I never understood the drive to blame the voting machines.
That said - there were instances where voters were witness to voting machine problems - like a total switch from R to D. but hey - whatever. You need proof not accusations.
Trump talked about the cheating prior - but did little, prior. Sadly - no one has the power to prove what we all know.
The real issue was the over-night counting in secret, and the ballot box stuffing. (See facebook's ballot boxes in key cities and the mules drops)
I have no doubt that the desperation to keep Trump out of the white house inspired enough cheating to give old basement dweller crook Joe the win.

Yes, giant screw-up by Fox. And Trump really duped Fox into it. The machine rigging falsity was the heart of it. That's mostly on Rudy and Sydney Powell.

One of the main reasons Trump lost was old-fashioned cheating and the $500m that Zuck spent. The mail-in ballots and drop boxes in key states were the thing.

Here in Omaha, suburban women personally loathe Trump. There is very little election cheating in NE.

Like I said, I'm done with Trump. If he's the nominee, I'll vote for him. But he can't get to 270. Too much baggage and too much cheating in swing states like PA, MI and WI.

I suspect that it had more to do with the House, rather than Trump. If the Dems had been on track to gain seats in the House and Senate, like they had expected prior to election night, then Trump would have won, because he would have been neutralized while still serving as a boogieman to drive up Dem fundraising. The panic came when the returns started coming in and people started talking about a possible GOP majority. A Trump reelection with a GOP congress would have been a disaster for the left.

Western civilization is comprised of institutions and cultures built on a foundation of a high-trust society. Unfortunately, the global managerial class has spent the past 70 years burning away all that for their own short=sighted goals. A lot of the problems today are the result of high-trust institutions operating within a low-trust society, and the subsequent conflicts. Meanwhile, the managerial class cannot understand why nothing works anymore the way it should work.

Thinking Fox ran some mock juries and the results were grim. Now on to the Symantic trial in New York state court. They claim $2.7b in damages, dunno how. Also a shareholder derivative case, but that would be a bench trial in Delaware. Way those work damages would be paid to Fox.

The Pentagon has been hacked. Every department in our Nat. Sec. operations has been hacked. The White House has been hacked. Congress has been hacked. Your major and minor banks have been hacked, your information on the 'most secure sites' from Adobe to Yahoo, Facebook, Linkedin, Marriott, Experian & Equifax (loved those), and scores of others have been hacked.

But Dominion, sitting high atop the rest of us mortals, remains the most secure source to run your electronic elections. Forgive me for not buying it. It's pretty easy to hack these things.

Fox could not prove any of the comments that were made on their network. This does not mean Dominion should be trusted to walk your mother across the street, or load up this country with electronic voting machines.

If we were truly interested in voting integrity, we'd eliminate electronic voting machines, which any random 7 year old could tell you are susceptible to infection, or hacking. Eliminate mass ballot mailings- to be used only for oversees or physically impaired. Make elections a week, one week. Not a month. Not extra days after election day. One week running up to election day, and ending ON election night, no later than 8pm locally. Eliminate ballot harvesting. If ever there was an insult to the word 'integrity' this is it. Clean up voter rolls regularly. The full time job of the county election staff should be to make sure registration rolls are accurate and up to date.

If we cannot do this, what's the point of elections? If we refuse to do this- which one party apparently insists on- there's more at play.

The apology/retraction obsession is nuts. Dominion is owned by a hedge fund with investors including selling management. It was purchased about 5 years ago for under $40m. Even with a contingency fee (just guessing) the return on investment will have been amazing. What LP cares about insincere apologies next to that?

I once defended a premises liability case against a child. Injured at 6, settled at 13. When it settled after summations I can't remember a happier looking person. As if I was writing her a check myself. Even a teen understood that what mattered was $$.

Anyone faced with an army of lawyers, a multi-million dollar suit, and a hostile judiciary, already tried in the 'court of public opinion', is going to lose. Innocence or guilt is irrelevant.

