Tweeted Michelle Fields — she of the Lewandowski-yanked arm — about Greta Van Susteren, who'd said: "Anyone encouraging this young woman to bring a lawsuit is irresponsible to her."

She isn't suing because she has been harmed. She's talking about suing to get attention and to pretend she's been harmed.
Why does such a person use Twitter at all? It seems like a stage on which to demonstrate lack of judgement.
I'd advise Ms. Fields to settle her claim for an apology and a hug -- assuming, of course, that she doesn't find that human expression of affection to be unpleasant and/or anxiety arousing.
Michelle Fields seems to be a victim of the millennial culture, where everyone gets a participation trophy and as such, she's never learned how to lose gracefully. She won't sue because no lawyer will take the case on contingency and she can't afford to go mano y mano with Trumps team of lawyers (the man likes to sue!).
This latest tiff with Greta van Susteren is just her way of saying "I'm special".
Remember the Trumpkin claim that the Palm Beach County State's Attorney was a Democrat partisan and that politics was the only reason for the charge?
It was one of about a dozen things they got wrong in this matter. Including Corey Lewandowski's lies, Donald Trump's insults, his reprehensible judgment, the presumption that it was a secret service agent who grabbed Michelle, and that it was the Democratic prosecutor who filed the charge.
Believing in Scientology is even worse than being a Trump shill, but it's close. In either case, Greta defends the indefensible.
This case really seems to bring out the absolute worst instincts and most base stupidity in the Trump crowd.
Which is if course saying an awful lot.
GVS' advice was to anyone advising Fields. I suppose it's implied advice to Fields as well since Greta says she doesn't want to take the stand and subject herself to cross examination, which is opinion not advice. Fields would open up her mental health history, etc. by seeking damages for emotional distress. She seems to be distressed about a lot of things and a jury listening to her saying this incident was almost as bad as the death of her father would roll their eyes if not laugh out loud.

Under the circumstances of this matter, I would have done exactly as Michelle Fields did. If I had been her lawyer, I'd have advised her to make a police report exactly as she did. I agree with every one of her subsequent Tweets, word for word.
I can say all of that, and still agree with the prosecutor making a very tough call to decide not to prosecute. (Although I wish he had taken it on, and I'd like to think I would have gone forward to a trial.)
All that we can conclude for sure is that Corey Lewnadowski and the Trump team are lying assholes.

He never met her (encountering someone for a few seconds as they did isn't meeting) and he never touched her (which is an expression we all use to mean "I didn't do what she is accusing me of doing") and based on her description? But there are serious impediments to any potential defamation claim she might bring against him, Trump, or the Trump campaign. At the top of that list is NYT v. Sullivan, as interpreted to include "limited purpose public figures." Because she voluntarily chose to become a reporter, TV pundit, and minor media celebrity, one whose beat is the most newsworthy topic (the U.S. presidential election) in the world, most courts would be inclined to conclude that she's deliberately injected herself into the public policy and politics arena. This incident arose directly out of her figurative and literal participation in that arena. If Lewandowski had instead grabbed her on at the supermarket on her day off, and then tweeted damaging falsehoods about her, then she might not have to meet the additional threshold required for public-figure defamation plaintiffs. As is, though, she'd likely have to plead and prove "actual malice," defined by Sullivan for this context to mean that the plaintiff must prove the defamatory statement was been published by the defendant with actual knowledge of its falsity, or reckless disregard as to its truth or falsity.
She's got another potential problem if Florida tort law is held to have the most significant relationship to the case (which seems likely, even if she were to file elsewhere). The Florida Supreme Court rejected the "false light" version of defamation a few years ago, and she would have a far better chance winning under that kind of theory (which many other states still recognize) than under traditional common-law libel law.
Defamation claims are just extraordinarily hard to plead, to get past pretrial summary judgment motions, to win with the jury, and to persuade a trial judge to enter judgment upon. Holding those judgments on appeal is also notoriously hard to do.
I sympathize entirely with Ms. Fields on a personal basis, and bow to no one in my distaste for the Trump campaign's thuggish tactics and lying thug of a campaign manager. But I wouldn't take her case on a contingent fee basis. There likely are lawyers who would, though; we'll see.
More Michelle:Even if Trump was done taking questions, Lewandowski would be out of line. Campaign managers aren’t supposed to try to forcefully throw reporters to the ground, no matter the circumstance.

I think Greta is giving her good advice, but she has access to lots of money.

If a female journalist's arm gets pulled -- not to the point of injury -- that's a big deal, an issue that can be used to promote her "brand" and possibly to justify a career-enhancing and profitable lawsuit. I'm a recovering female journalist. Back in the day, we had no use for these weak sisters. There were bigger issues -- being banned from the campaign bus, being relegated to the gossip column or the food page, being passed over for lazy but taller male journalists for serious assignments, being hit on by editors and on and on and on. We understood what was going on but didn't pick blood fights over minor issues.
We were stupid. We should have dyed our hair yellow, hired makeup consultants, bought wardrobes of sleeveless dresses in bright colors and challenged the easy suspects like Donald Trump for perceived sexism.
The best of us -- not me; I gave up years ago -- stood their ground and did their jobs. Not that it did them any good.

