"Grand Jury Votes to Indict Donald Trump in New York."

"Mr. Trump will be the first former president to face criminal charges. The precise charges are not yet known, but the case is focused on a hush-money payment to a porn star during his 2016 campaign."

The felony indictment, filed under seal by the Manhattan district attorney’s office, will likely be announced in the coming days. By then, prosecutors working for the district attorney, Alvin L. Bragg, will have asked Mr. Trump to surrender and to face arraignment on charges that remain unknown for now.

D.A. Bragg should be indicted for abuse of power. He's conflated a NY-state law with a Federal crime. He has no jurisdiction for Federal violations. The hush money payment occurred long ago and is NOT a crime. Bragg says its a false business record, but the statue of limitation expired long ago.

Bragg is a fanatic who doesn't believe in the rule of law. He'll make up any law he wants as long as he can get Trump.

A competent judge would dismiss these charges, but those apparently don't exist in New York any longer. If I were Trump, I would insist on a quick trial date. He has a decent chance of getting a hung jury, even in New York City, unless the judge is so corrupt as to rig the jury, too.

They better have a very good case with easy to understand evidence. It needs to be obvious that a just law was broken. Otherwise, I think this is going to backfire on them spectacularly. Even if it doesn't backfire during the next election, I think (regardless of how worthy this case is) there will be unintended consequences. They act as if they will always be in power.

I’m reflecting on perhaps five years’ worth of abuse that I have received from many Althouse commenters, ridiculing me for the mere suggestion that Trump would, or even could, be indicted after completing his one-term presidency.

For some of you — I don’t know how many — I expect that it’s possible that because of your intake of selective news sources, you may have no idea how strong are the several criminal investigations of Trump. You may not get it, and may not accept it, right up to the time of his sentencing hearing(s). I can’t help you with that. Just get some better news sources.

Others, of course, are just hardened partisans. I can't help any of you, either. And I don't want to. There was a time where part of me hoped for a new and better Republican nominee for President after 1/6/21. That was the part of me that hoped, in January of 2017, that Trump would be surrounded by, and overwhelmed by, the trappings of the Office of the Presidency of the United States of America and would be a somewhat normal President. That's long gone. And gone too to is any notion that the Republican base will now stand for any nominee but Trump. It will be very bad for the country, but I am okay with it. Another chance for the great majority of Americans to kick Trump's ass again.

John Yoo has laid out the problems with indicting Trump and I understand his argument to the following:

1. That the alleged payments would be a misdemeanor under New York state law and under that same law misdemeanors must be prosecuted within two years whereas the alleged offense occurred in 2016,7 years ago.

2. That the alleged offense is a felony under Federal law but the NYC DA cannot prosecute for Federal crimes

3. That the Federal DOJ has already looked at this question and declined to prosecute.

Yoo thought that perhaps Alvin Bragg was so lost in his progressive bubble that legal considerations meant nothing to him and he expected others to be the same. We don't know what felony Bragg hopes to use against Trump but it's my opinion that NYC is now on the hook for millions and millions in damages due to an egregious disregard for the law. Prosecutors are not above the law but like Harvey Weinstein they may get away with ignoring it for a short period of time.

Extradition Between States: Process
Whether or not a state has adopted the UCEA, the extradition process will be similar. The process begins when there's probable cause to issue an out-of-state arrest warrant. Typically this occurs when a person fails to show up for a court date or if there's reason to believe the person has fled.

When the out of state warrant is issued, the information is entered into the National Crime Information Center (NCIC), a nationwide database that law enforcement uses to access warrant information in other states. If the person sought is arrested in the new state, the arresting authorities will notify the first state that issued the warrant. For instance, if a crime is committed in California, and the person flees to New York, the New York police will be able to see the California arrest warrant and will notify California of an arrest in New York.

The original state may make a request for the return of the fugitive, but they don't always do so. If the crime is a misdemeanor or something other than a violent felony, there may be no request for return. However, if such a request is made, the fugitive has the option of waiving extradition or attempting to fight extradition through a writ of habeas corpus.

If the fugitive refuses to waive extradition, the original state prepares a request to have the fugitive returned. Extradition requests are made from the office of one state's governor to the other. If the request is approved by both governors, an extradition hearing will be held and a court in the state with the fugitive will make a decision to grant or deny extradition.

States, in deciding whether to extradite, generally may not delve into the underlying charge behind an extradition request. However, the U.S. Constitution (Sixth Amendment) requires the accused "be informed of the nature and cause of the accusation." This means that states will inform the fugitive of:

the extradition request;
the underlying criminal charge; and
the individual's right to seek legal counsel.
Once the request for extradition has been granted, the fugitive will be offered to the demanding state. The fugitive can still fight extradition by filing a writ of a habeas corpus. The only possible motive I can imagine for the indictment is to force DeSantis out of the race, they think that Trump is more beatable in the general. And they might be right about that. I hope they are, I, for one, would like to keep my Guv for 4 years.

But Dems are taking a risk here. They think that this indictment will scare support away from Trump for fear of federal alphabet department prosecution, but I think that this and any future indictments will galvanize support for Trump from corners previously inert, and it will purge the RINOs from the party.

When the charges are revealed, there may be other counts that warrant this indictment. However, if I'm not mistaken--I don't really follow Trump or his ongoing boasts and travails--the only charge made public is the allegation he paid "hush" money to a porn star to ensure she would not reveal his extra-marital indiscretion.

Is that a crime? If the payoff came from public funds, I can see the criminality, but otherwise...? If this is all they've got, or the most damning of the charges, they've got a much less than robust case, flaccid even.

I am no longer a resident of New York (city or state), alas! (I say "Alas" not because I won't have an opportunity to serve on Trump's jury--I would not want that torture--but because I'm no longer a New Yorker.)

As I have reported here, in my last call for jury duty about four(?) years ago, Donald Trump, Jr. was another who had been called to appear. (This was while his father was the president, and pre-COVID, so 2019, I believe.) I was startled, thinking, "Damn, that man looks like Trump, Jr!" I saw him enter the room where all called for jury duty first report and are then picked (or not) to be sent to various courtrooms to go through voir dire, and I saw him again in the men's room. I was only a few feet from him there and I caught his eye, before looking away. I still wasn't sure it was Don, Jr. Then, when names were called for prospective jurors to report to the first case of the day, the name "Donald Trump, Jr." was announced loud and clear over the mic. Damnation! It was he!

I was also called for that case, and I sat a few rows behind him in the seats where prospective jurors wait to be called up to be questioned and either accepted or rejected to sit on that jury by the lawyers for the case...the voir dire. I finally spotted at least one Secret Service agent assigned to him. He was sitting either next to or behind Jr.--I can't recall clearly--and I spotted the wire in his ear, revealing his Service communication gear. No doubt there were other SS agents in the crowd, equally nondescript.

Jr. was called up to be interviewed...in front of the rest of us, as is customary. He had a surprisingly resonant and deep voice. In the end, he was dismissed from service--no surprise. My long history of jury service on multiple civil and criminal trials in New York State ended that day, as they accumulated the requisite number of jurors and alternatives to serve on the case, and the rest of us were freed, having satisfied our obligation.
