Wrote Sarah M. Harris, the acting solicitor general, in an emergency application, quoted in "Supreme Court Lets Trump Suspend Grants to Teachers/In boilerplate letters, the administration told recipients that the grants supported diversity efforts and were wasteful." (NYT).
The Court's order was 5 to 4, with the Chief Justice voting with the 3 liberal Justices.

I love when they basically overrule a stupid decision from the 1980s in a sentence without even referencing that decision. Bowen v Massachusetts now applies only to Medicaid payments.
CJ John Roberts shows his true stripes; as if they were in doubt since ObamaCare case. He's a uniparty RINO.
Absolute bullshit that this is not a 9-0 decision. We are one bad election cycle away from having a black-robed tyrant like that bald Brazilian ghoul usurping the powers of the executive branch.
Congress has got to slap the judiciary silly, even if they have to suspend the filibuster to do it.
If that fails, then I say it's time for Trump to go 110% Andrew Jackson on the scum. Force every activist lawsuit to the Supreme Court, and ignore all injunctions until it gets there.
And a very thorough investigation of collusion between big left-wing law firms, NGO's, and individual judges is entirely in order. It's obvious they are colluding and coordinating this attack on democracy. Norm Eisen and that Boasberg scumbag ought to be the first ones investigated. Subpoena every piece of paper they ever touched.
Total war on these enemy bastards.
Again, who was the idiot that nominated Roberts?
Robert’s was always a social climber. So was O’Connor.
What a weenie. What do they have on this guy!?!?
Harris appealed to the justices to “put a swift end to federal district courts’ unconstitutional reign as self-appointed managers of Executive Branch funding and grant-disbursement decisions.”
Well, Roberts has aligned himself with the three twerps. We live in interesting times.
Any organization is only as strong as its weakest link. Those who look to government for money and power keep testing until they find that weak link and then they keep working on that link with flattery, veiled threats, not so veiled threats, money, positions for family members until that link sides with them. And that poor weak link flatters itself that it’s a deep thinking maverick when all the while it’s doing the bidding of its handlers.
KBJ, "This application concerns the Department of Education’s decision to cancel, with no meaningful explanation...."
There was a meaningful explanation. The Trump Administration said the grants included DEI training and that wasteful spending.
What is it about the words "wasteful spending" that she doesn't understand? She doesn't understand and can't define what is a woman is so maybe that's the problem.
What a disgrace. She's a Dem activist on the Court.
Roberts has been exposed as a deep state participant
See yesterday's Scott Adams on Roberts and his cabal.
Other than the broader point that the SC has found a case that draws them further into the jurisdictional problem there's not much here is there?
They simply upheld the Governments decision to withhold a relatively small amount of money while the Government's appeal at a lower level continues.
Roberts may be holding out for a better test case. Maybe?
He's still a squish though.
Will we see coverage on fact top aide to SCJ Roberts is also Lawfare-Mary McCord's husband? That SCJ Roberts is best-buddies w/Norm Eisen? That SCJ Roberts belongs to some sort of "Inn of Court" DC club that includes the DC lawfare judges? Odd company to keep as a conservative judge.
Curious people want to know.
Scott Adams on John Roberts deep state as reported by Mike Benz somewhere.
The headline is so biased. All you need read is one word - "lets" - to know it's a hit job.
Correction: The four liberal justices agreed.
Eisen must have video of Roberts with a ten year old.
I love DJT for actions like this. No other R prez would have done this.
Thank God ACB did not go wobbly.
Kunstler today is on fire--he makes the same points as Not Illinois Resident, above.
Reminder that Roberts authored the 5-4 immunity decision from last July. (Barrett partial dissent.) Don't take your analysis from a crackpot cartoonist.
I thought John Roberts was one of the most impressive people I had seen during his confirmation hearings. He's been a total disappointment; not at all what he made himself out to be.
How do these states have standing? If Texas, Tennessee etcetera had sued to block unauthorized spending on DEI the courts, including SCOTUS, would have thrown out the case for lack of standing. They never would have reached any substantive issue.
who is Norm Eisen?
