Impeaching Justice Kavanaugh? Senator Whitehouse says, "The hourglass is running on Brett Kavanaugh...."

I video'd this clip from "Morning Joe" just now. It's Whitehouse, prompted to talk about continuing the investigation after the confirmation and working on impeaching and removing the future Justice Kavanaugh:



He's ready to go and endeavoring to sound ominous, even as he looks weary.

We've heard a lot lately about witch hunts. Whitehouse — with his hourglass running on Brett Kavanaugh — reminded me of pop culture's most famous witch, scaring us with her hourglass:



ADDED: There's such an effort to create anxiety in the populace, but they themselves are anxious about the election. Note that Whitehouse resists saying the word "impeachment" as the scowling interviewer foists it on him. The interviewer is Susan Del Pescio, who is identified on her Wikipedia page as "a political strategist and media and Republican political analyst" (emphasis added).

Under the Constitution, the Senate has the sole power to try an impeachment and the Supreme Court has said that includes the sole power to determine what the proper procedure is.

What is tougher is the number of votes needed. Bare majority ( with Pence as tiebreaker ) to confirm. Strictly speaking, it only takes a bare majority of the House to impeach, but that does not remove them from office, it sends them to a trial in the Senate. It takes a 2/3 majority in the Senate to remove them from office.

Technically, the burden is higher because you need more votes to remove than to confirm, but the only standard is re election calculations.

I didn't watch any of the hearings yesterday, but later I did see a clip of CBF's answers to the questions about her fear of flying. Now I'll say that there is absolutely no way that a truly neutral observer, cruel or otherwise, could find that woman "credible." She fucking giggled about her obvious lie--which was equally obviously made in order to clear time for other lying crapweasels to come out of nowhere with idiotic claims intended to make her accusation seem reasonable.

I complained about this in the 70s, but I think there's still no physics theory of how an hourglass works. (What predicts its speed of flow.)

If you've solved that in the meantime, I also think there's no physics theory of the shapes of wrinkles in a balled-up and then un-balled sheet of paper. (Suppose you wanted to CGI a realistic looking un-balled sheet of paper. What rule would be needed?)

You can try, but it would be purely political. You don't have the evidence to claim, let alone establish, the extraordinary allegations advanced by your team. One out out of three is a bad calculation. And the one with a plausible allegation of an event is inconsistent in who, where, and when, with each recovered memory. The likely explanation is that she has filled in the missing links with contemporaneous knowledge influenced by personal prejudice complemented by external influence and incentives.

The House impeaches with a majority vote, but removal only takes place with a two-thirds vote after a Senate trial. Since impeachment is a political act, either house may use whatever standard they wish, but as you can imagine, two-thirds will be a high hurdle to clear for actual removal. It might be wise to remember: “If you strike the king, you must kill the king.”

Whitehouse may find cronies in the House stupid enough to go along with this, but purely political impeachment will open a Pandora’s box, one which has yet to be opened during our entire history as a republic. Which is not to say that others haven’t tried, but cooler heads have generally prevailed.

1. It looked to me like accuser Christine Ford was taken advantage of by DiFi, the Democrats who wanted to tank Trump's SCOTUS pick, and her politically motivated lawyers. She probably believes what she says, I don't think she is "in on it" rather she is being exploited. She came off as convincing even though there was no corroborating evidence. [not me- Ford sounded nuts]

2. Accuser Ford flew to DC, even though we were told there couldn't be a hearing immediately because Dr. Ford was afraid to fly. We learned she flies frequently and she flies all over the world. Why did her lawyers lie? To buy them time and drag this out so more accusers could come forward and attack Kavanaugh.

Why lie indeed? No answer needed. Accept the left lie to you for the greater good, and move on.

3. DiFi helped Ford find a lawyer. For all the chest beating about how serious Ford's claims are against Kavanaugh that America needs an FBI investigation, remember DiFi sat on the serious accusation for weeks and weeks. Also remember that DiFi had a Chinese spy working for her for more than 20 years and she didn't know it, so she can't really speak credibly about what her staff would or would not leak.

4. Ford's lawyers seemed to lie to her about Grassley's willingness to interview her in California. Ford looked surprised when Grassley informed her the committee offered to send investigators to interview her in California. Of course that wouldn't have been a spectacle, which is what the left wanted.

5. DiFi's staff leaked her identity to the media and that was always going to be the play. The left doesn't operate by the rules. Technically, Kavanaugh is qualified and in theory the SCOTUS process is not supposed to be political just like cabinet appointments aren't supposed to be political. But to the left everything is political, that is why the idiot Republicans give Democrat presidents like Obama the radical nominees he wanted with little push back, while the Democrats fight and obstruct Trump on every nomination. The left was always going to conduct Kavanaugh's confirmation hearing on their turf, the media, and not within the proper process channels.

Samuel Chase was impeached but not convicted. I thought I remembered that. It was 1803 and part of the Federalist-Jefferson battles.

He was impeached on the basis of lower court decisions, not personal conduct.

Apparently he was unrelated to Salmon P Chase, later Chief Justice on the Court,

I am now more optimistic about the mid-terms. The Democrats made a disastrous error in going after Kavanaugh.

Ann, would appreciate the take of a Constitutional scholar on this:

Article 3 says "The judges, both of the supreme and inferior courts, shall hold their offices during good behavior, ..."

