"Many of Fox’s arguments had been crippled in pretrial hearings, and the company was facing the likelihood that some of its top stars, including Tucker Carlson and Sean Hannity..."

"... would be called to testify, along with Rupert and Lachlan Murdoch, the father-and-son pair who run Fox News’ parent company.... ...Rupert Murdoch, who is ninety-two, would have to sit in a witness box and answer questions as dozens of journalists looked on.... At the press conference, Steven Shackelford, another Dominion attorney, told the assembled crowd, 'Money is accountability. And we got that today from Fox.... 'Is there anything else in this settlement besides money?' someone asked from the crowd. Would Fox air an apology? Issue a retraction?"

"The Dominion team walked away from the microphone.... Shackelford... seemed genuinely giddy and did a comic exhalation of breath, bending over and sort of shaking out the sillies. I asked if we would see an on-air apology. Shackelford smiled and snapped back into friendly professionalism—he wasn’t the right person to ask.... At my hotel, I got to the elevator bay at the same time that an entire team of pleased-looking Dominion lawyers did. As they filed in, I introduced myself and wanted to know if they had any answer to my questions about apologies.... They all just smiled as the elevator door closed on my face."

I never understood the drive to blame the voting machines.
That said - there were instances where voters were witness to voting machine problems - like a total switch from R to D. but hey - whatever. You need proof not accusations.
Trump talked about the cheating prior - but did little, prior. Sadly - no one has the power to prove what we all know.
The real issue was the over-night counting in secret, and the ballot box stuffing. (See facebook's ballot boxes in key cities and the mules drops)
I have no doubt that the desperation to keep Trump out of the white house inspired enough cheating to give old basement dweller crook Joe the win.

Arrest me! We are not allowed to say such a thing out loud.

But Hillary and Maddow are allowed to cook up and sell lies about Trump being a Russian Spy.

There was a plaintiff's lawyer in Omaha who was fond of saying, "They wouldn't pay money if they were right." Why get an apology when you've been paid millions?

Yes, giant screw-up by Fox. And Trump really duped Fox into it. The machine rigging falsity was the heart of it. That's mostly on Rudy and Sydney Powell.

One of the main reasons Trump lost was old-fashioned cheating and the $500m that Zuck spent. The mail-in ballots and drop boxes in key states were the thing.

Here in Omaha, suburban women personally loathe Trump. There is very little election cheating in NE.

Like I said, I'm done with Trump. If he's the nominee, I'll vote for him. But he can't get to 270. Too much baggage and too much cheating in swing states like PA, MI and WI.

I suspect that it had more to do with the House, rather than Trump. If the Dems had been on track to gain seats in the House and Senate, like they had expected prior to election night, then Trump would have won, because he would have been neutralized while still serving as a boogieman to drive up Dem fundraising. The panic came when the returns started coming in and people started talking about a possible GOP majority. A Trump reelection with a GOP congress would have been a disaster for the left.

But Dominion, sitting high atop the rest of us mortals, remains the most secure source to run your electronic elections. Forgive me for not buying it. It's pretty easy to hack these things.

Fox could not prove any of the comments that were made on their network. This does not mean Dominion should be trusted to walk your mother across the street, or load up this country with electronic voting machines.

If we were truly interested in voting integrity, we'd eliminate electronic voting machines, which any random 7 year old could tell you are susceptible to infection, or hacking. Eliminate mass ballot mailings- to be used only for oversees or physically impaired. Make elections a week, one week. Not a month. Not extra days after election day. One week running up to election day, and ending ON election night, no later than 8pm locally. Eliminate ballot harvesting. If ever there was an insult to the word 'integrity' this is it. Clean up voter rolls regularly. The full time job of the county election staff should be to make sure registration rolls are accurate and up to date.

If we cannot do this, what's the point of elections? If we refuse to do this- which one party apparently insists on- there's more at play.

The Crisis of Election Security
As the midterms approach, America’s electronic voting systems are more vulnerable than ever. Why isn’t anyone trying to fix them?

By Kim Zetter
Sept. 26, 2018"

Excerpt:
"How did our election system get so vulnerable, and why haven’t officials tried harder to fix it? The answer, ultimately, comes down to politics and money: The voting machines are made by well-connected private companies that wield immense control over their proprietary software, often fighting vigorously in court to prevent anyone from examining it when things go awry. In Ohio in 2004, for example, where John Kerry lost the presidential race following numerous election irregularities, Kerry’s team was denied access to the voting-machine software. “We were told by the court that you were not able to get that algorithm to check it, because it was proprietary information,” Kerry recalled in a recent interview on WNYC’s “Brian Lehrer Show.” He was understandably rueful, arguing how wrong it was that elections are held under “the purview of privately owned machines, where the public doesn’t have the right to know whether the algorithm has been checked or whether they’re hackable or not. And we now know they are hackable.”"

CBS: Why voting machines in the U.S. are easy targets for hackers (Sept. 19, 2018)

“Tens of thousands of voting machines in the United States are vulnerable to hacking. They have been successfully dismantled and attacked by security researchers for years to demonstrate their flaws.

