I can understand Baldwin having some liability as the producer who hired the armorer, but I don’t see how he has liability as the shooter. If the gun was given to him as a blank gun and he thought it was a blank gun and had no reason to suspect it was even capable of shooting real bullets, then how could he be culpable?
I hope he’s planning on giving the profits to the family of the woman he killed.

@tim maguire, he deliberately blew off the gun safety meetings held by his armorer, then mishandled a firearm leading to an accidental discharge of the firearm which led, in turn, to the death of an innocent individual.
I don’t know how many thousands of times I’ve fired a single action revolver in competition. Counting cap and ball revolvers fired in competition at the North-South Skirmish Association*, it has to be well over 10,000 times. Add in practice sessions and you have to double or triple that. (It’s that low because I only found my way into the sport in my 60s. Some of my fellow shooters had been shooting competitively since they were in their teens and have surely sent well over a million rounds down range. And, yes, they were much better than I was.)
The way one of those single action revolvers works, you pull back the hammer until it is in the full cock position. This rotates the cylinder and locks it into position so that the bored-through chamber is aligned with the barrel. Pulling the trigger then releases the hammer, which flies forward. There is a conical firing pin mounted on the hammer, which strikes the primer in the bottom of the cartridge in the chamber. The primer explodes, igniting the propellant (gunpowder) and forcing the bullet out of the cartridge, down the barrel, and out the muzzle. There is also a half cock position that allows the cylinder to rotate freely for loading or unloading purposes. The trigger cannot be pulled in the half cock position.
There are two ways to fire the revolver accidentally. The first is to have the trigger depressed when you go to cock the hammer. With the trigger depressed the hammer will not hold in either the full or half cock position, so the hammer flies forward and the cartridge gets fired. This is the most likely thing to have happened on the movie set, especially since a still photo taken just before the fatal incident shows Baldwin with his finger inside the trigger guard.
The second way to fire a single action revolver accidentally is to release the hammer before it reaches the half cock position. The hammer will come forward, though without the velocity it has when released from the full cock position. Could it cause an accidental discharge anyway? Maybe, if the primer was sufficiently sensitive. At the range I could not make it fire from releasing the hammer from before the half cock position, but maybe…
Either way, Baldwin mishandled a firearm and the fault is his.
I do not accept the excuse that he was told the gun was “cold.” Rule #1 of firearm safety is to treat all guns as loaded. You break the rules, someone dies, you should be punished.

@Rocco, thanks for that link to Brandon Herrera. I’ve seen some of his “Darwin Awards” videos but hadn’t seen that one. He and I independently reached the same conclusion, e.g., the most likely scenario is that Baldwin had unknowingly applied pressure to the trigger, so the hammer failed to engage the sear and came forward with enough force to fire the cartridge.
