I'm seriously thinking about filing a cert petition. Justice Kavanaugh has written that the "special relationship" given to the Tribes needs to be rethought. I agree; especially with respect to third parties who are not the government and they are dealing with tribe members.
And, of course, SCOTUS is fed up with racial discrimination.
I have some other ideas, but cert is always a long shot.

I'm not sure that this housing proposal is going to actually resolve anything, but Trump's best hope at limiting the damage is to start enacting policies that help people. The problem for him is that even if he gets the policy right, it may take months before good policy translates into outcomes that people notice, and the November election is less than 5 months away. At a certain point, even people who otherwise trust Trump, stop believing his lies. This is his real problem.

Want an affordable house? Come out to the county I live in. Don't like the vacant fixer uppers available? Buy an acre or so (about $5K an acre), buy a modular house and plop it on the land. If you don't want to deal being your own water and sewer company buy a fixer upper in town, demolish it and build anew. Last house fire in the village was because the knob and tube wiring in a wall overheated... I think at present two brothers could come up to a venue and one brother be admitted with privileges which were denied to the other brother because one brother had been adopted by a tribe and the other had not. Yet if it were shown by genetics that a tribe was composed of descendants of European adoptees who had gradually replaced the descendants of the original ancestors, then I think questions might be raised about tribal legal privileges and land ownership and treaty rights. I suppose your case is raising these issues and might clarify some of them. If someone claims treaty rights without a blood relationship to those with the treaty was made is he making a valid claim? Is it racist to grant the claim or to deny it? Or both since many feel that identity is true and false both, at the same time?

"It's like they suddenly can't read." My own institution has been spamming out gigantic emails to "explain" simple things like "get all your receipts in before June 15" in such complex and opaque language that everyone just ignores them. Apparently at the end of May there was a "mandatory" training that only 6 out of 100+ faculty showed up for because everyone just ignored or deleted the email.

That prediction was also made by Trump 45, only he was arguing expanded voting provisions meant that "you'd never have a Republican elected in this country again." That earlier claim was about expanding ballot access whereas the current issue is essentially the mirror image—that restricting registration through the SAVE Act is necessary for Republicans to keep winning.
Trump considers the Save America Act a national emergency because if he doesn't impose this voter suppression act he will lose both houses in the mid-terms. Elsewhere I read Bannon recommending MAGA taking guns to the voting booth.

Anyone believing that a bipartisan housing bill will actually create "affordable housing" is delusional. It will create a bunch of high paying phone baloney government jobs and lots of revenue for consulting firms on how to create the housing, and perhaps even a demonstration house or two.
Want an affordable house? Come out to the county I live in. Don't like the vacant fixer uppers available? Buy an acre or so (about $5K an acre), buy a modular house and plop it on the land. If you don't want to deal being your own water and sewer company buy a fixer upper in town, demolish it and build anew. Last house fire in the village was because the knob and tube wiring in a wall overheated... I ruled out several houses before buying here because when I went into the basement there were fuse boxes and some of the fuses fed knob and tube wiring.

You raise some interesting points, the chief one being, when is a race not a race?
1. North American tribes have consistently refused to allow genetic surveys of the whole tribal assemblage or of any of its parts. They say that they will not allow European scientific methods, i.e., genetics, to define what it means to be a tribal member.
2. THe US entered into treaty relations with different tribes on the basis that these tribes were nations although obviously the tribes did not and could not regard themselves as nations since "nation" was a European concept.
3. Currently tribal membership is usually based on presence on a certain census roll. However, individuals with no relationship to any tribal member can be accepted into the tribe with full tribal rights. This kind of adoption has existed in all the tribes throughout their history as we know it. The Deerfield Raid was, in part, an effort to recruit new tribal members by kidnapping young children and integrating them into the tribe.
Is a tribe in the US at present based on nature or nurture? I think at present two brothers could come up to a venue and one brother be admitted with privileges which were denied to the other brother because one brother had been adopted by a tribe and the other had not. Yet if it were shown by genetics that a tribe was composed of descendants of European adoptees who had gradually replaced the descendants of the original ancestors, then I think questions might be raised about tribal legal privileges and land ownership and treaty rights. I suppose your case is raising these issues and might clarify some of them. If someone claims treaty rights without a blood relationship to those with the treaty was made is he making a valid claim? Is it racist to grant the claim or to deny it? Or both since many feel that identity is true and false both, at the same time?

Right now it feels as if some kind of phase transition is occurring, and I worry that our 'leadership' are once again collectively losing their minds the way they did in 2016-17 and 2020-22. Only this time there doesn't seem to be a specific thing (MeToo, Covid, spazzing over race) that they're losing their minds over, which is perhaps more concerning.
Over the past two weeks I've heard from several former students at different institutions (pretty elite ones) that this past term many professors just seems to stop doing stuff. Email doesn't get answers, professors don't show up for vivas and other events, etc.
My wife came home from work incredibly frustrated because several different managers on different projects believed that reports or emails said the opposite of what they actually said (so one was berating a supplier for failing to delivered 700 parts, but the email had said that the parts HAD been delivered, but there were 800 of them and they had been mislaid in the shipping bay). "It's like they suddenly can't read."
My own institution has been spamming out gigantic emails to "explain" simple things like "get all your receipts in before June 15" in such complex and opaque language that everyone just ignores them. Apparently at the end of May there was a "mandatory" training that only 6 out of 100+ faculty showed up for because everyone just ignored or deleted the email.
Is AI-use pushing our management class over the edge? Is there an arm's race going on in which people use and LLM to effortlessly generate gigantic emails, memos, reports, policies, etc., and then because those texts are so huge, other manager-types use AI to summarize, and then use AI again to reply, and the accumulation of hallucinations plus the fact that no human is actually understanding what's going on is causing the managerial class to collectively crash out?

The best fix for housing in urban areas would be a hard-core Giuliani-type crackdown on crime in the areas where it is most common. Crime and vandalism degrade local environments so significantly that people will be unable--or will refuse—to improve or even repair housing, much less go through the expense of converting empty commercial properties to residential ones.
Just rounding up the 1% of people who are habitual criminals and keeping them locked up somewhere would massively improve the quality of life for the working-class people that the government and NGO class is supposedly so eager to help.

Using memory so check if it sounds wrong: only 13% of the city’s eligible voters were required for Mamdani victory. Most people don’t care don’t even register to vote (as far as they know). Most of those who register rarely vote in local elections or primaries and only show up for presidential elections. That’s the apathy part and why people like Scott Pressler and the late Charlie Kirk were so important to Trump’s win last time, registering new voters is hard but necessary work.

That prediction was also made by Trump 45, only he was arguing expanded voting provisions meant that "you'd never have a Republican elected in this country again." That earlier claim was about expanding ballot access whereas the current issue is essentially the mirror image—that restricting registration through the SAVE Act is necessary for Republicans to keep winning.
Trump considers the Save America Act a national emergency because if he doesn't impose this voter suppression act he will lose both houses in the mid-terms. Elsewhere I read Bannon recommending MAGA taking guns to the voting booth.
We desperately need a Save America From Trump Act.
