Thank you, Senator Johnson. I to have been wondering about the "Armed Insurrection" coinage. I heard one house manager say, "They were armed....some even with baseball bats". so it made me believe the baseball bat was the worst weapon in the fray.

What I saw happen on January 6 was a riot, though small scale and quite mild compared to many of those from last summer. There are two ideas I can think of off the top of my head that explain all the hyperventilating and calling it an insurrection:
1. Doing so gives Trump's opponents ammunition to go after him politically, i.e.; impeach him.
2. It is viewed as an insurrection by people that consider the Capitol and our Federal Government holy ground that must never be defiled by protest or attacked in any way.
He says the shooting and killing of Ashli Babbitt was justified, I'd like to follow up and ask him to explain, in detail, why.
If it was cricket bats, it might be 1812 all over again.

That this was an insurrection, a coup attempt is The Narrative. Don't go against the produced Narrative, despite what your eyes tell you, what your brain understands. Again, compare the results of the Narrative for both the summer riots and the Capitol riot. Compare damage, compare number of businesses destroyed, blocks of cities decimated, numbers of people murdered or injured, bombs tossed, fires started, etc.
The Capitol assault was a mob led by a handful of most likely hired provocateurs, a 'hey....let's bust into this place' plan. Then once they got in, no one had any plan. They wandered around in circles, some took souvenirs to show they were there. The summer riots were carefully laid out, planned, armed, financed, and encouraged by those who just got done attacking President Trump for over four years.
Nancy wants a 9/11 style commission for the Capitol attack? Have at it. I hope they get to actually ask questions about who funded the Antifa people at the front of the pack. I hope they get to publicly announce how officer Sicknick died, or who killed Ashli Babbitt.
The Democratic Party had already burned the Capitol down in all but physical reality, by defrauding America of an honest election. The enormous amount of fraud cheated our republic of its biggest moment, a presidential election. I was surprised by how mild the crowd's reaction was.

I'm ok with Johnson supporting the Capitol Police even in the shooting of Babbit. I've seen the video and it is really chilling, too see the hand of the person just off camera, with gun raised and pointing at the crowd, then shooting while they are still on the other side.
But, when you depend on the Capitol Police to protect you, you are going to support them.
But let's compare Babbit to Michael Brown or Jacob Blake. Or the guy who was shot in the Wendy's drive through after fighting with police.
These men have become folk heroes and Democratic causes. Their deaths resulted in riots and burned down cities, and politicians rushed to meet their families. The NFL put their names on helmets, and criticizing them and their actions was unacceptable. The officers were hounded and defamed.
So tell me why Ashlii Babbit is just some by product of her own bad choice, and the men are Democrat heroes. And then don't say another thing about it, because Democrats are people who enjoy watching cities burn and lives threatened when it isn't their own body in the path of the mob.

Why? Shooting and killing an unarmed person that was not threatening a persons life? I thought the law required proportional response. Firearm training teaches you that you should not shoot at a person coming through your door or window? Best to warn them to retreat. Also if shoot to kill is good policy, every other law enforcement person in the Capital is derelict in their duty to protect. What about the riots across the nation? Shoot to kill is recommended now? DC rules of engagement FORBID tear gas and pepper spray, but shoot to kill the unarmed is acceptable?
Then we have the St Louis couple that was criminally charged with standing on their private property holding firearms. Not shooting anybody.
We need consistency.
If it was meant to be an insurrection, when the shooter shot Babbitt, people would have shot back. That they didn't is the biggest indication to me that they just got carried away. It's not surprise that people who watched buildings getting broken into all last year were easily moved into breaking into this one. Especially if they view it as our building, not some holy edifice that can't be defiled by their presence.
I did a Google image search to look for (Capitol) protesters with bats. There was one guy breaking a window with one, another who had a flag attached to a bat (making it very awkward to use as a weapon) and at least one other person with what looked like a broomstick. Maybe there are more. I stopped looking when there wasn't the catalog of image after image that I was expecting.
On a side note, the weirdest thing for me was seeing the DeMarini bat. I'm from Louisville and don't care about sports. In my mind, all bats are Louisville Sluggers.

This is why we need a modern uniform Riot Act. here is a fine model, only we would obviously need to update references to his majesty, and death is an excessive penalty for riotous assembly.

