"The Supreme Court on Friday rejected an audacious lawsuit by Texas that had asked the court to throw out the presidential election results in four battleground states..."

"The court, in a brief unsigned order, said Texas lacked standing to pursue the case, saying it 'has not demonstrated a judicially cognizable interest in the manner in which another state conducts its elections.' The move, coupled with a one-sentence order on Tuesday turning away a similar request from Pennsylvania Republicans, signaled that the court has refused to be drawn into President Trump’s losing campaign to overturn the results of the election last month. There will continue to be scattered litigation brush fires around the nation from Mr. Trump’s allies, but as a practical matter the Supreme Court’s action puts an end to any prospect that Mr. Trump will win in court what he lost at the polls."

ADDED: Here is the order in full:
TEXAS V. PENNSYLVANIA, ET AL.
The State of Texas’s motion for leave to file a bill of complaint is denied for lack of standing under Article III of the Constitution. Texas has not demonstrated a judicially cognizable interest in the manner in which another State conducts its elections. All other pending motions are dismissed as moot.
Statement of Justice Alito, with whom Justice Thomas joins: In my view, we do not have discretion to deny the filing of a bill of complaint in a case that falls within our original jurisdiction. See Arizona v. California, 589 U. S. ___ (Feb. 24, 2020) (Thomas, J., dissenting). I would therefore grant the motion to file the bill of complaint but would not grant other relief, and I express no view on any other issue.

They left knew which precincts to target, and they did so. Also, the media will not report any curious behavior. Not a single witness was given an opportunity on a mainstream D-Party source. That is also by design. The media erected a wall to protect everyone from knowing the truth. Labels and censorship - all coordinated. Just like their non-stop anti Trump day in and day out Russia Russia BS.

None of the Court members decided whether any of the four states violated the Electors Clause.

7 positively said Texas et al don’t have standing to bring these claims.

Thomas and Alito said they would grant the motion to file the complaint but would not grant the relief asked in the complaint (blocking state certifications of their electoral votes, declaring that these states violated the Electors Clause, etc) even if Texas had standing. They also said they are not giving their view on whether Texas has standing, whether any of the four defendant states violated the Electors Clause, the Equal Protection Clause, or the Due Process Clause.

And since we no longer have a country bounded by law, what happens next? Strongest person wins? All the police quit and then the elected can wonder out loud why crime has skyrocketed? Do folks form vigilante committees since there is no law and order anymore (see Portland, et all)?

The Court did not rule on the quality of the evidence. It ruled on the quality of the legal theory. The election can still be attacked in the States wherein it is being stolen, and the adverse rulings of corrupt Democrat judges can be appealed. The Law has not yet told us in so many words that we suffered no crime, and can expect no remedy. It is necessary to give it every possible opportunity, and to present the best available evidence.

There is no credible evidence of election fraud, just a grifter con man supported by others looking for the main chance. Hopefully the Republicans in GA won't figure it out, return to their senses, and vote until after the runoff.

So should we expect the the three newbies will betray us next like they betrayed Trump? Will the gutless wonders change their votes on the Second Amendment and decide to disarm us because they suddenly discover that we have no standing in light of their cowardice? That “standing” excuse is all Courts need to run away and hide from their duty.

Maybe no one has a cognizable interest. We just have to rely on the state legislatures. Which created this mess.

Gun sales are already through the roof. Why didn't I buy more ammo?

Stephen म्हणाले...

The Supreme Court's decisions in both the Pa. and Texas cases were completely predictable under the applicable legal rules and simple common sense. The rule of law prevailed.

The rule of law also prevailed in the more than 50 Trump court losses. No proof of any fraud, let alone fraud sufficient to swing the election, means that under our legal rules, you lose the lawsuit. You don't get to set aside a democratic election on the basis of BS statistics, stereotypes, or fantasies, or what "everyone knows" but no one can demonstrate. That's the way democratic elections work.

The failure of proof in more than 50 lawsuits is powerful evidence that there is no proof of result changing fraud in any state.

So is the testimony of the officials on your side of the aisle--Barr of Justice, Krebs of Homeland Security, Ducey and Kemp, and so many local election officials, many Trump supporters, who have testified under oath that there was no fraud.

The lawsuits are over. Trump and his supporters will now try to get Congress to throw out the results in these states on the basis of the same evidence that failed in the courts.

That would frustrate both democracy and the rule of law. It will be interesting to see how many Republicans are brave enough not to participate in that attempted coup.

Readering: "There is no credible evidence of election fraud."

This is the sort of crap that gets shoveled not only by dedicated trolls like Readering, but by virtually all of the "mainstream" media and pundits, and serves only to convince me of the pure bad faith of those who repeat it.

There is of course ample credible evidence of election fraud, captured on videotape and in the preposterous reported election returns in various and sundry places.

The sort-of good faith (hah!) position would be--yeah, there are some real and serious problems, and we are all going to work to fix them (and prosecute the perpetrators) so that the scourge of election fraud never again rears it ugly head, but the vast and overwhelming majority of election workers and officials are honest, dedicated and hardworking, the system can never be perfect, blah, blah, blah.

But that isn't what we get. We get--you people are delusional conspiracy theorists, and who could ever believe there's anything amiss, so shut up and take it. I can't tell which is worse--the Baghdad Bob "explanations" or the blanket dismissal.

What I do know is that I have never had less trust or faith in the purported "leadership" of our country than right now.

Vance म्हणाले...