Ok Musk... get your geeks together and find dirt on Roberts... I bet he has some.
It's a shame that these 3 letter agencies are powers unto themselves. Imagine the leverage Trump would have if he actually had access to their information.
Lance, you make a good point. The states claimed if the feds didn’t fund the DEI teacher training to Non-Profits (and some local school districts) bullshit they would have to. That’s a shitty argument under standing. The non-profits and local school districts would have standing. Of course, these grants are discretionary. Biden’s handlers tried to rush them out the door by approving the grants. Trump revoked them and his position is to go sue the United States in the Court of Federal Claims, the court that has jurisdiction to hear these. There Trump can defend the revocation saying the grants are unconstitutional because they promote race discrimination, which they do. This is an easy case.
If that fails, then I say it's time for Trump to go 110% Andrew Jackson on the scum. Force every activist lawsuit to the Supreme Court, and ignore all injunctions until it gets there.
That's not “110% Andrew Jackson,” that's more like 80% Andrew Jackson. It was the Supreme Court that Jackson ignored—though, to be sure, the Justices were careful not to order Jackson to actually do anything.
Biden added 12 million migrants who require billions in services; and he added 1 trillion more dollars to the deficit for migrant services and for various other fantastic, unworkable projects related to climate change and to limiting the meaning of justice to the narrow meaning attached to it by various theories of retaliatory social justice.
No judge ever tried to stop this illegal accumulation of disasters and deficts but now, when the President is acting to rescue the country from its dangers, these judges are intervening, while piously asserting their concern for the law. If they were born yesterday, we might believe them. But they have been here with the rest of us all along and they sat silently by allowing those illegal acts which, in sum, are a catastrophe rushing toward us; and now they are trying to prevent any action which would to prevent disaster. The symbol of a US judge now is: one who busily works to keep migrant criminals and gang members in this country after inertly observing their illegal entry.
This isn't about Trump; it's about the country.
M Le Douanier:
"Why are so many here angry that some justices think that DJT doesn't have unilaterally power to control the checkbook of the US gov?"
The checkbook should be controlled by someone with an Ivy degree got before they drove out the Jooz;, - by the better sort of man untainted by ever having to run for dogcatcher in Wichita. Le Douanier perhaps. The rest of us can pay our Douanes and trust in his munificence.
Which codified laws has Trump violated with his (rightful) gutting of the federal government? At this point, lawyers and judges can poke their nose in, otherwise….fuck off.
As I said when Trump was number 45. Trumps greatest sin was/is to interrupt the flow of graft. Now we're seeing it in real time and all the bad actors are self identifying. It's all just sludge and it needs to be steam cleaned.
I wonder how they do it. Did they actually show Roberts the videos? And maybe give him a code phrase, that means "call the secret number for instructions"? Or do they just kind of hint around; "Remember, that nice young fellow you met in Rio? He remembers you, too. About this ... case ..."
I mean, we keep hearing that the Mossad and the FBI and Epstein were "collecting material for blackmail", but we never hear who got blackmailed, or for what. Except that the mob blackmailed Hoover to deny their existence. I guess that's safe to tell us now. But all that "collected material" must get used sooner or later.
Why are people pretending that Robert’s isn’t one of the liberal justices?
Let's further investigate Chief Justice Roberts, the ultra-RINO.
I find that framing detestable: "Supreme Court permits President to control Executive Branch".
How would everyone react if some headline read: "President Trump permits Supreme Court to voice their opinion"?
The Court's order was 5 to 4, with the Chief Justice voting with the 3 liberal Justices.
Not completely
It was a stay of a TRO. Roberts is doing his usual "regular appellate order" bullshit, and saying the wouldn't have voted to stay a TRO.
The 3 leftists, OTOH, all bitched. moaned, and whined about "Trump's cutting grants, the meanie!!11!" and ignored the fact that the District Courts simply don't have jurisdiction over contract fights, ONLY the Federal Courts of Claims have jurisdiction