A bit different than the high crimes and misdemeanors of the presidential impeachment.

It reads to me like a judge/justice can ONLY be impeached for bad behavior during their term of office, not for bad behavior before becoming a judge.

Is this the case or am I reading it wrong?

The only recent impeachment we've had was Democrat Alcee Hastings (now a Democrat Congressman). His impeachment was for taking bribes while a judge.

Good point about the spectacle. I was surprised she showed up but the lawyers controlled everything.

I have read a bit about the guy that Ed Whelan identified as the real molester. Apparently she dated that guy and protected him. This suggests that he was the guy but she went political in naming Kavanaugh.

The calendars were what torpedoed their ship. The lawyers did not expect that.

There's no Constitutional mechanism for appealing the Senate's conclusion.

I read somewhere that the plan is:

1) RBG retires or leave the court

2) AN hour later President Trump announces the replacement

3) The next day Grassly calls the committee, allows 1 hour for discussion then call a vote.

4) The next day after that, McConnell brings it to the floor for a vote where it passes on party lines.

The defense of this process will be that we must avoid another circus like this.

As the Professor points out, the Senate sets the rules for impeachment trials. So, just as the Democrats changed the filibuster rule when confirming judges, they could change the requirement regarding the number of Senators needed to convict. So a bare majority of Democrat Senators could change the standard to a bare majority to remove from office.

This investigation hasn’t got any better with age. Ford’s allegations are weak but plausible. Ramirez allegations are not first hand memories. She had to ask around to see what happened. After meeting with a Dem Operative Lawyer for a week she’s pretty sure Kavanaugh dick slapped her.

Swetnick’s allegations are off the reservation.

Kavanaugh has been hanging in the wind for two weeks now. Anyone who ever knew the guy has had the chance to come forward.

Three women. And the pimp who was one of his freshman roommates.

Kavanaugh will never be removed based on these people. And no one else can credibly come forward now without video/audio.

The media circus brings forward more witnesses than any FBI investigation could.

Judge Roy Moore was cleared of all claims. A date with an underage girl, that was ended following discovery. The only convictions outstanding are in the minds of Democrat partisans.

K is cleared of all claims when two of three allegations are dismissed as unsubstantiated, and F recalls a memory where who, where, and when change with each successive presentation.

Warlock trials are unconstitutional. Moore and K could only be prosecuted under the Twilight Amendment.

I am now more optimistic about the mid-terms. The Democrats made a disastrous error in going after Kavanaugh.

Trump has been working to nationalize the midterms for a long time. Impeachment talk over Russian Collusion. He had promised a budget showdown (even shutting down the government!) over the wall. He was looking for ANY excuse to make it a national election. A national election hurts those red state democrats (Tester, Manchin, McCaskill, etc).

If those races are about local issues, they retain their seats. If it's nationalized it becomes about Nancy Pelosi, Diane Feinstein, Chuck Schumer, etc. Their tactics played into nationalizing the election for Trump.

I expect Manchin will vote yes on Kavenaugh. It's telling he was in the meeting last night with Collins, Murkowski, and Flake.

After seeing her in action yesterday, my theory is that “Dr. Ford” was once Chrissy the teenage slut. I don’t say this disparagingly, I was always partial to sluts and feel they have an important role to play in adolescence culture. But back in the day, she was probably nicknamed “BJ Blasey” or something similar, and was famous among her peers for her sexual indiscretion. I suspect that in the course of her career as Chrissy, Teen Slut, she probably had a close call or two with rough boys. She probably has a record of emotional instability as an adult and a history of medication for the same. In the wake of the MeToo movement it became convenient for her to re-cast herself as a victim and when Kavanaugh came up as the nominee, she was a perfect foil for Democrat operators. She gets a moment of fame, and a good payday, NO MATTER whether she torpedos Kavanaugh or not. Her phony fragility was good enough for people who wanted to believe (looking at YOU, Althouse). Her use of “Brett” was particularly obscene.

Ford’s shifting versions this summer (they don’t match each other or her therapists notes) combined with her friend Leland saying she doesn’t know Kavanaugh and wasn’t at a small gathering sinks her.

Feinstein knows it. Her colleagues (Blumenthal, Whitehouse, Booker and Durbin) are mostly idiots. But she and Klobuchar are not.

And Ford isn’t brave. She’s actually a bad person for doing this. Put aside Kavanaugh, his wife and daughters didn’t sign up for this. A good person wouldn’t inflict that kind of collateral damage. We didn’t nuke Afghanistan to kill Bin Laden.

Ford seemed to enjoy her day in the sun. And had no problem taking a dig at her friend who wouldn’t back up her story. Kavanaugh is a better person than Ford.

So here we are today; the Democrats have already acknowledged their new standard is the woman is to be believed and the man guilty until they can prove their innocence. To them, the trial was over the moment CBF made the charge. No other proof was necessary to believe her, no exculpatory evidence can possibly be sufficient to show his innocence. So what's the punishment for these crimes, Dems?

And if they don't like those rules; then this is, what we always knew it to be: a sham to delay any confirmation of any Justice and deny the President along with his voters their fair representation. If that's the case, the Republicans still have the majority today and should act accordingly. Democrats can whine all they want.