I do believe there was a case in the state of Michigan where voting machines were demonstrated to have incorrectly counted the votes, and the votes voided. It was a local news station.

Being in charge of a lot of automation and programming, I would not trust the machines (or rather, the ownership of the machines). There is a serious lack of transparency over these Dominion machines, which demonstrates there is something to hide.

The allegations reported in the news were unimpressive--this or that Fox personality didn't think Trump was robbed. None of it even looked relevant to the suit, just puffery to win the news cycle. That, coupled with the near-impossibility of winning a suit against a media company, left me totally surprised that Dominion got more than a nominal token settlement.

Dominion's business model is selling something that does a very important job but cannot be verified to actually function properly (except by themselves, of course). The machines have been questioned in a bipartisan manner. It is not a useful product, and Dominion is not a useful company.

To be quite honest, when your job is to do something this critical to the function of the state, the burden of proof is on Dominion to prove that their systems are foolproof. I understand that is not how libel cases work, but it is the reality of adopting their product in any way that is sane. Alas, we do not live in a sane world.

Transparency and accountability in elections are fundamental to our Republic. Ask yourself why you would trust a voting machine that is, by law, supposed to be inaccessible with tightly-controlled privileges, and yet in certain key districts, was accessible remotely through wireless servers, and was being administered by unappointed private officials, who just happened to be electoral operatives, funded by Democrat political action money - who had access to the machines in real time. Please don't try to tell us that our elections are fair, open, transparent, and honest when so much effort has been poured into resisting audits and blocking oversight of election rolls. It won't wash. Dominion won the game, not the war.

I'll accept that Fox told its audience wanted it wanted to hear and did so in denial of what was the truth and what some of its on-air talent believed was the truth. I don't understand how that amounts to 3/4 of a billion dollars worth of damages, but that's the figure both parties agreed to. Has a precedent been set? Can anyone who suffered a loss of reputation in the Russia collusion stories now sue? Can they sue in Idaho?.....The msm are more subtle in their biases. In Robert Caro's book "The Power Broker", he reported that overpasses on the Long Island Expressway were low so that buses could not navigate them and thus Black people could not travel to Jones Beach. The story has been disputed, but that story is widely repeated. It's one of the foundations of the highways are racist narrative. In another of Caro's books, this one on LBJ, he reports that LBJ won his first election to the Senate by means of massive voter fraud--massive as in several hundred thousand votes. That story is not widely or--for that matter--ever repeated.

You've claimed "cheating in MI..." more times than I can count. I'd really like to meet you, and discuss your claim of "cheating in MI" in detail. Our (then) Republican-majority state senate studied the 2020 election and determined that the election was neither stolen nor fraudulent.

Yes, no, no, and yes. Although what I really wanted was a trial. A trial, in which Tucker, Hannity and Ingraham were all humiliated publicly, under oath. After that, a videotaped apology from multiple Fox hosts and executives. A groveling, tearful apology. I clearly didn't get that, so I'm not as happy as I might be.

It's a fascinating question. There is no earthly way that Fox's defamatory coverage of Dominion could have caused Dominion that amount of economic damages. So then there is the question of punitive and exemplary damages. It could be a lot; but it would be really hard to blackboard a punitive/exemplary damages claim of this amount; if a jury awarded it, the trial court (applying the usual federal court and Delaware court constraints on runaway punitive jury verdicts) might reduce the final judgment amount, or an appellate court might reduce it. (For that matter, an appellate court might review some of the trial court's pretrial rulings on the burden of proof, etc.)
Additionally; there is some case law suggesting that a corporate Defendant's revenue might be considered as an element in a punitive damages award. Fox's annual profits are about $1.2b on revenue of about $14b. The only justification for this settlement would be based largely on a hypothetical question of, "How much is enough to really punish Fox?" This settlement is a bigger number than any comparable products liablity or other personal injury case.
So the only way to understand this settlement is that Dominion got MORE in the settlement than they could have reasonably hoped for in a "best case" trial scenario. It is a stunningly total win for Dominion and a colossal defeat for Fox. This is just how much Fox didn't want a public trial. It is an otherwise-inexplicably huge settlement amount.

