A site on X (“Terrible Maps”) posted a map showing the drunkest 50 counties in America (in terms of the percentage of adults who binge-drink heavily)—all but 9 of which are located in Wisconsin (the others are located in Iowa, Minnesota [1], South [1] and North [1] Dakota). I thought that was interesting.

I wonder, when Ann watches Elana Kagan voting 180 degrees from her previous statements on rogue district court judges, and realizing that the Supreme Court is an absolute joke and that the written laws means nothing, whether she wasted her life teaching these people.

It kind of looks like Amy Coney Barret didn't even bother to take Ketanji Brown Jackson out behind the barn. She put little Miss "I am not a biologist" over her knee and quite publicly explained to the AA hire that "Neither are you a jurist". With four of her fellow justices concurring. Like, "Once the smarter end of your body stops smarting from the licking I am applying to it, maybe you should explore that particular form of shutting up known as shutting the Fuck up".

I am a bit concerned about how this can possibly play out going forward. And I am pondering just how thoroughly sick and tired five SCOTUS justices need to get before they land a lambasting like this on someone who may well be on the Court when they are all gone.

As a highly competent computer programmer, I have often been subjected to harangues to the effect that I should be grateful for the opportunity to expiate my crimes of privilege by serving as an "ally" to Little Black Samba, and Wise Latina, and so on. I have never actually been moved to sabotage their incompetent asses, and hang them out dry. But neither am I interested in saving them from their evident incompetence, which is usually served up with an astonishing helping of arrogance. They really seem to imagine that I accept their analysis of our moral relations, and am eager to help them to obtain the rewards that I have earned. I mean, how can anyone, even a Negress, be that clueless about how human beings act? I think they must have learned it at "college".

Why don't you explain how you came up with your numbers Rich.

Why don't you try to explain how things are going to be different under Trump than they were under Biden?

Oh I forgot you are kind stupid and you just say what the media tells you to say.

By the way the only way to pay off the debt is to grow the economy at a higher rate than interest is growing anyway. I don't expect a dumbfuck like you to have any idea how to grow an economy or to improve wages for working class people like Trump is doing.

I want to thank Ketanji Brown Jackson for ... ( wait for it ) ... being a really stupid person and making the Supreme Court look like an absolute joke.

Jupiter म्हणाले...

I'm puzzled about how this works. Did KBJ write her dissent, without having the majority opinion? Just knowing what they ruled? And then, ACB wrote that opinion, and in the process, ripped the ignorant, nappy-ho hide off of KBJ? And then, four of her fellow justices read it, and said, "looks about right to me. Let's go with that!"? That sounds like we should not be surprised if pepper spray is deployed at the next meeting of the court.

I believe that whoever owns the democrats and controls them knew Ketanji Brown Jackson would be an absolute embarrassment. There are intelligent Black Women who could have served in that roll.

But they picked an idiot on purpose. They did it in order to alienate black people from the general population.

At some point we need to actually start making sure the Pritzkers and Soros's and other scummy oligarchs pay for their crimes.

Role.
I am uneasily aware that while KBJ is nowhere near as smart as her professors told her she was, neither is she an idiot. She obviously has a truckload of politicized baggage, and she probably is not among the 2000 best legal minds in the USA, but I'm still not sure she deserved what ACB just laid on her, very publicly. If four justices concurred, this indicates a degree of rancor among the members of the court that is unprecedented. What could they hope to accomplish by this? Drive her to resign? It seems possible to me that she may actually have more intellectual horsepower than Sotomayor, and might conceivably develop a coherent personal theory of the law. Well, probably not. A long, long climb, from a deep, deep hole. But still. How did five justices decide this was the best way to deal with a fellow justice?

Big Mike म्हणाले...

In the comment thread following Althouse’s post about the Supreme Court’s final six decisions of the year I asked whether someone could confirm the story that Justice Kagan had argued against nationwide injunctions back when Biden was President. Well Scott Jennings has done so, gloriously. Yes, the two DEI hires on the Court are embarrassingly out of their depth (and might well be so as traffic court judges), but in its own way Kagan’s demonstration that her legal principles are malleable, depending on who the President is, is even more damaging to the Court’s legitimacy.

