"The jury has found Sean Combs guilty of two counts of transportation to engage in prostitution but acquitted him on the most serious charges of sex trafficking and racketeering."

"Combs covered his eyes and appeared to exhale in relief as the not-guilty announcement came in. After the verdict was read, he quickly touched hands with his lawyers and turned and smiled at his family...."

WaPo reports.
Defense counsel Marc Agnifilo has asked the court to release Sean Combs back to his home in the millionaire enclave of Star Island in Miami. “This is his first conviction, and it’s a prostitution offense,” Agnifilo said. The attorney noted that the charge he was found guilty of was significantly less serious than the ones that kept him detained in a Brooklyn jail for the past nine months....

ADDED: From the NYT reporting: "Sean Combs is on his knees, his elbows on the chair where he was sitting, his head buried. He appeared to be praying. He started a round of applause, which was echoed by his family, who are jubilant."

AND: "With a touch of levity, the judge said he assumed that Sean Combs would not want to return to the Brooklyn jail where he has been held. Mr. Combs shook his head vigorously and put his hands together in prayer." It's hard to believe, then, that the judge would send Combs back to the jail. He should go free today.

So under the sentencing guidelines that's like 15-21 months, right? With credit for time served less than a year remaining? He can probably serve that out at a minimum security camp.

I'll admit that I have scarcely followed this story, but from what little I've seen, it looks like he is guilty of being an asshole who treats people like shit. He shouldn't have been convicted of anything.

Only for a bit. He's still looking at a possible 20 years on the Transportation charges.

I haven't seen any video. Maybe there isn't any.
I'm guessing this was a fist bump or a high five, but the WaPo wanted a more Diddy-friendly tone, wanted their readers to think he was feeling humbled, not triumphant.

Seriously?

Anyway, was in court for minor transgression years ago. Plenty of defendants from prostitution sting. No jail time for any. Some represented by lawyers, most rep themselves and pled guilty.
Just fines and probation. Doubt that any were arrested, just given notice to appear tickets.

That's not a federal crime, so it wasn't charged here, and it's a crime that his lawyer argued he'd taken responsibility for and would plead guilty to.

On the top counts, the key issue in the case turned on consent v. coercion. But not coercion in its usual meanings, where a person is forced to do something by physical force or perhaps fraudulent inducement. Instead, in this case (and also in some of the cases against Harvey Weinstein), the defendant was alleged to have coerced the victims essentially by offering them the benefits of a (weird) relationship with money, career advancement and power. The inducement was so overwhelming, so the argument goes, that it deprived the victims of any real agency in the matter. That was also the prosecution's answer to the fact that the victims often stayed in the 'relationship' and engaged in the same conduct for quite a while.

Also interesting that the jury resolved the issue on the facts -- whether the prosecution had proven its theories of coercion and fraud beyond a reasonable doubt. On the law, these cases present an analogous issue to the Supreme Court's rejection of expansive criminal fraud theories in Ciminelli v. United States, 598 U.S. ___ (2023), and many other cases. In the fraud cases, the Court has held that 'fraud' when used in a criminal statute carries with it the normal common law meaning, restricting it to deprivation of traditional property rights unless Congress clearly adopts a different definition. The same argument can be made about 'coercion', seeking to limit it to its traditional understanding absent an express Congressional direction. The lower courts haven't gone in that direction, but these issues have yet to make it to the Supremes. So, time will tell.

Yancey Ward said...

Time served and he is likely free to go. From what I had read about the charges and the evidence, the jury got this mostly correct. Combs isn't anyone someone should admire but the DoJ shouldn't have invested this much effort in trying this case- Bondi et al would have done well to reach exactly this plea result the moment she took over from whoever replaced Garland on an interim basis. Also, holding him without bail was unjust given the fact base and the charges.

When Sean Combs' attorneys referred to Ms. Ventura as a very attractive woman, I knew Diddy was going to win. No way will a normal, somewhat unattractive, maybe very obese, female juror relate to an extremely attractive, very wealthy, stunningly promiscuous rape victim. When you're beautiful, other women despise you. Diddy's lawyers expertly played off the female jurors' jealousy and spite to get this absolute bastard an acquittal he doesn't deserve. So much for the sisterhood!

His sexual practices, while outside classic middle American norms, were of a piece with the rest of the Hollywood and big music moguls. Do any of you believe that there is not a gay version of Diddy doing much worse? And sorry, but there are statutes of limitations on assault and "offending the sensibilities of suburban women" is not yet in the Criminal Code. It was a show trial to my mind, and perhaps one day we will learn what was behind it. Cassie was already "paid" for her 13 years of apparently willing participation.

Is this a celebrity justice thing? Do you folks know of people deemed to be a flight risk or who might risk harming others while out jailed awaiting trial who are then convicted (on whatever counts) who then are FREED before serving their sentence? I never heard of that. You stay locked up after conviction. It comes off your sentence, that time served, but there's no post-conviction "recess" or "get out of jail free" card while you await sentencing, if you was locked up during the trial in which you were convicted.

Maybe stop pretending their are two, or more, levels of justice depending on who is charged. Put the blindfold back on that lady already!