Which does not seem to me unreasonable, although I think the necessary precedent for such indemnification ought to be first a correct determination by law enforcement that protesters are engaged in riotous assembly, not a peaceable if noisy assembly (as protected by the first amendment), and second a clear warning and order to disperse to all present, in the well known formula:
Our sovereign Lord the King chargeth and commandeth all persons, being assembled, immediately to disperse themselves, and peaceably to depart to their habitations, or to their lawful business, upon the pains contained in the act made in the first year of King George, for preventing tumults and riotous assemblies. God save the King.
Where is the evidence that the arm that held the gun that shot the unarmed Ashli Babbitt belonged to a “law enforcement officer”? He had cuff links, something neither DC cops or Capitol Police wear. That shot is entirely justified. She's just down the hall from the members of Congress who have been ushered to safety behind a makeshift barricade...which she and her fellow rioters are smashing their way through, along with the locked glass door in front of it. That officer is sworn to protect the lives of the members of Congress and that is what he did. He has every conceivable reason to believe that a mob violently smashing its way through a barricade, heading right towards the congressional delegation, means to do violence to those members. It's so obvious it's insane to have to even debate this. If it was a BLM protestor doing the same in that video I'd say the same exact thing.

I don't think I did, but if I did, hey, at least I am consistent. If there's a reasonable and effective way for law enforcement to suppress the mob without killing them, I am in favour of that option, but if not. Usually, if a riot is anticipated, there's nonlethal measures (e.g. gas, beanbags, etc.) that can be readied. If it is a surprise, then that may not be an option.
But I continue to think the best thing Biden could do to defuse the situation is to crack down hard on both the Capitol rioters and the Antifa/BLM rioters in Minneapolis, Kenosha, etc. Federal jurisdiction may be limited, but even if it's just the scumbags in Portland who were going Fort Sumter on the federal courthouse, that would be good. Some of them were indicted by the US Attorney there, but it's important that those charges not get dropped or watered down with the change in administration. Watch the video. The security officer appears to have panicked and thus prematurely drew his weapon. I guess that is understandable to some extent. But having armed security officers who under pressure will panic is maybe something that can be evaluated at the time of hiring.

But Biden's oft-repeated suggestion that police officers should aim for the legs was not realistic. It works on TV, I guess, but aiming for center of mass is apparently much, much more certain than trying to hit a smaller, more mobile target like a leg.

I see it repeated over and over, but (a) that seems totally at odds with the attitude of the protesters I've seen from inside the Capitol, and (b) smearing feces on stuff seems pretty unique to a particular sort of far left protester (usually on police stations or police cars). So it strikes me as facially implausible, but still possible. Have specifics of this allegation ever come out? E.g. location, etc?

The shooter was wearing a sportcoat and white shirt - some sort of uniform. He appeared to be an elderly Black man. He also appeared to be fiddling with his gun as if he were nervous or had never fired it before.
His actions were very clearly premeditated. He shot into the crowd and killed Ashli Babbitt who was not a threat to him. There were far more threatening people breaking down the door, but he did not aim at them. He seemed to shoot blindly.
If it were a White man shooting a Black woman in that way, that do you think would have happened?

From my experience in an armed unit fighting in armed confrontations this is the one that really alerts me.
His field of fire had people on "his side" in it.
He was firing in the direction of capitol police.
Based on this I personally don't think he was connected at all with the capitol police or any actual unit that was tasked with defending that building.
He may well have been someone's personal security operation outside of police authority.

2. They had already broken the windows and but for some action from the police, they would have soon broken through and then you would have a large mob of very angry people moving down to hall. You could wait to shoot until then, but it would likely be too late because the breach would have already occurred. Further, if the cop waited till then the crowd likely would have attacked him.
3. By shooting when he did, the mob basically stopped in its tracks, eliminating the danger to everyone on the other side of the door including the police and the congress persons.
4. In other words, the shooting was inevitable; the only question was when. The officer made the right call. Further, he was pointing his gun for a long time before he fired. Two armed UNIFORMED officers had just stepped out of the way - they made NO physical effort to stop the group. Why did this one officer feel such incredible fear that he shot.Normally you ask for backup first.He should have been able to see the uniformed officers - who were in no danger, merely standing there calmly. None of his fellow officers were even making strong attempts to block the protesters.Why did this one cop behave in such an extreme manner.

People leaving their weapons in their cars doesn't sound much like an insurrection. But then left wingers aren't trying to understand what happened - only to justify their previous mischaracterization.
When the victim was shot, she is said to have been trying to climb through a window to enter the very same room the shooter was in and was protecting.
However, the footage shows something different. It shows the shooter in that room holding a gun with his arm extended straight out through an open widow and pointed in a straight line, parallel to the floor, with his target across from him. Thus the victim must have been across from the shooter when she was shot and was not trying to climb through a window to enter the same room where the shooter was located.

Was the shooting of Ashli Babbitt justified? I do not know. If it has been found to be justified, where is the report? Why do I have to speculate? What was the cause of Officer Sicknick's death? Althouse is a moderate only in the sense she doesn't hate everyone who disagrees with her. By her own assertion the only non-liberal position she holds is being unwilling to bankrupt the country. Ironically this was a non-ideological position until roughly the day before yesterday. What sets her apart from others who claim to be liberal is dealing with reality rather than inventing a fantasy world to justify her policy preferences as left wingers do.
