"Judge Who Set Unsecured Bail For Jerry Sandusky Is A Second Mile Volunteer."

"District Judge Leslie Dutchcot... ordered that Sandusky be freed on $100,000 unsecured bail." The prosecutors wanted $500,000 and a leg monitor.

So... is Jerry Sandusky not a flight risk? Maybe not. If you look at the grand jury report, page 20, you'll see that when Sandusky was confronted with the allegations about "Victim 6," he said: "I understand. I was wrong. I wish I could get forgiveness. I know I won't get it from you. I wish I were dead." That suggests his orientation leans toward escape by suicide. I'm no expert on the standards relating to bail requests, but don't you think that someone who'd consider suicide as the solution lacks the energy and determination to flee or at least is unlikely to flee successfully? I don't know. Presumably, he has plenty of money, and he knows he's likely to lose it all in the various lawsuits that will be filed. What's $100,000 to him?

And, the biggest question against Joe Paterno is WHY was the Penn State locker rooms available to Sandusky after 1998?

And, because of the Catholic Church's attempt to put a lid on the adults making claims ... discovered they couldn't discharge blame as coming in "too late."

And, in "Happy Valley" ... the PERVERTS ruled! Sandusky never had to leave ... even though there are 3 separate reports of him getting "caught" in the act!

Joe Paterno? He built his reputation on MORALITY. And, he fell short.

The current governor of Pennsylvania is also on the Board of Directors at Penn State. He was involved with the immediate firing of a man way past his prime in being a coach of a football team.)

He was kept on too long.

And, after the DA "disappeared" in 2005 ... this case was quietly handled by the man who is now governor of Pennsylvania.

Bringing this "situation" to its conclusion ... The one you see now ... Is like seeing the "big ship hit the tip of the iceberg."

Small town. Small community. Perhaps many of them are in denial?

Maybe, some of them thought the ass-fucking was good to those children that got "chosen" and "grommed?"

The money to the charity flowed in.

Some charity.

Some cover up.

Some mafia! Getting to a DA and having him disappear.

What are the odds that Sandusky shows up dead, next?

Barring some unusual provision of PA law, the purpose of bail is to ensure that the defendant will show up, and to avoid danger to the community while the proceedings are pending. Excessive bail is, of course, prohibited (8th Amend).

Nothing to suggest that the court got the quiz wrong on either issue.

Andrew Vachss calls this phenonemon the "circle of trust." Child sexual abuse is less the guy who kidnaps at random - though that happens - but more the people (men and women) within a child's circle of trust. The other adults in that circle entrust children into that person's care, believing the child is having a special experience, benefitting from extra attention from some coach, or priest, or teacher. Once an offense is exposed, Vachss says the circle starts to fold in on itself, hence you have ineffective "mandatory reporting" acting as a circle - they don't go to the police, they report it throughout the circle, each report more vague than the previous, like a game of telephone.

Here, this judge should have recused herself. Instead, she kept the circle intact.

As for his "I wish I were dead" remark, I wouldn't believe it to be anymore than a bit of narcissistic drama.

As to legal strategy, up at the Daily Beast is an article that contains the strategy lawyers will use. They will use the 14th Amendment's GUARANTEES that little boys' rectums can't be used for pleasuring perverts.

A whopper of a case will land in Federal Court.

I guess those who know about the legal ramifications of the 14th Amendment's guarantees ... are becoming aware of the dynamics of the law suit, ahead.

In 2010 the mother of Sandusky's grand-children ... filed a petition with the court (in Happy Valley) ... to keep her kids from visiting their "grandpa."

Once again, you see selective justice. The entire Penn State system is nothing more than a giant mafia at this point. The football program and the school need to be shut down completely. It will be one of the small ways that it can atone for this horror. The school should be sued into oblivion. Sandusky at this point is a loose cannon who will either try to kill himself or be a danger to others and justice will not be served. This is why child molesters and rapists should qualify for the death penalty. At this point Paterno should be criminally negligent and McQueary should too along with the any and all school and police officials who knew and did nothing. Frankly, I think McQueary should kill himself at this point. That coward doesn't deserve the money of the state to prosecute him. Why is he on leave? Why is he not fired?

