"In late December, Ms. Ponsetto was caught on video tackling Keyon Harrold Jr., the 14-year-old son of a prominent jazz musician, in the lobby of a boutique hotel in SoHo."

"She had falsely accused him of stealing her cellphone, and can be heard yelling, 'No, I’m not letting him walk away with my phone!' The video, which garnered widespread consternation on social media, was yet another example of Black people in America being confronted with baseless accusations while simply going about their lives. It drew comparisons to an incident in May, in which a white woman called 911 to falsely claim that a Black bird-watcher in Central Park had threatened her life. (Ms. Ponsetto, her lawyer said, is of Puerto Rican and Vietnamese descent.)"

This story would have "garnered" so much more attention — and, of course, "consternation" — if only Ms. Ponsetto had been white. The Times calls it "another example," but it's not really in the category for which examples are being... garnered. Ponsetto is, her lawyer says, of Puerto Rican and Vietnamese descent, and she's not even charged with a hate crime — because, according to the police, "she didn't say anything about that."

Why is the charge robbery and not assault? Is there evidence that she knew the phone was not hers?

As for that interview with Gayle King, Ponsetto's lawyer says, "She went off script,. She decided to disregard my advice and just go on her own... She was prepared and guided. She apologized, but not in the way she should have. But she said so many other things that it almost blurred her message. It was so disrespectful." The lawyer called her client disrespectful? Am I reading that right?

In the TV interview, Ponsetto wears a cap that reads "Daddy" and says "I consider myself super sweet." The high point of the interview comes at 4:46 when Ponsetto lifts her hand, palm out, toward Gayle King and says "All right, Gayle. Enough." Now, that's not a crime, but it does show a young woman with unusual instincts, instincts also on view in the hotel video (which you can also see in the embedded clip).

How does a 22-year-old woman acquire that orientation in the world? I'll hypothesize that it has something to do with the self-image "super sweet."

What if the kid she tackled had been some 14 year old ginger doofus son of a milkman like I was at that age?

So many questions. So much entitlement. Such a peculiar time we live in.

“ How does a 22-year-old woman acquire that orientation in the world?”

Belief in a world view that essentially says that the only things that exist are in the physical realm - things you can see with your eyes and touch with your hands - and that life is one big struggle against other people - eat or be eaten. People trapped in that worldview tend to divide roughly into two groups: the fighters and the flight-ers. She appears to be a fighter.

I’ve often in my life felt the same way, acting differently in a particular moment than, in a more calm or reflective moment I wish I hadn’t. The only way forward in that world for me was to get out of - to give up - the struggle for survivor and self esteem. The hat required me to believe more deeply that the universe was from its foundation, structured in my favor.

These very rare incidents are repeatedly re-published and glorified in the fakenews to give the false impressions that blacks are above suspicion and that they are also victimized by people of other races.

In reality blacks commit most violent crimes in the US and most of their victims are also black.

“False accusation” aka “bearing false witness”
It was simply an accusation.
It’s my understanding that she really did believe the young man had stolen her phone.
Accusing someone of something that it turns out they didn’t do happens all the time, and there’s usually a process for making a determination as to the accuracy of the charge.
In this case it would have taken about 30 seconds for the young man to prove it was his phone, but that would’ve been nearly as entertaining. It’s true that he was under no obligation to do so, however in a civilized society we are occasionally called upon to make simple concessions and go on with our lives.

It was a false accusation because he didn’t take her phone. Most phones look like most phones. Did she have reason to think he stole hers? From a quick read of the story, it doesn’t even sound like she had reason to believe her phone was stolen, let alone that he was the culprit.

Because America is very good as mass production and what we're currently producing in vast quantities is a lot of narcissists who are at best mediocre thinkers.

I did not click on the NYT link, but hopefully the pointed out what I've seen in a couple of other reports; an Uber driver showed up with her phone a few minutes after this occurred. Apparently she had left it in the back of his car. God forbid that that thought might have crossed her mind or that she might have taken the care to make sure she had her phone before she got out of the Uber.

"In reality blacks commit most violent crimes in the US and most of their victims are also black."

This is true but also misses a massive issue.

So let's say you are white or Asian. Who is most likely to kill you? Well ignoring big wars, like World War II, the most dangerous group is going to be your family. And that's true for everyone.

Ok. So ignoring wars and your family, who is most likely to kill you?

Well, if you are white, it's a black person. And if you are Chinese, it's a black person. It's not like black violence is only directed at black people. To the contrary, for other groups, black violence is a major, major problem.

