Let's look at the complaint in Noelle Dunphy v. Rudolph W. Giuliani.

Filed in yesterday in state court in Manhattan. I'm just going to extract some things that stood out to me, so I encourage you to do your own independent reading. My selections are entirely biased, as is this entire blog, toward what catches my attention: 

Giuliani worked aggressively to hire Ms. Dunphy, offering her what seemed like a once-in-a-lifetime opportunity to work as his Director of Business Development with a salary of $1 million per year.... He made clear that satisfying his sexual demands—which came virtually anytime, anywhere—was an absolute requirement of her employment and of his legal representation. Giuliani began requiring Ms. Dunphy to work at his home and out of hotel room, so that she would be at his beck and call. He drank morning, noon, and night, and was frequently intoxicated, and therefore his behavior was always unpredictable. Giuliani also took Viagra constantly.

While working with Ms. Dunphy, Giuliani would look to Ms. Dunphy, point to his erect penis, and tell her that he could not do any work until “you take care of this.” Thus, Ms. Dunphy worked under the constant threat that Giuliani might demand sex from her at any moment.... In addition to his sexual demands, Giuliani went on alcohol-drenched rants that included sexist, racist, and antisemitic remarks, which made the work environment unbearable. Many of these comments were recorded.... Giuliani gave Ms. Dunphy permission to record her interactions with Giuliani anytime, anywhere, as well as Giuliani’s interactions with others.... 

Giuliani preferred working with Ms. Dunphy in his home (and later from hotels) so that he could easily transition from work, to demanding sexual gratification, and back to work. Thus, Ms. Dunphy worked under the virtually constant threat that Giuliani might initiate sexual contact at any moment. Although Ms. Dunphy never knew when Giuliani might force sexual contact on her, upon information and belief, his actions were premeditated because, in many instances, he had taken Viagra or similar medication beforehand in preparation.

Giuliani often demanded that she work naked, in a bikini, or in short shorts with an American flag on them that he bought for her.... Throughout the employment and attorney-client relationship, Giuliani forced Ms. Dunphy to perform oral sex on him. He often demanded oral sex while he took phone calls on speaker phone from high-profile friends and clients, including then-President Trump. Giuliani told Ms. Dunphy that he enjoyed engaging in this conduct while on the telephone because it made him “feel like Bill Clinton.”...

At certain times, Ms. Dunphy overheard discussions which contained, upon information and belief, privileged or confidential information. These discussions included, for example, strategies as to how to deal with the investigation being conducted by Robert Mueller, and whether it might be possible to distract, intimidate, or otherwise dissuade Mueller from proceeding against Trump....

Giuliani was rarely sober around Ms. Dunphy. Since he regularly drank all day and night, it became part of Ms. Dunphy’s responsibilities to fetch his alcohol and make sure that he was a “functioning alcoholic.”... 
Giuliani began to tell Ms. Dunphy that he loved her. Often, this was while he was coercing her into performing oral sex on him. He sometimes also referred to her as a “best friend” and he often told her that he “needed” her. Due to Ms. Dunphy’s vulnerable state, and the power imbalance between them as boss/employee and lawyer/client, she began to believe him.... 
Giuliani made derogatory comments about Jewish men and implied that their penises were inferior due to “natural selection.”... Giuliani said, “Jews want to go through their freaking Passover all the time, man oh man. Get over the Passover. It was like 3,000 years ago. The red sea parted, big deal. It’s not the first time that happened.”... Giuliani demeaned and sexualized Hillary Clinton and mocked her body.... Giuliani mocked Senator Elizabeth Warren as “in search of a gender,” stating: “Pocahontas was a really hot babe, and Warren does not look like a babe. She looks like a person in search of a gender.” Giuliani later said he was “very hot” for Warren.....

The are 21 claims made, including sexual abuse and rape and sexual discrimination and harassment in the workplace.

