It’s an interesting hypothetical legal question, but I would think a President’s orders would still be valid at least between the time of his death and the swearing in of his successor, perhaps until they are affirmatively revoked by the successor (as is the rule for formal Executive Orders). That doesn’t necessarily mean they will be carried out, but they could be.
Let’s take two examples:
1. We’re subject to a first strike nuclear attack, the planes to make the counterstrike are in the air, and the President is taken out by the first strike. Are the counterstrike orders still valid? Major Kong would say yes.
2. The President orders a first strike on no provocation, goes into the bathroom, and shoots himself. In that case we would hope the orders are not carried out.
Finally something that Trump and Hitler really do have in common. A lot of people want him dead, but also like Jesus.
