I can't speak for Leland, but for me the rule applies to assholes that are part of a mob trying to commit arson, and get killed attempting to bring bodily injury to a person that they thought prevented the arson.

Still, ours is a creaky, maybe broken justice system, that jailed him for weeks for one of the better documented displays of self-defense that we've all seen, while rioters and looters walked free or stayed jailed barely long enough for a nap.

I read the report. The journalist tactfully neglects to mention the activities of the people that night prior to being shot, nor their criminal activities prior to that night. He does give us considerable background on the lawyers who are defending Rittenhouse, however. I don't think the photo of Rittenhouse that tops the article was supplied by his mother.

Where the defense is self-defense in the face of an attack, yes, we should look at the criminal background of the victim. You can be certain that, if the victim had no criminal background, that fact would be (justifiably) raised.

IF there are any lawyers who read these comments, I have a few questions maybe you could answer:
Is bail supposed to be punitive, rather than just a means to ensure the defendant doesn't flee?
Is there any reason to believe this defendant would flee if released on his own recognizance while awaiting trial?
Is there any reason to believe that, if this defendant was inclined to flee, losing $2 million of other people's money would stop him?
Will this case be tried in front of a different judge than the one who set the bail amount?
If the answers to all the above questions are no, how can the defendant expect a fair trial in front of this judge?

Thank you Iowan2, tcrosse, and tommyesq for the thoughtful responses to Mark. At least one of the people shot confessed to intending to kill Rittenhouse. Another is seen on video threatening to harm another person that he then mistakes Rittenhouse as being. Both of those people had criminal records that suggest a history of violent crime, meaning they were likely to carry out their threat of harm. That's two compelling arguments for self-defense. Bumble Bee makes another compelling argument. I've got nothing from Mark but conjecture and deflection to unrelated topics.

Two guns for sure, and probably more. The timeline tape his lawyers released show pretty clearly that Kyle didn’t shoot until the tall bearded hippie guy had taken a shot at him with his revolver. Kyle’s back was turned so he didn’t know which member of the antifa mob was trying to kill him. Under the reasonable-man standard, I think he would have been justified in shooting anyone in the mob, or even everyone in the mob, and I wish he had. But the next thing he knows, the bald angry-elf pedophile had a hand on his rifle, at which point he is legally considered in possession of the weapon and even more of a slam-dunk legitimate target of armed self-defense. Good riddance.

Kyle is going to walk, and when he does, we need to make him rich and famous for giving Antifa exactly what they’ve been asking for. He showed more bravery and good weapons discipline than many a sworn law enforcement officer.

The other thing we need to do is to prosecute the DA and see if we can’t get him five or ten years in Federal prison for official oppression under color of law for daring even to file these ridiculous tyrannical charges. At the very least we can try to strip him of his house, his pension, and his law license. We have to start following Alinsky’s rules and ruining the lives of individual leftists. try and understand this. When a conservative says "Lock her up." a trial is a given. We take that shit seriously. But when you. the left say "Lock em up." You dox them and have your compliant minions come at them in the dead of night fully armed and equipped with TV cameras so as to insure a biased trial. make sure they're good and tired and humiliated and then maybe have a trial. Or like that poor schlub who made a video just go right to jail. Or hit em with a bike lock or shoot them while they're playing softball.

He was attacked by dozens of people. It is on video. He shot three of them. These details are why he is clearly not a flight risk because no jury in the US will find him guilty.

The video coverage of the events in question is pretty complete. You can see criminal #1 firing into the air. You can see Rittenhouse being pursued by multiple older men, rioters with violent intent. You can see him react to the (illegal) shot, thinking that he was the target as the multiple male rioters were chasing him. You can see victim #1 get it, and victim #2 getting it as well, as he attempts to strip away Rittenhouse's weapon after Rittenhouse was distracted by being hit by another criminal with a skateboard. There isn't much doubt about what happened, compared to other similar targeting crimes involving a victim's self-defense in the face of multiple attackers. The video record is exceptional. The prosecutor's track record is also in alignment with his past professional efforts. He has no qualms going after people who make good victims for his political portfolio. You get what you elect. If people from Kenosha like seeing Main Street burn, like seeing mayhem in the streets and businesses demolished by outsiders, like seeing their upstanding neighbors prosecuted for defending against these things, then they're on the right track. Keep voting, folks.

I am not so sure about that. Kenosha is a small city of 100,000 (more on the geography later).

The first night of the riot caught the city off guard, and the situation spun out of control real quick (all the fires). The second night, thanks to our dickless governor Evers, there was no National Guard presence, so it was up to local law enforcement agencies and people like Rittenhouse to establish some semblance of control.

As to the geography (for future reference), Kenosha courthouse is over 6 miles from the Interstate, via surface streets. To the east is Lake Michigan. To the north about 3+ miles out takes you into the Village of Somers - mixture of suburban homes & farm fields. To the south 3+ miles takes you to the Village of Pleasant Prairie. Also a mixture of suburban homes & farm fields. Kenosha County was 51% Trump, Village of Somers 4/5 wards were Trump, Village of Pleasant Prairie wards were 5/5 for Trump. Those villages are also accessible by surface streets only. No freeways (other than I94) to jump on to make a quick getaway. So, any trouble makers coming into Kenosha will be easily cut off from I94. Fleeing into the Villages they will likely encounter armed citizens - this would be the land of tall pickup trucks with flags. They will be ready.

In September, local law enforcement was presented with the opportunity to do a test run. A peaceful protest was going to happen at the Kenosha Courthouse. Credible information was received that there was a group of cars with blacked out license plates on I94 moving in a caravan like manner. There was a multijurisdictional response, a perimeter was established closing off traffic downtown, and the protest was indeed peaceful. Some police scanner chaser live streamed the response on Facebook. From what I can see at the end of this video, law enforcement officers outnumbered protesters.

I didn't read the article, but the pictures are great. There's a nice one of Kyle's rifle, I believe it's a Bushmaster. You can see the one-point sling he was using, to very good effect. I hope he gets it back when this is all over. Although apparently it does not actually belong to him.

I will add that, when only employed by one side, the tactic of firing and hiring based on politics is an unbeatable tactic. It will result in 100% political control of the targeted institution 100% of the time within a single generation (and they've been doing it for over 3). Once successful, it doesn't matter if the other side does it too, the takeover cannot be reversed.

The only possible fix is to completely disband each institution, recreate it, explicitly ban anyone in the old institution from being hired in the new one, and explicitly bar hiring anyone from the political ideology that has overwhelmingly proven it cannot be trusted not to do the same to everyone else. Forever.

I would say to John Huber that if he had raised his son to respect other people, and not to commit arson, then the son still be alive. But John Huber failed as a father and now his son is dead. Pity.

Because in those cases it's an important element for analyzing the "crime"

Is bail supposed to be punitive, rather than just a means to ensure the defendant doesn't flee?
Is there any reason to believe this defendant would flee if released on his own recognizance while awaiting trial?
Is there any reason to believe that, if this defendant was inclined to flee, losing $2 million of other people's money would stop him?
Will this case be tried in front of a different judge than the one who set the bail amount?
If the answers to all the above questions are no, how can the defendant expect a fair trial in front of this judge?

We already do. When there is a claim of self-defense, a defendant is entitled to introduce evidence at trial as to the victim's violent propensities. Criminal convictions for violent acts are especially relevant.