In 2017, at the annual Defcon hackers conference, one tech professor from the University of Copenhagen was able to penetrate an Advanced Voting Solutions machine in about 90 minutes. The attackers were able to access the administrator mode, allowing them to potentially alter voting data.

At this year's conference, a group of hackers was able to crack one in 15 minutes. One hacker told CNET: "Should you be trusting your vote with these? I don't think so." "They're running Windows. They have USB ports. They're actual computers and are very susceptible to attacks," says Cris Thomas, the global strategy lead for IBM's X-Force cybersecurity team.”

The Guardian: Kids at hacking conference show how easily US elections could be sabotaged (Aug. 22, 2018)

“The risk of a hacker casting the validity of an election into question through one of any number of other entry points is huge, and the actual difficulty of such an attack is child’s play. Literally. “The most vulnerable part of election infrastructure is the websites,” explained the security expert Jake Braun…

Unlike a voting machine, Braun explains, websites represent a compelling target because they are, by their nature, connected to the internet 24/7. And, whether they are used for voter registration, online campaigning, or announcing the results at the end of the election, they can be used to sow havoc…Armed with facsimiles of the websites of 13 battleground states and a child-friendly guide to basic hacking techniques, the kids were set loose on critical infrastructure – and proceeded to tear it apart…

“The No 1 thing we found last year wasn’t a hack at all; it was the fact that we opened up the back of the machine, and of course, no surprise, all the parts are made across the world, especially China. This isn’t conjecture; this isn’t my dystopian fantasy world; this is something we know they do

…The fragmentation argument is absolute horseshit because once you’re in the chips, you can hack whole classes of machines, nationwide, from the fucking Kremlin.”… The bad actor just needs to steal enough votes in a few counties in America’s battleground states – just enough to swing a close election…“I’ve only one conclusion,” said Schürmann: “Use paper and do your audits.”

“An 11-year-old boy on Friday was able to hack into a replica of the Florida state election website and change voting results found there in under 10 minutes during the world’s largest yearly hacking convention, DEFCON 26, organizers of the event said.

“These are very accurate replicas of all of the sites,” Sell told the PBS NewsHour on Sunday. “These things should not be easy enough for an 8-year-old kid to hack within 30 minutes; it’s negligent for us as a society.”

Dominion's business model is selling something that does a very important job but cannot be verified to actually function properly (except by themselves, of course). The machines have been questioned in a bipartisan manner. It is not a useful product, and Dominion is not a useful company.

To be quite honest, when your job is to do something this critical to the function of the state, the burden of proof is on Dominion to prove that their systems are foolproof. I understand that is not how libel cases work, but it is the reality of adopting their product in any way that is sane. Alas, we do not live in a sane world.

Bob Boyd म्हणाले...

BBC: Hacking the US mid-terms? It's child's play (Aug. 11, 2018)

“Bianca Lewis, 11, has many hobbies. She likes Barbie, video games, fencing, singing… and hacking the infrastructure behind the world’s most powerful democracy…She’s taking part in a competition organized by R00tz Asylum, a non-profit organization that promotes “hacking for good”

…Its aim is to send out a dire warning: the voting systems that will be used across America for the mid-term vote in November are, in many cases, so insecure a young child can learn to hack them with just a few minute’s coaching.”

Can anyone who suffered a loss of reputation in the Russia collusion stories now sue? Can they sue in Idaho?.....The msm are more subtle in their biases. In Robert Caro's book "The Power Broker", he reported that overpasses on the Long Island Expressway were low so that buses could not navigate them and thus Black people could not travel to Jones Beach. The story has been disputed, but that story is widely repeated. It's one of the foundations of the highways are racist narrative. In another of Caro's books, this one on LBJ, he reports that LBJ won his first election to the Senate by means of massive voter fraud--massive as in several hundred thousand votes. That story is not widely or--for that matter--ever repeated.

You've claimed "cheating in MI..." more times than I can count. I'd really like to meet you, and discuss your claim of "cheating in MI" in detail. Our (then) Republican-majority state senate studied the 2020 election and determined that the election was neither stolen nor fraudulent.

Yes, no, no, and yes. Although what I really wanted was a trial. A trial, in which Tucker, Hannity and Ingraham were all humiliated publicly, under oath. After that, a videotaped apology from multiple Fox hosts and executives. A groveling, tearful apology. I clearly didn't get that, so I'm not as happy as I might be.

Now about the amount of this settlement. You make a very good point, echoed by this next comment:
Blackbeard said...
The settlement, $787 million, is perhaps 20 times the full value of Dominion. How can damages be far more than the value of the company?

