"DOMA does not address whether a same-sex couple may marry within the United States," the motion says. "Instead, it permits the citizens of each state to decide that question for themselves."

Obama's DOJ defends the Defense of Marriage Act.
On federalism grounds.

I was hoping you could add an "Obama is like Bush" tag.
Obama's assault on gays and lesbian rights is a hate crime.
They should have him arrested.
no hope and no change in DOMA
Obama doesn't want to president of the gay states of America or president of the straight states of America, he wants to be president of the unite........
....oh nevermind.
He just wants to be president of anything.
The next Republican presidential nominee should announce, right now, that he will have Obama arrested and tried for this hate crime if elected President.
I was hoping you could add an "Obama is like Bush" tag.
I'd settle for "Obama is like Clinton."
Why don't the Dems juste repeal DOMA? It's like they don't care about gays and lesbians.
I'd settle for "Obama is like Clinton."
If Democrats cared about gays and lesbians, they would've nominated Hillary.
Weird. It's almost like Obama believes that marriage is between a man and a woman or something.
Hate brief.
That's what they're calling it over at Ameriblog.

These Justice department lawyers should be prosecuted for this hate crime. They're filing hate briefs; and that's a hate crime.
Republicans should promise that, if elected, they'll prosecute these Justice Department lawyers for these hate crimes against gays and lesbians.
It does involve federalism grounds, but the brief is shockingly and gratuitously homophobic. It throws incest, pederasty and the old "gays has equal rights already - they can marry someone of the opposite sex just like anyone else" into the mix.
From what I've read thus far, this brief is way over the line. The DOJ is obligated to argue in favor of federal laws that are in place and the federalism argument is a defensible one, but the gratuitously insulting language was unnecessary and outrageous. This was a major mistake on the part of Obama's DOJ, and if you go to americablog.com, you'll see there's no shortage of liberal condemnation of it. We'll see how this all plays out.
Well I think it's quite obvious that Obama is an anti-gay bigot.
Not surpising. The vast vast majority of Americans are anti-gay bigots, including 90% of Ann's commenters.