Saying "I wish I was dead." is a far cry from having plans to commit suicide. The judge should have recused herself. With only that statement to base your opinon on, you make too great of an assumption based on a single statement made in 1998. No psychiatrist would rule a person suicidal based on 13 year old statements.

That sentiment goes back to The Godfather II, in the senate hearing scene when Pentangeli tries to rat out the Corleones and when Michael brings Pentangeli's brother from Sicily he recants ratting them out and is told by Robert Duvall (Hegen) that he did the right thing by keeping the oath of Omerta intact and that there was only one way to atone for his responsibility and he slits his wrist in the bathtub in the scene where the Feds are playing cards. This thing with Sandusky smacks of that in that the judge is giving him the out for the paltry price of 100K.

My take on Second Mile comes from an experience in 1985. My son at age 11 became a special favorite of his wealthy Sunday School teacher, who took him with him to awards banquets for the teacher and motor cross rides at his estate.

I was felt very suspicious, but was not ready to accuse a man admired greatly within the community of being a pervert.

My son assured me then and now that nothing happened to him. I believe my son, but I am still angry at another wealthy man for wanting to romance my son.

There seems to be an inclination by many wealthy men to promote life experiences for age 10-12 boys. It may be from childhood experiences they remember.

But most of them leave the sex part out or they would be dead by now. I guess it promotes their ego to be needed.

According to the grand jury report, the janitor had worked there only a very sghort time. He was very angry.

Why he did not take it further, I do not know, but he was unavailable for testimony to the grand jury: he had since the incident fallen victim to dementia, and was confined to a rest home.

Not looking to diminish the seriousness of what went on, but reading the Grand Jury report, it's hard to find any collaboration of anal rape. It does not appear that victim #2 was identified to collaborate what happened, and there are different perceptions of what the graduate student reported that he saw (what appeared to be anal sex being committed on a boy that appeared to be 10 years old). The legal issue seems to be that no matter what happened, it should have been reported to proper authorities for investigation.

Victim #4 reported that an attempt was made at anal penetration, he resisted, and that was the end of that. Felt that he was being "tested" to see if he was willing to do it.

Victim #8 is the one seen by the janitor. His identity was never confirmed.

Most of the victim's testimony seems to collaborate inappropriate fondling, oral sex, naked wrestling & bear hugs (from behind the victim's back) in the shower. I'm wondering how close the graduate student could have gotten to confirm that anal penetration was taking place.

re: McQueary's "blowing the whistle": this is the same problem we have seen with the Catholic church and other institutions. Illegal behavior, and a sexual assault is a crime, should be reported to police, not to one's boss. I don't see how just punting some information within your organization meets the requirement, legally or morally. Any "mandatory reporting" law that doesn't mandate a direct report to police is useless.

For all we know the cops might have covered it up at that time as well, given the influence of the University in the community. If someone had beaten Sandusky's ass at the time, it might have made a difference in what happened subsequently. But who knows. Multiple failures everywhere.

Since he is facing perhaps 400+ years in prison (based on counts announced so far) and is recognized as being tantamount to Hitler, suicide has to be a major option.

Am I correct in recalling that since Ken Lay died before sentencing, there was some financial impact that was reduced (fines could not be assessed against his estate?) Of course civil litigation probably ate that benefit up, and would in the Sandusky case.

I don't think he has any good options. He can't move to FL and establish a homestead to protect a life estate in that for his wife.

He's forked. It would be hard to argue that suicide wouldn't be a good call for him. He is not going to testify at a trial. He is going to make the prosecution do the hard work, and make the victims testify, which will be excruciating.

Even Sandusky's wife knew something. Dottie never had a kid on her own. And, in 1998, or 1995. She, herself, called one of the victims up on the phone, to get him to "change his story."

The DA that's disappeared ... actually closed the 1998 case. And, was forced to re-open it in 2005. The last his family saw of him was when he said he was going out to talk to somebody.

His car was found 50 miles away. And, his laptop, sans its hard drive was recovered out of the Susquehanna River.

