The president can certainly instruct his attorney general to investigate given individuals. In his 1960 presidential campaign, for instance, John F. Kennedy pledged to target Jimmy Hoffa, the labor leader.... "

Writes Adam Liptak, in "Trump’s Vows to Prosecute Rivals Put Rule of Law on the Ballot/Donald Trump’s promise to seek retribution challenges long-established norms. The election could hinge in part on what kind of justice system the country believes it has now and wants in the future" (NYT).

I think Trump's campaign rhetoric is mostly designed to force his adversaries to proclaim principles that support his own arguments. Liptak acknowledges that as he contends that what Trump is threatening to do to his political opponents is different from what they are doing to him. Trump's political enemies will appreciate the asserted difference. His supporters won't. And what is it? The most obvious difference is that Trump's opponents are currently deeply engaged in prosecuting him, but Trump did not prosecute his enemies in his first administration and he's only referring to the potential to do so the next time around. He's issuing a credible threat in a game of tit-for-tat that he did not start. Won't we need to see what charges his next administration brings (if there is to be a next administration)? These might be solid charges that rest on the proposition that no one is above the law... as Trump's opponents like to say about the charges brought against him.

Liptak quotes something Justice Alito said in the oral arguments in the case about presidential immunity:
"If an incumbent who loses a very close, hotly contested election knows that a real possibility after leaving office is not that the president is going to be able to go off into a peaceful retirement but that the president may be criminally prosecuted by a bitter political opponent, will that not lead us into a cycle that destabilizes the functioning of our country as a democracy? And we can look around the world and find countries where we have seen this process, where the loser gets thrown in jail.”

And Liptak follows that with this from lawprof Robert Gordon:

"A party may come into power determined to address injustices committed by the prior regime, as Argentina criminally charged leading generals after the dirty war, or Brazil is doing now against its former president. But the claims of injustices have to be true and their investigation and prosecution scrupulously fair. It’s pretty obvious... that turning law enforcement against your political opponents just to get revenge on them is among the worst crimes a regime can commit."

Just to get revenge.... Trump isn't threatening to do this just to get revenge... or even to get revenge at all. He is saying that there is profound corruption and that a "terrible precedent" has been set. He wouldn't be starting the "cycle that destabilizes the functioning of our country as a democracy." I don't know that he plans to continue it or accelerate it, but I do think he believes that he needs to confront his opponents with what they have done.

Here's how Trump put it in the interview with Sean Hannity that aired last night. He was asked whether he would keep the cycle going and prosecute his political adversaries. He said:
"Look, what's happened to me has never happened before.... It has to stop, because otherwise, we're not going to have a country. Look, when this election is over, based on what they've done, I would have every right to go after them, and it's easy, because it's Joe Biden and you see all the criminality, all of the money that's going into the family and him, all of this money from China, from Russia, from Ukraine...."

The latest NY trial is just the final wake up call for those that weren't paying attention 8 years ago. I think many wanted to believe the system would be self-cleaning and resolve this mess, but now they realize what most us feared long ago. It won't clean itself.

To accept this article at face value is to say, for instance, that no election could be stolen if all of the surface forms are properly pantomimed, even while the processes that ensured their legitimacy had been gutted. This is cargo cult law. Hilary was without a doubt guilt of breaking the law concerning how she managed her information, but it was decided that she was above prosecution. On any given day there are many times more laws broken than prosecuted.
Trumps prosecution was not because of the seriousness of the offense, but rather because of the seriousness of the threat he poses to the political status quo. That’s what makes it a politically motivated prosecution.
What you will witness in the future is that conservative offenses are routinely deemed worthy of prosecution, and offenses by those on the left will be regarded as trivial, and not worth the effort of prosecution.

Assuming Trump gets elected, and there isn't a wave of mass pardons by Biden what you suggested is probably has the best chance to unwind the stepped up criminalization of politics we are seeing. I would want to s newly sworn in Trump to give a press conference where he lists the crimes and things that look like crimes of Biden and his family. State that what he has done deserves prosecution and punishment under the justice system. But state there is a higher principle at stake and that is avoiding the criminal justice system being used for political gain by going after political opponents. Therefore he is issuing a fully and plenary pardon for Joe Biden and his family for any and all Federal crimes they may have committed. Then follow that up with but to ensure that there aren't other actors in the bureaucracy we will be cleaning house at the Department of Justice including the FBI to ensure that our civil servants have an unwavering principle of equal justice for all regardless of their political affiliation, religion, race, or gender. Further, we know that powers of government outside of the Justice system can be used to target political opponents and benefit political allies, so I am instructing all my Secretaries to clean house at all of the various federal agencies. While he shouldn't say it the press conference, despite Biden and his family getting pardons there needs to be prosecutions of a couple dozen former Biden administration officials, so that the conniving DC-class get scared and are motivated to join the private sector.

Having said that, prosecuting your political opponents, throwing them in jail, is not a good foundation for a functioning republic. To coin a phrase 'at this point, what difference does it make' when trying to jail ex-office holders for crimes which, although serious, are sometimes just a technicality. Democrats want to go there, though.

Unfortunately, there are always people who are fooled by these sorts of dishonest protestations. A certain degree of cynicism is required in a healthy electorate to prevent these sorts of slides into autocracy.

At this point, Trump has to prosecute them all. Pour encourage les autres. The Democrats have to learn that there was a reason we do not go after the out of power party. Trump has to prosecute to drive the lesson home that the Democrats led us down the banana republic road. To come back, some Democrats are going to need some prison time. The NEXT Democratic President will understand the message.