Who was the Internet security guy who used to give out his SSN on his TV ads? He got burned in the end, but he was putting his money where his mouth was. How is Dominion doing along those lines? To claim to be secure, unhackable (!), and accurate but to refuse to enable outside auditing is not exactly the recipe that fills this voter with confidence that my vote will be recorded and reported correctly.

That said - I agree with those who say they believe the election fraud that moved the needle in those areas where it needed to be moved in 2020 was your common or garden variety, not voting machine hacking. Occam's razor dictates 3 things to me in this instance: 1. Joe Biden did not have popular support; however, his media support was overwhelming. 2. Media support for Biden, or rather, media attacks on Trump combined with media cover for Biden, made the election more about voting against Trump than about voting for Biden. 3. Election tampering, from rule changes through election-day problems in Republican-heavy districts up to and including the usual kinds of fraud, led to Biden's narrow victory in the places where it needed to happen, in order for him to win under our system. Oh, heck, let me add a fourth. 4. Biden has been for decades and continues to be a corrupt inarticulate ineffectual boob, inept at everything except making sure his family continues to benefit from his government "service" and his political enemies suffer for their sins against him.

Western civilization is comprised of institutions and cultures built on a foundation of a high-trust society. Unfortunately, the global managerial class has spent the past 70 years burning away all that for their own short=sighted goals. A lot of the problems today are the result of high-trust institutions operating within a low-trust society, and the subsequent conflicts. Meanwhile, the managerial class cannot understand why nothing works anymore the way it should work.

For years Republicans held a significant advantage in early voting, then Donald Trump told them to vote only on election day, with predictably disastrous results in 2020 and 2022. Presume Important Person X at Fox sends an email containing an assertion which is a clear falsehood and likely defamatory to another Important Person at Fox. Second Important Person does not replay. Is that any kind of evidence in court? Not speaking legally, but in court where "legally" frequently goes to die.
Does it imply agreement? Is failure to correct an internal email's assertions the same as approval? Does it mean sufficient recklessness as to cross the standard for libel?
Which is to day, I'm wondering how many emails went one way and resulted in no reaction whatsoever and whether they were counted against Fox.

While everything you wrote is factually true, the broad characterization is inaccurate. Republicans were less willing to cheat using mail-in-ballots. I hope their reluctance will be less in 2024 since cheating is the only way to counteract the Democrats doing so, as the courts have made abundantly clear in the last 3 years. The Republicans will need to also drive their turnout above 100% in the areas of the various states that they firmly control at the local level. When overall turnout reaches 120% in a few years, maybe, just maybe the Democrats agree to come to the table and negotiate an end to ballots with no chain of custody or verification of authenticity.

As I noted there’s a word for those who fail to emulate the innovations of their opponent: Losers. If Republicans want to win they will match Democrats strategy for strategy and then some, and they will also dump the guy who told them not to vote in 2020 and 2022.

It was five swing states stopping the count at the exact, same time, throwing out the watchers and then miraculously having Biden ahead when updating their totals three hours later.

Dopey D, if you know the fix is in, like a Delaware or NYC jury or a DC jury, it's pretty safe for Democrats. Recent examples are Scooter Libby and Greg Craig. DC juries.

I know enough about cybersecurity to believe that the Dominion machines are hackable, though probably not deliberately so. And any decent hacker would have the malware erase his tracks as the last step before shutting down. The best way to prove that they can be hacked would be to hack them to give 100% of the votes to Donald Trump. It would be really funny they do it for a Democrat primary.

This is purely a thought experiment since I spent my career developing countermeasures, and I’m not a hacker myself.
