Cruz was naturalized by 8 US Code 1401(g) and not eligible. The State Dept. also doubts his eligibility in 7 FAM 1131.6-2(a):a. "It has never been determined definitively by a court whether a person who acquired U.S. citizenship by birth abroad to U.S. citizens is a natural-born citizen within the meaning of Article II of the Constitution and, therefore eligible for the Presidency".

Not only do they say he may not be eligible, they say that determination is judicial, not political. All the argument now public about this issue make it ripe for adjudication.

Filed and served in Ft. Lauderdale (# CACE15022044). Defendants gave until 1/8/16 to respond.

Mick, do you seriously think that a person born to a US citizen is not a citizen themselves? Here's a hypothetical for you to chew over: if a fertilized egg of 2 citizens is carried out of the country and implanted in a foreign surrogate, is it a citizen when born? Come into the 21st century Mick.

While over Mexican airspace, the baby's head exits the birth canal and then is fully delivered on the taxi-way in Houston.

@Jack Wayne & David Begley: What you guys miss is the very real possibility of a dual national becoming POTUS. A POTUS with fealty to two different nations. Cruz is not an example of this, but there's no reason he couldn't be had he not renounced his Canadian citizenship. The US Constitution pertaining to POTUS eligibility does not yet know how to deal with dual citizenship but that day is fast approaching. Or maybe I'm reading you both wrong and you're the types who believe multiple passports and conflicted loyalties are "cool."

Scott Bollig's (sp) charges should be amended to assisted miscarriage and practicing medicine without a license. Any other charges would be sexist. An unwanted child is unwanted, regardless of the sex of the parent.

Trump, on the other hand, has a problem. His only loyalty is to Trump.

We all understand that "American soil" doesn't mean the mother doesn't actually have to be lying on dirt when in labor. She can be on a bed. She might be several floors up in a hospital. What if she were on the International Space Station? Would the baby be American only if the ISS happened to be directly above the USA? Does the "International" part disqualify the baby? What if the birth is on an American spacecraft? or on the moon, right near the American flag they planted up there? How about Puerto Rico? or inside the American embassy in France? or right on real dirt, imported from America and layered on a patch of ground in Cancun?

I used to wonder if women were still second class citizens, but this seems to be proof. Posting a rant online is equal to fingering a German woman according to this genius.

I didn't think so.

So why all the fuss about a Hawaiian birth certificate? What did it prove?

If jus sanguinis is so important to you, what about the case of child born in America to foreign parents? Then the whole question shifts to jus soli.

Why even bother with these nuances when we don't have to do.
