One has only to look at his tomb to see that that is not a true statement.
This guy is legal. He may become a public relations embarrassment to the Kleptocrat Reid, but he is not punishable by expulsion for the method of his selection. On the otherhand Franken is 100% illegal and everyone knows it. This must be a vast Leftwing conspiracy at work. In other words, it's politics.

Senator Reid, this is AC... I got Roland Burris in the car..
Burris really is a comic figure. He's spent his political career as a relatively inoffensive (which is saying something in Illinois) glorified accountant. There is no way he could get to the senate on his own merits.
That said, like others here, I think legally he has to be seated. But I also think he shouldn't unpack his bags too quickly.

(leafs through How to Avoid Probate) Well, I'll be darned. There he is on page 217! And you can imagine my surprise when I saw that he had his own chapter in the Third Restatement of Torts.
I think Burris is an idiot, but is indeed the Junior Senator from Illinois as defined by the Constitution.
What bugs me the most isn't that Reid questions the validity of the Burris appointment specifically, it's that Reid declared no appointment of Blogojevich would be permitted.
Reid also declared Franken the winner even though Franken hasn't yet been certified by the Governor or Minnesota.
What color was Franken again?
CNN is showing Burris walking up to the Senate door...LIVE.
The Sergeant-at-Arms and a Reid lackey are about to meet him at the door.
I expect a fist-fight.