I take this as a strategic distraction to defuse the consequences for Jeffrey Epstein's clients. The names of very wealthy and powerful people are coming out. Guiliani is an easy target, per his association with Trump, age-related gullibility, and the dripping hair dye fiasco after Jan 6.

He sounds like a really entitled and unpleasant guy. I would also guess that he was using stimulants (meth or Adderall), because that kind of sexual behavior really fits and would also explain the ability to drink morning, noon, and night and remain conscious and lucid.

However, they keep using the word "forced", and that seems like straight up bullshit. She was told going in precisely what the job entailed, and he was not joking by the sounds of it. She agreed to that "job", and now she would like a payoff bigger than one million per year. Maybe this was prostitution. Maybe it was consensual. It was not forced.

I imagine that the problems for Ms Dunphy are mostly: 1) not being paid for her job; 2) not being able to collect judgment from bankrupt Rudy if she wins.

I tend to believe that they entered into this seamy arrangement, and that Rudy was exploiting her stupidity. A little shocking to prudes like me, but this seems consistent with NY world inhabited by Epstein, Trump, Guiliani and their ilk.

I have been told not to use the word "prostitution" but to say "sex work". Further, that it should have no stigma, that it is just one way for a woman to make a living--and if she decides to, no one has any right to question her. Even further, that anything she agrees to is okay. Sex work often involves acting out the client's fantasies. If this story is true and not just another MeToo hatchet job on a Trump associate - and that's a big "if" - Rudy and this whore simply entered into a business deal. They exchanged value for value - she valued the (supposed) $1M/yr job that Rudy could give her and Rudy valued what was between her legs. It's quite simple. They struck a deal, tacit or otherwise.

I did look at Ms. Dunphy's website, particularly the modeling page, and I have to say Mr. Giuliani struck a very low-priced bargain for a year's worth of unrestricted sex with her, expressed as "satisfying his sexual demands—which came virtually anytime, anywhere—was an absolute requirement". Maybe he should have included a "no regrets" clause, as that seems to be what is happening now.

In the Trump case, prosecutors failed to specify what crime was covered up by making the false record, but in this hypo, it would be prostitution.

The complaint doesn't appear to allege that Giuliani created any business records regarding the title/role. None of the Exhibits (not attached) appear indicative of his creation of such false business records. At least one time, shown in the complaint, he explicitly texted that he cannot create a reference letter attesting to her consulting work.

Also, she is alleging that she did develop business, apart from prostitution.

If everyone has a price, hers was $1 million, but I guess now that E. Jean Carroll got $5 million for simply hinting at a lot less; Dunphy wants more. If the allegations are true, then I have no pity for Giuliani for opening himself to this blackmail. If untrue, I expect Giuliani to find better counsel than Trump. Either way, I have little sympathy for Dunphy, who was obviously willing to put up with this when the money seemed enough to do so. I get that woman shouldn’t be forced to even entertain such offers in order to work, but I also know many men and women are happy to accept such contracts.

So even more explicitly in paragraph 2 it is explained that she found the offer too good to pass up. But we finally see that there is an unexplained claim that though she agreed to deferred payment, she was apparently not paid as expected. The rest seems to be written for the new media and not a court proceeding.

If I understand this correctly a hooker is suing the John for non payment for her ilegal services and expects a court of law to compensate her. In her complaint she admits to committing a state crime and possibly a federal crime ( tax evasion and non disclosure of receiving cash for related transactions). What amazes me is that the court that this 'case' has been assigned to doesn't instantly dismiss the case with prejudice and refer this to the district attorney and recommends to to bar association disbarment of the plaintiff's attorneys. To the attorneys who comment here am I wrong? Inga and the other Trump bashers what say you?

E. Jean Carroll's talking head pals claimed she had kept the dress from this clearly fictional "encounter" and that it had forensic proof, if you know what I mean, on it.

Well, since Carroll clearly copied the Law and Order episode for her hoax she figured why not copy Monica with a fake forensic-evidence-laden dress hoax as well?