And this was empirically demonstrated on YouTube a while back. There was a time when people could freely post videos of people assaulting other people. And what did that random sample reveal?

What it reveals is a remarkable correlation with race.

So what do we do with that reality? Is it racist to know that this happens? Apparently it is.

And it is in this sense that this video we are seeing here today is a lie. It's a massive lie. And it's not that this thing didn't happen.

But the same process that is selecting out this for you to view is at the same time preventing you from knowing about thousands upon thousands of violent acts being committed by people that might have been just as entertaining or interesting and that we would have had an equal chance of seeing, if the media wasn't so profoundly and almost impossibly racist.

“They” as non-gender specific third-person singular is like the spilt infinitive. It is standard English. It’s been standard English for centuries, but for a brief period in the 20th century when linguistic busybodies tried to convince everyone it isn’t.

Statistically, a black guy is 15 to 20 more likely to kill a white guy than vice-versa; a black is 270 times more likely to assault an Asian than be assaulted by an Asian. This was simple assault, misdemeanor. No weapon, just wrestling Keyon Harrold, Jr. to the ground. Why did the NYC send out two officers instead just sending the warrant to the LAPD and having them execute it. They could have even talked to Ms. Ponsetto's Lawyer and arrange her surrender. Sending out the cops is more dramatic and shows that the NYPD is on the job and is super woke. Now they have to extradite her to NYC for a misdemeanor, while gangs of teenagers are assaulting random drivers. My experiences growing up in California and being around many Hispanics, Asians(mostly Japanese and Chinese) and Blacks in school, work, in the cities...is that...in general, Hispanics etc resent Blacks and do not like them.

It may be because they see Blacks as getting and taking advantage of their "special" status as being Blacks/slavery etc etc etc....while they (Hispanics, Asians) are on the receiving end of prejudice, without all getting the "white guilt" perks.

Resentment over the unequal treatment..PLUS also being on the receiving end of the criminal elements in the black community without any justice from the 'establishment'

Re that birdwatcher story: I'm sure there's more to that story than has been reported, even though the lady lost her job and reputation already and it's out of the news. NYC birdwatchers are an often ornery crew. They tend to hate dogs and children, for example, which is inconvenient since the best bird-watching spots in the city are usually found in places favored also by dogs and their owners and people with their children (parks and nature preserves). I've had some unpleasantness with birdwatchers, including minority birdwatchers, over noise emanating from my children running and playing along paths. The guy in the story with the crazy lady dog owner said in his own FB post that he carries dog treats and entices unleashed dogs with them to teach dog owners a lesson about leashing their dogs. I see the logic, and rules say you're supposed to leash your dog in most parks, but in most parks there's also a gentleman's agreement that before, say, 9am dogs get the run of parks. That also happens to be prime bird-watching time for certain birds at certain times of year, so this conflict is as inevitable as it is ridiculous.

Why are they going to such lengths to punish and persecute this poor woman of color for what was a momentary lapse of judgment......There's a lot of privilege on display. The poor and oppressed of the world do not stay at boutique Soho hotels. Money is the sincerest form of privilege, but, if you're a wealthy person of color, you get to not just flaunt it like Marie Antoinette but also to feel as downtrodden as Madame LaFarge. The best of both worlds. A way of eating cake that burns more calories than it consumes....Sadly, this privilege of oppression only extends to being oppressed by white people. The Bonfire of the Vanities in 2020 no longer even requires somebody pretending to be among the downtrodden.

I notice that she feels it excuses any bad behavior to say her phone was lost. As if she suddenly found herself alone in a gray, featureless space with phantoms drifting by. Then suddenly, THERE IS HER PHONE. Of course, she grabs for it. That's one thing. But it's not working as an excuse for what happened. I can't believe a 22-year-old woman is so lost that, even in the dread moments when she has no phone, she thinks she can just grab passing strangers and make accusations. And, later, she should have been covered with shame and gasping out apologies. Instead, underneath, she still thought she was right because she thought that anyone might have thought that that passing boy had stolen the phone because he was black. And I think Gayle King exploited her lack of self-awareness and brought out her attitudes very clearly, and was able to do so because Gayle King was aware while, again, and for the same reason, this fool wasn't able to see who she was looking at.

Hard to see how the lawyer here didn’t breach his duties of confidentiality and loyalty — except in the unlikely event that the client authorized the statement. Of course I was surprised that more people didn’t think it was wrong for Michael Cohen to secretly tape conversations with a client and reveal the contents (I know, “Orange man bad” excuses all sins”. Maybe rules for lawyers are just different in NYC.

