Norwegian trial court finds that the conditions of confinement violate the rights of Anders Behring Breivik — who killed 77 persons in a politically-motivated rampage.

He's kept in a surprisingly lovely 3-room suite that has windows, a treadmill, a refrigerator, a TV, and a PlayStation. But he's alone there, and he argued that is torture. The judge agreed.
Mr. Breivik claimed that he had been on a “martyr operation” to stop a Muslim invasion of Europe.... He was sentenced to 21 years in prison, the maximum, though he could serve longer if he is deemed a threat to society....

[At trial, Breivik] complained about his microwave dinners and cold coffee. He gave a Nazi-style salute and said he had renounced his faith in Christ in favor of the Norse god Odin. He demanded the right to publish a political tract every third year, in print or online, and said he had written two books already, “The Breivik Diaries” and “The Nordic State,” but was not allowed to seek publication of them....

Cato Hemmingby, a scholar at the Norwegian Police University College who co-wrote a book on Mr. Breivik, said in an interview that it was “especially the lack of access to the Internet and the communication control” that had angered Mr. Breivik....

While part of me can appreciate turning towards Odin, I suspect his turning away from Christ happened a long, long time ago and that he didn't turn towards the norse god of wisdom. Methinks Breivik needs to be hanged on a tree until he wises up.

The 'cruel and unusual' argument cuts both ways: surely rooming him with other prisoners would be cruel and unusual punishment for them, and they are unlikely to have committed crimes even one-tenth as deserving of punishment as he has.

3) Norway's leading newspaper Aftenposten refused to publish the famous "Mohammad with a bomb in his turban" drawn by Danish cartoonist Kurt Westergaard except as a unrecognizable pixelation (see Harvard University Press vs Testosterone)
4) Antisemitism. Norwegians hate Jews. Norwegians love Arabic Muslims. Both groups can be considered semitic. One group rewards murder with honor in this world and 72 virgins in the next. The other considers murder the most heinous sin. Norway has an ever-increasing Muslim population (300,000 at least) and an ever-decreasing Jewish population (less than 800). By 2020 Norway will be Europe's first Judenrein state since WWII.

The last genuine Norwegian with balls: Joachim Rønneberg, age 97, the last surviving member of the "Heroes of Telemark".

This is why we need to keep capital punishment on the books, because once it's eliminated the usual suspects will never stop redefining "cruel and unusual". They already oppose life in prison. Fundamentally they oppose punishment.

The ideal Norwegian is basically the human equivalent of a bacon hog — lazy, content, and oblivious to his inevitable fate. It's not post modernist phraseology, it's psychology. I don't know what I'd do and I don't blame someone for an innate flight reaction that's largely outside consciousness. You're assuming that volitional choices were readily available to those teens facing mortal danger, when it is possible that maybe they were frozen, unable to act and think clearly when someone dressed in a police uniform was approaching them with a gun drawn.

I've never been caught in a mass shooting, but I have been trained to react to a near ambush. So I don't know what I'd have done - maybe I'd have hid, or stood still and prayed for a miss - but I do know what I hope I would do. And no, this is not action movie hero posturing.

The drill is to turn into it and charge. Because you probably won't survive, but guess what? This is not a fair fight. It was designed not to be. Your odds are very poor either way, but if you fight you might survive, and at the very least you might take the bastard(s) down with you. A person shot straight through the heart remains very dangerous for some crucial seconds after that. Even lethal wounds are often not instantly incapacitating.

It's not a natural act, charging into a hail of gunfire. That's why we train on it. And it's my unscientific opinion that Flight maximizes a given individual's chance of surviving, whereas Fight would result in fewer total deaths.

I continue to think this is misguided, and that more people will die in mass shootings following this advice than if everyone close enough pounced on the shooter, every time.

That argument has its merits. We can talk about how effective that approach is, but I imagine none of those teens on the island underwent the training you're talking about. Suggesting that they could've reacted differently and that their response is indicative of a "civilization in its death throes" is a bit of a stretch.

The Muslim population of Norway is 2.1%, so that's 106,735 people out of a little over 5 million people. Norway has a birth rate that's higher than some other European countries and it seems like the benefits awarded by the Norwegian government to parents (maternity leave,etc) incentivize natives to start families. I don't an Islamic demographic threat to Norway's future. France, Germany, the UK on the other hand, maybe...
The key challenge is to find a way to assimilate existing immigrants without adding to the pool. Perhaps Europeans should learn how to do that from us.