According to ACB et al, KJB is not doing the job well. I imagine they each tried to convince her that there are guardrails that she is not allowed to cross in our constitutional construct and she just wouldn’t budge. They did not want her view of an imperial judiciary to gain any traction in the populace. If they were above the executive, they’d be responsible for everything.

I suspect it's more than just KJB though I feel she has probably become a lighting rod for frustration (the studies showing she speaks more at oral argument than three of the more senior male justices combined probably doesn't help). Each of the other six have, from time to time, shown a degree of independence from strictly ideological judgement (you can say Roberts is doing it wrong but most people think his motivations are mostly for the Court to be respected rather than to advance a political theory) but the Three Blind Mice vote a political line with a predictability that has to be somewhat maddening. I'm sure the justices that were on the Court in 2022 were quite aware of how Kagan flip-flopped on universal injunctions, too.

She was here to do some paddling on the lazy rivers. I asked her about the canoe - how do you get it on and off the car? I can get it down all by myself, she said, but as for getting it back up: well, I depend on the kindness of strangers.

Good catch bringing up Sotomayor.

The "Wise Latina" is obviously too stupid to be on the Supreme court and is an embarrassment the country and anyone she is associated with while she holds that role.

All criticism of Sotomayor and Jackson will be perceived as racial by many people. This will turn and conversations of the mediocrity of these 2 "judges" away from critiques of their flawed and stupid judicial reasoning and into a bitter racial conflict.

I believe this was done on purpose.

I wonder whether Jackson said something unkind about one of ACB's children. The remarks about "boring 'legalese'" and judges following the law are startingly personal. That the other justices, particularly Roberts, let that language stand in a majority opinion on a very major decision is telling and more than a little troubling. Well-deserved, apparently, but wow.

I couldn’t find any information on KBJ’s clerks, but she needs to get a bunch of new ones. The first job of a subordinate is make sure their boss doesn’t do anything stupid and embarrass themselves. They failed miserably.

I’ll bet if you picked any random clerk from the staff of any other Justice, they could have whipped out an opinion far more cogent and true to you know, the law, than that steaming pile of do-do she blessed us with.

As to Barrett, I think she finally had just had enough.

I’m enjoying the comparison of Kagan’s opinion from 2022 (“stop the district judges from issuing nationwide injunctions”) to her complete reversal this week. She was the one leftist on the high court that I had some respect for because sometimes she would hew to the rule of law. But this is so obviously a situational decision that I can only conclude she sees the law differently when the plaintiffs have D after their name.

Mississippi Masala is a movie directed by Zohran Mamdani's mother and was chiefly interesting to me because of the hope it might give some insight into Mamdani. The movie came out in 1991, starring a very young Denzil Washington who turns the movie into something very watchable. The story follows a well-off Indian family expelled from Uganda by Idi Amin and thereby impoverished. They go to Greenwood Mississippi. The daughter, Mina, falls in love with a young black man (Denzil Washington) causing consternation and ruin on all sides. The hidden fact is that the Asian father, Jay, is part-African which must never become known to the Indian community. Because of this fact, the subtext of the movie is the different meaning of almost every scene if you consider the scene as a scene between an Asian and an African or if you consider it a scene between two part-Africans, one of whom looks Asian and the other African.
The conclusion I reached was that Mamdani very likely is deeply convinced that color does not matter but that the idea of others we get from what we think is their "color" is unfortunately deeply embedded in destructive social patterns and that this is true of all races.

She has spoken more during hearings than all the other justices combined. A stat reflected in her written opinions. But it's more of the compassion- and feelings-based view of the law and less about what the law actually means. THAT is what has drawn criticism from her fellow jurists, not her vocabulary but the complete absence of legal argument in her "legal opinion."

They had three young and the young are out flying around. One of them must have killed a rabbit or two because this one perches in trees near our open areas. Occaisonally it swoops down and does it's best owl impression by flying just feet off the ground. We must not impress him too much because he or she flew low over the skeet patch and between two groups standing there. I could have leaned out and touched it. Very, very cool.