It seems the Mafia has higher standards than Penn State!

Watch for the MEGA lawsuit(s) to come. FEDERAL COURT. 14th AMENDMENT. A good lawyer can take this clue and build the strategy behind the lawsuits. Will the taxpayers in Pennsylvania be forced to pay?

The janitor was "let go" after 8 months on the job. He now has dementia. And, Gricar (sp?) the DA has finally been declared DEAD.

Colbert was the next DA to get this case. And, recently he got elected governor of Pennsylvania. He is also one of the members of the Board of Trustees.

Joe Paterno made his announcement to retire at the end of the season, KNOWING the Board was holding its meeting. He wanted to work around the announcement with one of his own. And, this, too, blew up in his face.

Small boys are very curious about sex.

That worked out real well back in the 80's for some day care workers at Kern Coutny, McMartin Preschool, etc.

If I told you that I've interevened on the behalf of a child who was clearly being abused by his father in a shopping mall parking lot, would you believe me? I don't care, but I did and when I told him to stop and he told me to mind my own business, I told him that what I saw became my business and if he didn't stop then I would stop him and I did just that.

Would you believe me if I told you that when a relative in my family who was sexually molesting one of his children was being shielded by his wife and other relatives that I payed him a visit and afterward called the police and that cops themselves basically shook my hand, one by one and said I did the right thing and that I wouldn't be charged even though his wife wanted to press charges against me and I would have willingly gone to jail for it?

I have no idea what credentials an attorney needs to bring a case into Federal Court.

And, I have no idea how the 14th Amendment will be the vehicle to use. Because it protects individuals from harms. My guess is that Penn State will be considered a "State" player.

@Carol One the more curious comments I heard at the PSU game Saturday was from an older fan. He said there was a deliberate delay in the investigation by then AG Corbett.

Corbett did not want to be the AG who presented the indictments. It would have torpedoed his run for governor.

I think Corbett understood that the DA who disappeared, was killed off because of some power that the perps OWNED.

As to Joe Paterno, in that he is Catholic, I think he was fully aware of what happened when the lid blew off the Vatican's "controls" of brushing off pedophilia investigations. (The shit hit that fan in 1991. On a Larry King Live program, no less. When King interviewed an adult victim. Who wrote a book. And, the victim was there with his lawyer.)

You'd think there would have been a better response out of Penn State! Except that the "charity" Second Mile ... put into place in 1977 by Sandusky ... was a GOLD MINE.

Remember last year when a student at Notre Dame was killed (more here. "IOSHA fined Notre Dame $77,500 for six safety violations tied to Sullivan's death, including knowingly putting its employees in an unsafe situation."

They knowingly put a guy in a situation that killed him, but no criminal charges, no (in)voluntary manslaughter or reckless endangerment? Brian Kelly keeps his job after someone is killed on his watch?

1. Let me say this first because soon you won't be listening to me: Sandusky must not die. Not yet, at the very least. If he dies that seems an excellent circumstantial reason to suspect a wider conspiracy a la some Taken-style boy-grooming ring. Just as the death of Gricer should have sent up alarm bells, so ought a Sandusky quietus. You want him alive!

2. As a Jew, I am disgusted at the Catholic-bashing. I suppose if it were a Protestant it would be girls a day older than the age of consent; the Muslim tendencies are well known; Buddhists also seem to like little boys; and even Jews...my own cantor at Temple Emanu-El was accused of horrible disgraceful activities with members of his own family (amazed C4 has kept shut on that). If true, why wait? I knew a Puerto Rican boy in my childhood who was said to have lost his cherry - with girls, I believe - at age ten. The sexual instinct start when it starts.

So if you accept homosexuality, isn't the age of consent rather pointless? My friend who recently died in the midst of sad domestic troubles had three kids. The youngest, a boy about ten, has the obnoxious habit of climbing into people's laps and squirming about, about as welcome as a dog humping one's leg. If the mother, a drug addict and adulteress, doesn't watch out, he will continue squirming in men's laps till he finds what he is looking for. It is not preposterous to think that the 2002 McQueary case involved consent.
