"We agree that it has indeed been commonplace and widely accepted to separate public restrooms, locker rooms, and shower facilities on the basis of sex."

"It is not apparent to us, however, that the truth of these propositions undermines the conclusion we reach regarding the level of deference due to the [U.S. Department of Education's] interpretation of its own regulations."

Said the 4th Circuit Court of Appeals, finding that the Gloucester County School Board's policy violates Title IX.
[Gavin] Grimm was born female but identifies as male. He was allowed to use the boys' restrooms at the school for several weeks in 2014. But after some parents complained, the school board adopted a policy requiring students to use either the restroom that corresponds with their biological gender or a private, single-stall restroom.

I was at a relative's house last weekend and a reality show was on in the background about life in jail. There was a men's and a women's totally separate.
What about that? If restrooms must be gender neutral, what about other facilities like jails? Is there are a reason why these changes won't apply there?

No fucking shit it is commonplace and widely accepted. These people have no idea how far down the road we are. There are so many people in the leviathan that have no worldly clue how we see this kind of crap out here.

No matter how black your robes are or how smart you think you are you cannot come up with a reason why there is going to be a 'person' with a dick in the same restroom as my soon to be 3 year old daughter unless it is me with her in the men's bathroom. Soon she will be too old for that and she will be going in the woman's bathroom while I wait outside. It will be clobberin' time first if you let men hang out in that bathroom.

If they are lucky the people on this court will get to watch the Trump presidency and this garbage will start getting rolled back peacefully. Otherwise it will get rolled back the other way.

Achilles, I don't agree with you on Trump, but you are spot on with this. There will be violence over this, and sexual predation, along with false accusations of it flying around like confetti. It's just about the most irresponsible thing a society could do, and it will victimize the most vulnerable from little girls to grown men. Gasoline on a fire where no flame even existed before.

Imagine a young girl at the movies goes into the restroom, and two men follow her in. Nobody else is there, and yet everybody is following the law behind a closed door. Sleep well parents, you have created an open tolerant society... on paper.

That might keep your little daughter from the risk of men in the women's room, but how does that protect her from getting a failing grade or being expelled from school or fired from her job when she keeps calling Bruce "he" rather than "she," persisting in the truth that he is really a boy and not a girl named Caitlyn?

Howard, I prefer to enter a women's locker room with my two young girls with the knowledge that the only anatomy they will be seeing (and trust me, we do see) will match their own. If that makes me a prude, so be it. But I will note that if my daughters saw a penis at a park, the man would be arrested. Why is it suddenly ok in a locker room?

Haha, good one Howard. Have never seen concern for any other than young girls or women.
Every stadium event I have attended lately has had women use the men's room, and nary a tear was shed in distress. They come in pairs and groups or with boyfriends/husbands because their lines are too long.

I noticed something.

Most places don't have laws about the "Gentleman's room" vs. "Ladie's Room" users.

Because society developed a very strong social incentive that worked.

There must have been a reason for that choice.

Some sort of society-wide decision that large public facilities of this type should be separated.

There's a sense that even though most men and women could behave themselves, there is always that one stranger in one hundred who could use a mixed-sex lavatory for voyeurism. Or sexual harassment. Or assault.

And to make it easy to stop that--and to install a strong cultural barrier against it--we set up rules of social opprobrium and shame to convince people to use one room, and not the other.

(I also notice that public restrooms are from the age of urbanization and indoor plumbing. Yet the people who made those decisions also made decisions about bathing, privacy, and social boundaries in small families, towns, and cities, during the era just before indoor plumbing.)

How much do people want to weaken that strong social rule about propriety, privacy, and avoiding even the remotest possibility of strong people preying on weak people?

I understand the desire for change. American culture has been full of change. And we spent the last tree-quarters of a century changing the social rules relating to sexual intimacy.

But change by itself is not always good.

And what happens when the culture tears apart old social rules, and discovers a generation later than the results are worse than the original problem?

Now now. If one were to assume some aberrant characteristic was behind every borderline-sane outburst by Howard, we would soon run out of characteristics with which to describe him.

My recommendation: Aberrant characteristic rationing. Regardless of how many times and in how many ways Howard goes off and loses it, let us refrain from attaching any labels to the outburst and just roll them all up in a consolidated report at the end of the fiscal year.

Which means we must end Title IX. And a Republican President must decide to not enforce ANY law that puts ANY law-making ability in the hands of bureaucrats.

Men, we have to make an example of this. Men should go to women's restrooms and stare at adult women. Every single day. Show the massive problems this idiotic policy leads to. But I have doubts it will change anything since Progressives worry more about people afflicted with body dysmorphia than women.

I wonder how long until we're chided for trying to fix the issues of anorexics. Since they have the identical problem trannies have.

I want to echo the comment of MayBee above.

No matter how you feel about the merits, this is not a fight that was "picked" by social conservatives.

This is a fight that was conclusively started by the Obama Administration's Department of Education Office of Civil Rights social activists. Using Title IX to literally threaten individual schools and school districts with federal punishment if they don't conform to Obama social mores. Just like the supposed campus rape crisis.

Danny K said...

I can't believe our civilization has come to this. But if we have to do something, let's just make the men's room an "anybody" room (it kind of already is), and continue to restrict the women's room to actual biological women or post-operative transsexuals. That way nobody will feel stigmatized for using the men's room, and women can have some damn privacy which was the whole point of segregated restrooms in the first place.

damikesc said...

Danny, it's almost cute that you think ANYTHING will satisfy the pink gestapo. They want fundraising money and this does it. They LOVE the idea of culture wars now.

Bryan C said...

"regarding the level of deference due to the [U.S. Department of Education's] interpretation of its own regulations"

Wait. Why is deference due to a regulatory agency in "interpretation of its own regulations"?
The regulations define the scope of the agency, not the other way around. Otherwise you can simply write wishes on your magic piece of paper to give yourself whatever authority you want. In the IT industry this would be called a privilege escalation attack.

If an agency feels it needs more latitude then the agency is in the perfect position to lobby for legislation that gives them that latitude. Otherwise no dice.

mikee said...

Time to rewrite Title IX. Long past time. It has been twisted out of its original horrid purposes to direct the outcomes of issues never contemplated as applicable under its aegis, before the Obama Administration.

Or, perhaps, do away with the Obama Administration, which seems to be the common denominator in so very many misuses of law and governance and politics in the country for the past several years.

Bring on Hillary, let the strongest survive and the rest fall by the wayside as the expendable vermin she thinks they are!

Mark said...

Yes, Danny. It's not like in women's bathrooms there are stalls giving privacy to each toilet or anything.

If this is such a small percentage of the population, why is everyone so bent out of shape about it? The reaction is not merited for the fact that most people will never encounter this (or be aware).