It's a fascinating question. There is no earthly way that Fox's defamatory coverage of Dominion could have caused Dominion that amount of economic damages. So then there is the question of punitive and exemplary damages. It could be a lot; but it would be really hard to blackboard a punitive/exemplary damages claim of this amount; if a jury awarded it, the trial court (applying the usual federal court and Delaware court constraints on runaway punitive jury verdicts) might reduce the final judgment amount, or an appellate court might reduce it. (For that matter, an appellate court might review some of the trial court's pretrial rulings on the burden of proof, etc.)
Additionally; there is some case law suggesting that a corporate Defendant's revenue might be considered as an element in a punitive damages award. Fox's annual profits are about $1.2b on revenue of about $14b. The only justification for this settlement would be based largely on a hypothetical question of, "How much is enough to really punish Fox?" This settlement is a bigger number than any comparable products liablity or other personal injury case.
So the only way to understand this settlement is that Dominion got MORE in the settlement than they could have reasonably hoped for in a "best case" trial scenario. It is a stunningly total win for Dominion and a colossal defeat for Fox. This is just how much Fox didn't want a public trial. It is an otherwise-inexplicably huge settlement amount.

Occam's razor dictates 3 things to me in this instance: 1. Joe Biden did not have popular support; however, his media support was overwhelming. 2. Media support for Biden, or rather, media attacks on Trump combined with media cover for Biden, made the election more about voting against Trump than about voting for Biden. 3. Election tampering, from rule changes through election-day problems in Republican-heavy districts up to and including the usual kinds of fraud, led to Biden's narrow victory in the places where it needed to happen, in order for him to win under our system. Oh, heck, let me add a fourth. 4. Ried this elsewhere, didn't seem to take. trying again.
Presume Important Person X at Fox sends an email containing an assertion which is a clear falsehood and likely defamatory to another Important Person at Fox. Second Important Person does not replay. Is that any kind of evidence in court? Not speaking legally, but in court where "legally" frequently goes to die.
Does it imply agreement? Is failure to correct an internal email's assertions the same as approval? Does it mean sufficient recklessness as to cross the standard for libel?
Which is to day, I'm wondering how many emails went one way and resulted in no reaction whatsoever and whether they were counted against Fox.

"In other words, Republicans were outstrategized and outhustled. For years Republicans held a significant advantage in early voting, then Donald Trump told them to vote only on election day, with predictably disastrous results in 2020 and 2022. There’s a word for those who fail to match the competitive innovations of their opponents: Losers."

While everything you wrote is factually true, the broad characterization is inaccurate. Republicans were less willing to cheat using mail-in-ballots. I hope their reluctance will be less in 2024 since cheating is the only way to counteract the Democrats doing so, as the courts have made abundantly clear in the last 3 years. The Republicans will need to also drive their turnout above 100% in the areas of the various states that they firmly control at the local level. When overall turnout reaches 120% in a few years, maybe, just maybe the Democrats agree to come to the table and negotiate an end to ballots with no chain of custody or verification of authenticity.

It's absolutely precious that you guys take this picture literally.

He's our "only hope." Do you people really believe this? Like really? Like Trump is Jesus or Luke Sky Walker or Super Man or something. Like he is literally your savior and hero?

YOU are obviously ignorant of what the word FASCIST means.

As I noted there’s a word for those who fail to emulate the innovations of their opponent: Losers. If Republicans want to win they will match Democrats strategy for strategy and then some, and they will also dump the guy who told them not to vote in 2020 and 2022.

It wasn't the voting machines that facilitated the steal.

It was five swing states stopping the count at the exact, same time, throwing out the watchers and then miraculously having Biden ahead when updating their totals three hours later.

I figure Fox news is Republican Party propaganda, but I'm glad they survived their lawfare lawsuit. If Fox news disappeared, all that would be left is the Democratic Party propaganda at NPR, the NYTimes, etc., and that would be bleak.

There are many jurisdictions where you can reasonably assume you won't get a fair trial, if you are going against the narrative dictated by the Democrats. Delaware is one.

Delaware is Joe Biden’s bought and paid for bailiwick. How else did he become a multimillionaire?

"Dominion dodged a bullet there. I still don't trust them but they are very good at hiding what they do."

Filing a defamation lawsuit is a pretty odd way to keep something "hush hush." Oh my, you guys are so far gone there is no common sense or reason remaining.

Dopey D, if you know the fix is in, like a Delaware or NYC jury or a DC jury, it's pretty safe for Democrats. Recent examples are Scooter Libby and Greg Craig. DC juries.

"They're selling a product that can't be verified. It wouldn't just be hard to verify, or inconvenient to verify: you can't verify it."

The state I live in regularly does random hand counts to verify voting machine results. Just because you say something, doesn't mean it's true.

I've only just started to read through the comments, but the number of people who haven't learned that lesson here is shocking.

Why would they talk to the Times? It's their job description to make this go away.

Goldberg is a consistent idiot. What part of her job does she understand?

Yancy is right. Mail in ballots are the big fraud. Here in Atlanta, so is walking around money. It's practically quaint.

That's good, and all should. Do they?

I know enough about cybersecurity to believe that the Dominion machines are hackable, though probably not deliberately so. And any decent hacker would have the malware erase his tracks as the last step before shutting down. The best way to prove that they can be hacked would be to hack them to give 100% of the votes to Donald Trump. It would be really funny they do it for a Democrat primary.

This is purely a thought experiment since I spent my career developing countermeasures, and I’m not a hacker myself.