It matters not, if there was any injury. Neither the common law of simple battery, nor the operative Florida statute, require any proof of an injury on the part of victim in order to establish the elements of the crime.
So it does not matter if there were bruises or not. To me, the notion that there were no visible bruises on the night of the incident, but that there was bruising seen 2 or 3 days later, makes perfect common sense to me as a layperson.
I am not a doctor; I am a lawyer. And I say that the bruising issue does not matter, in establishing simple battery.
Of course, not all touching is battery. A battery is only established by unconsented touching which is objectively offensive, if not injurious.
So you can bump somebody in an elevator, or tap them on the shoulder to step aside in a narrow hallway; no battery. But you can't shove them, or grab them, or punch them. I doesn't matter if you do or do not injure the victim. The famous case in the beginning of our torts book in law school is a simple battery case, in which a segregated hotel in the old south saw a hotel manager swat a plate out of the hand of an African-American standing in a buffet line. The manager never even actually touched the victim. And he did not injure the victim. Still, it was (tortious) battery. It was offensive touching.

The commentor is torturing the word, “witness,” by using it to describe Michelle Fields. There’s usually some degree of impartiality implied by the word, “witness.” The same goes for Michelle’s buddy, Ben Terris.
What I’m pointing out is that the only witness who has no ax to grind, who could credibly be described as “impartial,” told the Florida investigators that they thought Field’s “reaction was fraudulent” and a “fake action.” I think most impartial folks would agree that with an impartial witness giving this type of damning testimony that it would have been pointless to have gone forward.

As a lawyer, Chuck, you might want to look up the Florida statutes in question. If you do you will see that Florida law allows for the grabbing and shoving aside anyone who is impeding the progress of a candidate trying to exit a rally.

I suspect that the audio recording of Michelle’s supposed reaction at the incident was staged much later. I want to carefully compare what you think is Michelle Fields' most egregious and consequential misstatement of facts, with the Lewandowski/Trump misstatements.
And before you answer -- because I really want to fight this out with you until you cry uncle -- let's agree that procedurally, defendant Lewandowski gets every advantage. His guilt would have required proof of every element, and the absence of any defense beyond a reasonable doubt.
So; go and give it your best shot, because the charges against Lewandowski were based in the police report and an interview with her and not any column by her or any interview with her.

Chuck, I agree with you. Trump and Good Ole Corey decided to take what would've been nothing and decided to make it big. If Corey had just said "Sorry" or even "I didn't intend to do anything", Michelle would've been fine. She's said she basically had no option after they called her a liar and basically implied she invented the entire incident. Call a reporter a liar or a fabulist and their rep can get decimated.

I never made the claim that she reported it to the police. She made the claim at Breitbart, in her column, titled Michelle Fields in her own words.

One witness told police his eyes were fixed on Michelle Fields, the journalist who claimed Corey Lewandowski battered her – and her actions 'looked like a fraudulent slip-and-fall.'
Police in Jupiter, Florida released video of their interview with Michael Spellman on Thursday, along with a more formal statement that he wrote immediately afterward.
Spellman, the president of a glass technology company based in Jupiter, says on camera that Fields' reaction to Lewandowski separating her from Trump after a March 8 press conference was 'disproportionate' and 'bizarre.'
'At first I thought she was drunk,' he recalled.
Recalling the moment he said Fields 'shoved her phone ... right at' Trump, Spellman said he was 'surprised that Secret Service let 'em do that – let her do that.'
'But then seconds later it just – she spun, and it was really animated and acting.
His written statement, obtained by NBC News, said he saw Fields 'fall back in what appeared to be a disproportionate reaction and a fake action. I did not see from my view any touching. I truly believe her reaction was fraudulent.'

Here's the reason, grackle; it was because "security" was not on Lewandowski's mind. He was miffed at a reporter bugging his man. By at least one (uncontroverted) account, Lewandowski confessed to a Breitbart editor, long before Lewandowski was charged, that he (Lewandowski) had mistook Michelle (as a 'friendly' Breitbart reporter, for some other Mainstream Media reporter. And he just put a stop to that.
And let's go on, because I want to rub your nose in this. No Secret Service agent, within an arm's reach, sought to perform the intervention that Lewandowski took. And after the fact, absolutely no one treated Michelle Fields as any sort of security risk. She was not stopped. Not questioned. Not arrested. No ID demanded. She was clearly and obviously credentialed press.
You can take your "RFK" and "JFK" theories and shove them, grackle. You've been given plenty of chances on this subject. I just don't think you can be humiliated any more. I don't know what else to do with you or say about you.

Prosecutors said during Thursday's press conference that Michelle Fields made physical contact with Donald Trump before Corey Lewandowski touched her, but denied it during their conversations with her.
Palm Beach County State Attorney Dave Aronberg described the incident, saying Fields 'makes her way beyond the press area and gets right next to Mr. Trump and actually makes slight contact with Mr. Trump.'
Aronberg's chief assistant prosecutor, Adrienne Ellis, chose more forceful words while narrating video footage: 'You can see when she gets next to him that she touches him and you can see Mr. Trump recoil his arm like that, and that is the point at which Mr. Lewandowski reaches in.'
Ellis also recalled a conversation with Trump in which 'he said that she touched him, and all that's captured on the video surveillance. ... it was quite evident.'
But Ellis said Fields told her that she never made physical contact with Trump.
'My conversation with her was basically that she, you know, did not touch Mr Trump,' Ellis said.
A reporter countered: 'She said that to you?'
'Yes,' Ellis replied, 'that she did not touch Mr. Trump. And that's not what we see captured on video.'

The way Michelle Fields talks you would think someone yanked her arm out of its socket, threw it on the floor and kicked it under a sofa.
