[Mohamed] Merah filmed himself killing seven people, including Jewish children and unarmed soldiers, before he was shot dead after a 32-hour siege last week....Someone mailed al Jazeera a USB memory stick with edited footage and a note claiming the attacks were committed in the name of al Quaeda. Since the postmark shows it was sent after Merah was under siege and from outside of Toulouse, it indicates that Merah had at least one accomplice. Whoever prepared the video combined footage of all 7 shootings with music and Islamic verse.
Al-Jazeera explained its policy:
"Given its contents, we immediately passed the video on to the French police as we were duty-bound to do and they are conducting their investigation. In accordance with al-Jazeera's code of ethics, given the video does not add any information that is not already in the public domain, its news channels will not be broadcasting any of its contents."I hope that is indeed their policy. I suspect that there are also fears of legal consequences. This is al-Jazeera in France, where presumably there is law enforcement against those who are in a conspiracy with murder and who serve as accomplices after the fact.
..."You hear the voice of the person who carried out the killings," [al-Jazeera Paris bureau chief Zied] Tarrouche told French channel BFM TV. "You also hear the victims' cries. My feelings are those of any human being who sees horrible things."
Mr Tarrouche said he had to weigh up the "risks and the consequences" of airing the video, but he added: "We are not a sensational network."

Funny how in the past they had no problem airing people getting their heads chooped off when it suited their purposes.
Getting tossed in the hoosegow is a definite disincentive, but it looks like France is apparently fed up with the nightly rampages of the "youts", which this would accelerate.

Strange hearing that from you, since neither conspiracy nor accomplice liability is remotely applicable hereb(at least as those concepts are understood in American law). Conspiracy requires an agreement to accomplish an unlawful end; an accomplice after the fact requires aiding the perp in some fashion. If al-J had aired the tape, nothing would support finding any such agreement or accomplice relationship.
The legal consequences you wish for would be quite harmful if they exist under French law. Teh simple truth is that barbarity on this scale should be exposed in all its ugliness, so that those who support it cannot hide in the shadows, pretending it is something else. Unless the Merahs of the world are actively rejected by the larger Muslim community, there will be no end to the barbarity.
For a First Amendment maven, you don't seem to have all that much confidence in the power of the "more speech, not enforced silence" idea here to bring about better results.
Legal consequences? Feh. That there's a marketing decision. More people than not might think poorly of jihad after viewing these videos.
Note that Al-Jazeera's Paris bureau chief describes himself as a human being whose feelings are affected when he sees horrible things. But do the Jewish pigs and dogs, described as such by his co-religionists and murdered by his co-religionist, do they merit classification as human beings? He doesn't say.

We should see it to remind us what we're fighting against, but Al Jazeera is watched mostly by Muslims, many of whom think this is what we deserve. They should be shown the video of the police shooting the perp into chopped liver.
Second thoughts about Al Jazeera: Perhaps they withheld footage not because it's the decent thing to do but because it's such effective anti-jihad propaganda. When that young Palestinian boy got caught in a crossfire such discretion was not used.
Apparently the killer thought that Al Jazeera would show the video.
