The lawyers on the case have been told by the US District Court Judge to be in court on Monday, to put into writing their commitment to begin the process of producing Census questionnaires without the citizenship question.

Basically saying, don’t even think about fucking around on this anymore.

And of course here is the periodic reminder that I favor the citizenship question on the form. I like having that question on it. And I also think that the executive branch should have full powers to include such a question absent specific Congressional mandates. And if I had been on the Supreme Court, I’d have been a deciding vote for Secretary Ross.

Easy legal solution. Put the citizenship question on the census form. Under the APA recite that reason is that since 10 Dem candidates for President want to extend free health care to illegal aliens, then the President needs to know how much that will cost.

If he did try to do that, he would be in direct conflict with the Supreme Court which would have already allowed the question into the Census. The only reason his injunction is still in place is because the case in his court was not the one heard by the Supreme Court.

The strategy in Hazel’s court is to try to throw up enough obstacles to the Census going out with the citizenship question in a timely fashion that the Administration will have to fold. If the Administration makes it across the hurdle set by SCOTUS, the odds of a nothingburger case like the one here derailing the Census approaches zero. The single important thing that happened here was that the government was given an immaterial deadline to declare its intentions. If it doesn’t, the only thing happens is that a bunch of lefties get to masturbate to fantasies of Trump getting a comeuppance when the case Hazel is overseeing restarts."

I listened to the oral arguments. Or about half of them. They were boring.

The Supremes don't have any question that they can ask the citizenship question. Even the people that are opposing asking it admit that there is nothing wrong with collecting the information.

The argument, from the opposers, is that asking the question will make the census less accurate. Dept of Commerce says no, it won't affect accuracy.

We've asked it on a bunch of previous censuses, it seems a perfectly legitimate question.

And, according to both sides and, it would seem the Supremes, is a perfectly legitimate question.

Except as it affects census count accuracy.

The Constitution spells out the political basis for the government of this nation, and the census clause was put in there to provide data for the political guidance of Congress and the President in setting suitable policies to ensure successful outcomes.

Since Roberts punted, not forbidding but sending it back down the chain, obviously there is some validity to Trump's claim.

So print the questionnaire WITH the question and you can instruct the Census takers on whether to ASK the question or not.