Yes. Firstly because the DHS has repeatedly demonstrated a completely non-serious, kiss-it-and-make-it-well approach to homeland security with policies such as refusing to use the provenly effective method of security popularly known as profiling. El Al has been safe from terrorist incidents for more than thirty years thanks in part to profiling. A serious agency seriously devoted to homeland security would learn from more experienced agencies abroad. The fact that DHS does not reveals both hubris and hypocrisy at the policy-making levels.

Secondly because the run and hide advice is ludicrous in light of actual mass-shooting crimes. Persons who desire to inflict mass mayhem choose when and where primarily to make running and hiding a stupid option that works in the criminal's favor. Consider the case of James Holmes who murdered 12 and wounded 59 in a cinema theater. How could running or hiding possibly avail those people. By hiding below the seats or running for the exits the movie-goers only simplified Holmes's deadly task. There are no walls or furniture that offer reliable protection against modern firearms, hide behind a desk and you only offer your assailant a stationary target.

The real reason why the DHS advises running and hiding is philosophical. DHS is a cabinet-level agency under the control of an administration with a fundamental objection to firearms in the hands of private citizens, and a tragicomically arrogant confidence in its own mostly delusionary competence. If the Constitution was no impediment I am quite convinced that President Obama would attempt to disarm the law-abiding American citizen, making him just as vulnerable as those 73 Norwegians on Utoya (Why do you suppose Breivik choose an island for the scene of his crime, hmm?). He has already done this to Federal entities that have as the raison d'être the deadly use of arms, which is why the victims of two (count 'em!) mass shooting at Fort Hood had no means of self-defence. Obama Administration policy has put American soldiers in the absurd position of relying on military police and even local civil police for protection against terrorists. The fiction of run-and-hide must be maintained by the DHS and other mouthpieces of the Obama Administration because to admit the fallacy is to admit the real justification of the right to keep and bear arms.

The victims were mostly teenagers at a camp on an island. They were trapped without anywhere to go. As I recall there were a handful of security guards, but they weren't armed.

Just because he didn't get a life sentence doesn't mean he'll ever get out of jail. When he's done they're just going to change the paperwork from "serving prison sentence" to "involuntarily committed for mental health reasons". He'll be moved to the care of another bureaucracy, and he'll get a new cell, but not much else is going to change.

The Scandis have their issues, but they're not stupid.

There used to be institutions for the criminally insane, and Anders Breivik belongs in such a place as a permanent resident.
However, in America, the lawyers did away with such institutions in the 1970s, and I suppose Norway followed suit. The Norwegians do have a tendency to want to stay with the times, even up there by the Arctic Circle, and with the modern media, that generally means do what the Americans do.

If the situation proceed to its logical conclusion by the time Breivik's sentence is complete the operative law in Norway will be sharia. Then the question will be something along the lines of is the killing of infidels a crime? Breivik may find himself endowed with a healthy cash settlement in this world and 72 virgins in the next.

The man murdered 77. And yet somehow his rights have been violated. The fact that he is even alive at this point is a mercy almost no other culture in history would have seen fit to concede. And it's not even imprisonment in a stone cell in the depths of a filthy dungeon, but something very much better than what much of the third world gets to live in. Probably not the example to be setting when lots of immigrants for whom these conditions would be a significant upgrade are coming in. And if they get company/conjugal visits besides 3 rooms, 3 meals, video games, TV and internet? Buckle up Norway, lots of people would kill for that deal.

My personal opinion is to stick this judge in there with Breivik for company.

Norway seems to be deeply committed to Stockholm Syndrome. That may not be a strategy for long-term success but it does ease the cognitive stress of being a victim. If you can't overcome your captor, you identify with him. Here, thanks to the absurd constraints of Norway's penal laws, Breivik has effectively captured the state. Most of us here seem to think it should overcome that by changing its laws and imposing "commensurate" punishment. But the state can't, so it has to reconcile the irreconcilable by...showing sympathy and understanding to the new "victim" of the narrative. A narrative that Breivik, no fool he, is busily and noisily constructing.

As the memories of the dead and wounded fade, Breivik wil become ever more prominent in the history that Norway adopts.
