I can well believe Biden and even Austin were out of the loop on what was going on with the plea bargaining until after the fact. Biden has been deliberately cloistered by his staff for obvious reasons, and what we've heard publicly about Austin -- that he disappeared for a medical procedure and no one noticed for days -- suggests that our War Minister was also pretty disengaged.
But that, to me, is the overriding theme of the entire Biden administration: midlevel bureaucrats and staffers got to do pretty much what they wanted without much oversight by the democratically elected President or by senior officials appointed by the President and approved by the democratically elected Senate. It was everything the professional civil service could have dreamed of, and it was, predictably, such a disaster the people voted for more Trump.

War is a state between two countries. Soldiers in uniform have rights as prisoners. A private individual conducting warfare on his own has none of those protections. They should have been executed the moment the government got whatever information they wanted out of them.
As a non-uniformed enemy combatant and terrorist, KSM has NO rights.
The silver lining is that egregious decisions and actions like this by members of the entrenched bureaucracy are the poster children who will provide the justification of their wholesale purge by Trump.
