The restaurant tried a lame promotion and got caught. On the other hand, the patron seems like a total asshole.

The customer finishes and asks for another. They ask for $5 again and he points to the sign. Their answer is "Well, thats all you can eat for $5."

Traditionalguy, check out the link on my previous comment. Homer's lawyer said The Frying Dutchman's "all you can eat" claim was the most clear-cut case of fraudulent advertising since the movie "The Neverending Story."

It's not unusual. A friend of mine owns an all you can eat catfish joint and fatties try to break the bank and try to cheat (stuff fish in pockets and purses). But this guy was doing on the cuff which seems even more egregious. I would tier the pricing based on weight.

Small business owners can be bad operators. If I had a regular food customer who woofed down that much grub, no way do I offer "all you can eat" during Friday fish fries.

In the Wisconsin tradition, there is no fish left over when the fish fry ends and the customers are always the same people - so why do you need such a special?

When young, I once went to a restaurant that had the offer.

Their tactic was to bring a small second plate after a 45 minute wait. Nobody ever waited for #3.

We used to stop at a locally owned Ryan's on I-85 near the Alabama border that had buffet style with dozens of meats and a huge desert selection.

That was problematic because staying awake the next 4 hours to Destin was not easy.

Indeed. I think that makes a lawsuit impossible.

Although in general, if you advertise all you can eat you ought to have all you can eat, even if a few people eat a ridiculous amount. You know they have tons of people who come and eat only a little bit so it should balance out if you've priced it right. (so long as people aren't sneaking food to go)

For the non-badgers following this, friday fish frys are a WI tradition bordering on obsession. Many if not most of them are all you can eat. If Chucks Place is surrounded by similar restaurants, it may have little choice but to follow suit. My sympathies are with the restaurant.

OTOH, some of this story doesn't smell right. I don't understand extending credit to a "problem (for years) customer" Or continuing to welcome him into your establishment. Could this possibly be a publicity for the restaurant?

Took a look at Court records & Google Maps. He was evicted in April (as was another person with the same last name) by the owner of the house (who also has the same last name). Place looks like crap - lots of vehicles in the weeds. County issued lien on 4 different parcels for unpaid property taxes. Small claims filed by Yellowbook for advertising his tree service business. WI Dept. Revenue has some things filed against him too - one was $27,000.

Alan Markus, Based on your background check I would say he has signed the Walker recall petition, probably 23 times. Maybe I'll run a Pacer check on him.

A William Wisth has filed several bankruptcies and one civil lawsuit in the Federal Courts Eastern District of Wi. I'm not going to spend much money researching but the court dismissed the civil suit filed by Wisth w/o prejudice agaist his property insurance company. Since there is not a suffix[Jr, Sr, etc.] listed in the court filings, and since it's an uncommon name, very high probability it's this loser in the story.

If I were w/ the Walker campaign, I really would have someone research if Wisth signed the recall petition. Would make for a good tv ad.

Alan Markus, I have been a PI for over 30 years, this guy has more Wi. circuit course cases filed than probably anyone else I have ever investigated..over 150!! And, he's only 54 years old.

Walker operatives..it's worth the time and effort to research this.

I prefer Dilbert's father who never left an all-you-can-eat restaurant because he could always eat more.

Hey, he's standing up for the consumers. Who will not get to eat any fish cause this guy cleaned them out. Some unions use similar strategy.

Everyone go back and watch the video. At the 1:14 mark you'll hear the owner say that Wisth was there with a friend (Jerry) and he was sharing his food with him. In other words, only one person paid (or owed) for the meal, and two people were eating the all you can eat fish. Wisth needs to be battered.

I would say his assholism was further compounded by the TV station who felt that this story warranted the attention given and, beyond this, the assholism was cubed again by Althouse bringing even further attention to it. This is the kind of story that invites copy cat assholes.... I freely admit that in my own small way by thus commenting on this story I also contribute to the surplus of assholism in this world. You have my apology, but I did it to issue this warning: any further comments will perhaps rip the earth's delicate membrane and we will all be swallowed in a vortex of assholism.

Also the restaurant is claiming that he was sharing his fish with a friend rather than just eating them himself. So they likely had two people eating for free plus whatever this guy owed for his tab.
