYT article "The Aspiring Novelist Who Became Obama’s Foreign-Policy Guru/How Ben Rhodes rewrote the rules of diplomacy for the digital age" (May 2016):
With three hours to go until the president’s address to Congress, Rhodes grabs a big Gatorade and starts combing through the text of the State of the Union address. I peek over his shoulder, to get a sense of the meta-narrative that will shape dozens of thumb-suckers in the days and weeks to follow. One sentence reads: "But as we focus on destroying ISIL, over-the-top claims that this is World War III just play into their hands." He retypes a word, then changes it back, before continuing with his edit. "Masses of fighters on the back of pickup trucks, twisted souls plotting in apartments or garages — they pose an enormous danger to civilians; they have to be stopped. But they do not threaten our national existence."
AND: Something new from Dianne Feinstein, about Blasey: "I can’t say everything’s truthful. I don’t know."

Later, she said, “Look I believe she is credible... But based on what I know at this stage she is credible,” which doesn't explicitly walk back the idea that maybe not everything Blasey said is true.

But then Feinstein came back with a sledgehammer: "During every step of this process, I’ve found every single piece of information from Dr. Christine Blasey Ford eminently credible, sincere and believable. She knew this would have a huge effect on her life and she was incredibly brave to come forward."

PLUS: Just last August, Dana Milbank (at WaPo) had a column titled "Journalists are playing into Trump’s hand":
Trump is making us the story by making us the in-house villain of his rallies.... My colleagues’ instinct has been to fight back. During a live stand-up from Trump’s Tampa rally this week, CNN’s Jim Acosta was taunted by the crowd, which had been chanting “fake news,” “go home” and “CNN sucks.” Said Acosta: “We’re staying right here. We’re going to do our job and report on this rally to all of our viewers here tonight.”

A noble sentiment, but better to “go home” — so Trump can’t use the scenes to his benefit. Eric Trump retweeted video of Trump supporters chanting “CNN sucks” at Acosta during his stand-up, adding the hashtag #Truth. The president retweeted his son....

Stop letting him make us the story.
UPDATE: I just heard on the Tucker Carlson show that Blasey has announced that she will not testify until after an independent investigation is done.

I can't tell if rumour claiming Ford was promiscuous and drank a lot during her teen years is true or not, but she will have her repuation torn shreds if it is true. I wonder how much Ford has been pressured into releasing letter and everything since, she seems like pawn to me.

Declining to testify is an extraordinary turn of events. If FOrd holds to that position, it is raising the white flag of surrender on the merits. Sure, there wil be caterwauling about the FBI but that is whining about process. The bottom line is she was given an opportunity to tell her story, in public or private, and refused. That is her decision, and her decision alone.

My theory is that Ford is an academic and expected this to be treated like Title IX kangaroo courts on campus. She makes an accusation, it is presumed true, the accuser is not questioned about anything, and the accused gets little or no information and due process, and if turns out differently than she demands, she appeals it until it does.

She is not on a campus right now.

If they are so constrained what federal crime do you think is involved in the alleged sexual assault that happened in Maryland at some point during an undefined 2-3 year period 30+ years ago??

Since we are getting into the personal lives of the men in this situation and how that might relate to their honesty, I have a few questions for Ms. Ford:

Do you believe that Kavanaugh would take away a woman's right to abortion?

Have you ever had an abortion?

Do you have any knowledge of any friends or family that have had an abortion?

These are valid questions in determining if there was a 'nonoccurrence' in her life that might affect her trustworthiness in this matter.

I say we bring her friends and family in for questioning.

I hope none of them have a drinking problem.

What would an investigation reveal? The FBI would interview the witnesses: Ford, Kavanaugh, and Judge. There is no physical evidence to examine. There is nothing magical the FBI could do. The case, after investigation, would remain a he said / she said case.

Yes, I was on the island when Maria hit. And Irma. And Georges, and Hugo. And David, and Federico and a couple other minor ones over the past 47 years.

Actual direct deaths from Maria were less than 50,probably closer to 20.

The 3,000 and other similar numbers are excess deaths since Maria. It includes things like people falling off a roof while fixing it, getting hit by a car at an unlit intersection as well as people dying from increased stress, illness and such.

In other words, indirectly caused by Maria.

Perhaps a bit disingenuous, perhaps not.

The real problem is how the 3000 was arrived at. One would think that one would count death certificates for, say, 6 months after Maria and compare the number to a similar period in prior years.

Nope. The 3000 is an estimate based on a survey sample. There are a number of estimates ranging from @1000 to 7000. They seem to have picked the 3000 as the highest number they thought they could get away with.

More dead people mean more of thos sweet, sweet, taxpayer dollars.