This story is all about the narrative. If the story was headlined "Crazy woman tackles much larger teenager," we wouldn't have to be bothered by it.

I noticed Gayle King constantly referred to the teenager who is larger than Ponsetto as "little" and "boy." Once again, the demand for racism exceeds the supply. When will the media start to refer to her as a white-Puerto Rican?

And, yes, if she had tackled some white kid, no one would give a shit, especially not Gayle King.

No, I think Gayle King would have been lionizing her as a hero in that case.

I guess I just don't understand why this is a national story. Geez.

loudogblog said...

I think an important part about this story involves some people's relationships with their smart phones. Smart phones are expensive and, for many, they are highly addictive. Imagine if a drug addict had misplaced 4 or 5 hundred dollars of their drug and mistakenly thought that a teenaged kid had taken it and was walking out the door. I think we would have seen a similar reaction.

A White Hispanic, per chance White Asian. The ambiguous privilege. It was so much easier when it was Jew privilege and everyone would obediently kneel under threats of abortion/cancellation or penalty of social progress. Diversity breeds adversity.

“ How does a 22-year-old woman acquire that orientation in the world?”

Diversity [dogma] (i.e. color judgment) that denies individual dignity, individual conscience, intrinsic value, normalizes color blocs, color quotas, and affirmative discrimination progresses bigotry.

affirmative discrimination progresses bigotry.

Political congruence (e.g. set asides) only exacerbates the corruption.

She didn't "falsely" accuse him. She (apparently) legitimately thought he took her phone. Falsely would mean she knew he didn't take it but accused him anyway. She was wrong. So she wrongly accused him.

Remember back when we didn't have to hear about the poor, poor blacks every single day? And weren't expected to be collectively outrageously outraged about whatever unfortunate thing happened to one of them that particular day? 328 million people in this country and I'm supposed to get all verklempt over these few? Fuck off.

Shit happens to innocent people every day for a million different reasons. F'ng deal with it and stop all this navel-gazing nonsense.

Re: gspencer:

Remove from crime stats the crimes committed by the notorious "youths" found in the 13% and America looks as safe as Europe ever was in its pre-Muslim days.

Pretty sure this is inaccurate. In 2018, there were approximately 15,500 homicides in the US, for a per capita rate of 5 per 100,000. The
FBI statistics for 2018 don't capture the full 15k, but within their sample of 6,570 single victim/offender homicides, 3,011 were perpetrated by Whites (923 by Hispanics of various races). Let's assume -- inaccurately but for purposes of illustration -- that all 923 Hispanics were categorised as White, i.e. 2,088 of 6,570 homicides or 32% were committed by Whites. Extrapolate that across all homicides and you'd get a rate of 5 x 32% = 1.6 / 100,000. That's an underestimate of the Whites-only US homicide rate, but it's still higher than the total murder rate of current "diverse" European populations, e.g. France (1.2), the UK (1.2), Germany (0.95), Austria (0.97), Spain (0.62), Portugal (0.79), or Sweden (1.08). Slightly lower than Belgium (1.7), though.

On the flip side, if we tried to back out just Black perpetrated homicides, we get 3,177 out of 6,570, or 48%. So rather than 5 per 100k, we'd have 5 x 52% = 2.6 / 100k, putting us substantially higher than Western Europe.

Anyhow, high US violent crime rates are not solely a function of Black crime. Our Whites are more violent than the Western European norm too.

Mistake of fact vitiates the affirmative defense of Recapture of Chattels:

If a person mistakenly believes that his property has been stolen, he cannot claim this defense based on a mistake of the facts.

Reasonable force may be used to recapture a chattel (e.g., personal property), but only when an individual is in “hot pursuit” of someone who has wrongfully obtained possession of the property, such as by theft. If the other individual received the item lawfully, however, then one can only use peaceful means to recover the chattel and will not be allowed to use this defense.

Perhaps, unlike many commenters, the young woman could not afford to let a thief walk away with her phone. Many here would simply buy another phone within the hour. Others here would defiantly tackle a perceived thief in order to reclaim their property.

The woman's only problem was mistaking the kid for a thief.

Balfegor,

That is a misleading characterization of the situation, at least when you're comparing to the UK.

Instead, the situation is that the US is more homicidal than Britain, but the latter has a far higher rate of assault. Furthermore, up until very recently, the US homicide rate was higher than the UK's, but it was falling, whereas the UK's assault rate was higher than the US and steadily rising.
