I agree with Seven. There was no arrest of the punk who posted the "threat" in re the South Park show. A threat that shut down free expression over concerns about security and perceived violence.
Granting of bail is conditional on a judgment that the defendants will appear for trial and they pose no real evidential threat to life or property.
The judge ruled their speech alone, without any other corroborating evidence, poses no threat to human life or destruction of property.
He also imposed strict sanctions.
It remains to be seen if the judge is correct.
It is immaterial whether one agrees with the decision. This is the system we live under.
The judge also had the power to throw the case out if it was determined by the judge there is no probable cause or the government cannot prevail at trial.
Our system is not perfect- no justice system is. But, it is the best in the whole world.