Whereas slavery was ended through a frontal assault, selective-child will be ended through moral reform. Unfortunately, abortion rites are natural rights, and will persist under a layer of privacy when there is sufficient demand.

Still, baby steps. Separation of Constitution and the Twilight Amendment is a critical step to securing human and civil rights, and restoring scientific integrity. We did it with slavery. We are working on diversity (i.e. color judgments). Denying life to relieve after birth burdens is next.

I ahve readily acknowledged that molecular biology did not exist when was in medical school. I had to learn it by reading Albert's The Cell.

Then I read Lewin;'s Genes XII except I began at Genes VII and kept having to buy the new edition. I did this to keep up with my medical students who know much more about it than I do.

While I was at it, I read about Crag Venter and the "Genome Wars" and finally had the chance to meet him. I wrote the highest rated review of his biography on Amazon.

He is a nice guy. After his talks he walks around in shirt sleeves with a beer in his hand.

He is also a sailor which is another bond.

Couldn't agree more.

It's very similar to the "children are being snatched from their parents" hysteria. The Dems and their media allies thought they had a winner of an issue. Then to their surprise it backfired, both substantively (the Obama cages, the Time magazine cover, etc.) and in the court of public opinion. The polls went Trump's way, and he rubbed their faces in it (for example, talking about victims of illegal crime being permanently separated from their parents).

I think this is the same. Most Americans believe in due process. Most men, regardless of politics, know the fear of what a false accusation of sexual misconduct can mean. And on Twitter and social media, many women are saying they don't believe Kavanaugh's accuser. Even some pro-choice Dems who don't want K on the Supreme Court are complaining about Feinstein's unfairness. So I think Trump is wise to let this play out until the Dems are hoisted by their own petard.

I've said this before here, Trump's uncanny political instincts bring to mind the book of Esther, in which a trap that was laid eventually ensnared the ones who made it. I think that's about to happen big time with the Russia collusion conspiracy. Just in time for the midterms.

The most obvious rationale for the just-short-of-3000 number for Maria is that it's almost exactly the number who died on 9/11/2001. Except that no one has done the six-months-further-on calculation for that one, of course. (Technically speaking, someone has, and added another 1600 dead, but the fact isn't generally known.)

Holton-Arms is an extremely expensive prep school. It is fair to assume that she was your typical spoiled rich girl when she went to the party. Christine Blasey Ford also owns up to having been a heavy drinker during her youth, and a participant in what today we would call "hooking up."

I will say that even a prostitute can be raped, so the fact that Christine Blasey Ford was an easy lay doesn't mean she wasn't assaulted, but it also suggests an alternative scenario: that she tried to get him or his friend Mark into the bedroom herself, and that she is better because Kavanaugh interceded on behalf of his friend. Or that she tried to get Kavanaugh into the bedroom, and he threw up when he looked at her.

No matter what happened, it takes an ego larger than Trump's to think that her alleged incident can be kept private while she has the FBI try and chase down something that may or may not have happened on hundreds of possible days at an unspecified location in a fairly wide geographical area.

Her testimony now isn't going to be any different than it would be after an investigation takes place assuming what she says is true - unless of course the whole point of an investigation is to allow #TheResistance within the FBI time to come up with a time and place that passes the smell test.

Maybe one of Obama’s Hawaiian judges can sign those 10,000 warrants to search homes in Maryland but what good what it do? Is Ford going to go on a tour of 125 houses, many of which may have been remodeled in the last 36 years.

Then if she can narrow it down to a dozen, the FBI can track down the homeowners from back then and see if they or any of their kids remember Kavanaugh or a Ford? Then maybe remember a 5 person get together sometime between 1979 and 1984?

If she does not come forward to 'testify' - which is likely as the narrative has been set that she is receiving death threats and has had to go into hiding for fear of her life. Appearing in person would put her in harms way (according to that narrative).

This paints the republicans - and men (they are just evil!) - in a bad light and is part of the stage for the mid term frenzy (of course, this simply works up the hard core leftists perform their moon howling).

If they go forward with the vote, it again, reinforces the above.

Delay until after the mid-terms, is probably the best to hope for - from a purely political standpoint. The right thing to do is just vote and have done with it. The slimeball Democrats will play shitty regardless: they have no interest in making things better for anyone or running a country.

In the past, the Dems controlled all the levers and could've written the opposite law. The Supreme Court has been publicized because Congress isn't doing it's job, and wants to keep hot button issues to control the masses. In general, the Supreme Court doesn't void law that's voted in by Congress. For example: Lilly Ledbetter's suit was ruled unconstitutional, but a law was passed clarifying the law. I'm a chemist and no expert at this, perhaps some legal mind could clear up this point. I still stand by my original post that the Supreme Court is politicized because the Congress is not doing its job.