And you, Readering, have been cheering one on for just that long. Let's face it: your side is literally salivating over going full Nazi.

Heck, my local rag was full of Democrats screaming and calling for our local Attorney General to be arrested, charged with treason, and executed for joining Texas and the other 18 states.

Every single one of them is all aboard the "It's treason to disagree with the left!" train. Just like you are.

Michael K म्हणाले...

The Democrats have openly cheated in a national presidential election, and they have gotten away with it. They have created a permanent one party state that will no longer be effectively challenged. As I see it, their absolute victory has made voting pointless and a waste of time. I always thought of Trump's presidency as an anomaly, not to be repeated. Apparently, one term is all the Swamp will allow. They will not underestimate their enemies again.

I agree completely. Trump was a man alone in the corrupt capitol. VDH described him as a "tragic figure." I wonder how long it will take the corrupt economic system with the Obama ZIRP to collapse. The blue cities that think they are immune to hubris will find out where food and energy come from.

The Arabs signed the deals with Israel because we no longer need their oil. Biden, if his handlers allow it, will reverse that.

Looney, Readering? This very thread, Chuck is all about jailing Trump. Oh, but only after a "fair trial" he says! The jury is going to be Pelosi, Schumer, Harris, Beto, and the Cuomos.... it'll totally be fair!

This country has had a long tradition of peaceful transitions of power, until now. Now you and your side are openly planning to arrest Trump, his family, and anyone who worked for Trump (honestly worked for him, not just as a backstabber like Mattis).

What kind of country is it when the losing side is arrested and jailed or executed like your side is doing, Readering? It's sure as heck not America.

I also understand that cheating when casting my vote, or someone else's, is perfectly acceptable. The cheating in Georgia alone was simply awful and pretty much an "in your face" scenario. They had their plan and executed it perfectly, except for the fact that it was on camera. But, with the help of the Ga SOS and Governor, they bluffed their way through that. So, all cheating is now considered fair!

Readering म्हणाले...

YoungHegelian म्हणाले...

We must all understand what sort of a position the vote fraud put the leadership of this country -- either they forced the losers to accept it, or the attempt to extricate the system from the fraud would 1) destroy one of the major political parties 2) piss off the "winning" Democratic voters as much as we the losers are pissed off now & 3) set off a wave of far-left & maybe a good dollop of moderate lefty unrest probably surpassing the 1968 riots. The Democrats went to the precipice & they left the Establishment no way out that wouldn't involve its own destruction.

So, now, to we, the losers, it's the Rubicon & Alia Jacta Est. Who knows how this will go. There's a good chance the majority will go quietly, but also a good chance that a sizable minority won't.

May God have mercy on us all. I suspect we're going to need it.

You skipped a step. First you try to convince the Electors that the election was fraudulent, and have them switch their votes. This is in fact exactly the type of situation they were created to fix.

Calm down, all the Supreme Court said was that Texas did not have standing to challenge another state in "its election".

Do you know who still has standing to challenge each of the 4 corrupt states in "its election"?

If you could not understand that question in a moment, no, you don't.

The election theft will almost certainly not be overturned unless lots of individuals in the suspicious swing states are indicted with probable cause for fraud. And that sort of thing does not happen quickly. Alito and Thomas were willing to overturn the election theft without that, but the other 3 normals on the Supreme Court have not yet shown a similar willingness. And of course, the 4 liberal failures: 2 appointed by Obama (the two boring childless single old women who support late term abortion), the loser appointed by Bush (the compromised Roberts) and the way long past his prime Breyer ---- none of them have yet given any thought to doing the right thing.

boatbuilder म्हणाले...

Gahrie--You are correct. And this seems to be precisely what the Supreme Court said today is the only remedy.

And the people who cheer this decision will scream bloody murder, of course.

Rt41Rebel म्हणाले...

We understand it Young Hegelian, that's what the riots all summer long were really about. They were groundwork for the steal, they were designed to let the courts and legislators know what the consequences would be if they lost the election. So the courts and legislators basically had to choose between certain riots and unknown riots, instead of what was constitutional and legal. They choose unknown riots.

YoungHegelian म्हणाले...

@SC,

The election theft will almost certainly not be overturned unless lots of individuals in the suspicious swing states are indicted with probable cause for fraud. And that sort of thing does not happen quickly.

And when does it happen, SC? Two years into a Biden administration? And then what? Impeach Biden, and then impeach Harris, since they're both invalidly elected? And then down the list until we get some Republican Senatorial dweeb that we settle for?

That's the point, SC --- there's no way to resolve this post-Inauguration to anyone's satisfaction. You have a group of 79 million people at least who see their concerns blown off. Maybe they're delusional, but in a democracy you do not call the concerns of 79 million citizens out of a population of 320 million "delusional" and just move on. They also see themselves as electorally trapped, that their opponents have figured out a clever way to game the system to always win, and they have no recourse.

Unless Biden & the Democrats come up with not just an olive branch, but a whole fucking olive orchard of a program to investigate the Trump voter concerns, this is going to get really ugly.

Gahrie म्हणाले...

Should an American Pinochet (hopefully) rise to stop this election theft, there is no longer any reason not to fully support him. Every institution has been infiltrated utterly with enemies of the people.

If there is political violence over this election, I hope it is a large scale popular uprising across large parts of the country. It is our only chance to have a restorative insurrection, rather than a destructive one.

The American people warned Washington with the Tea Party movement, and were ignored and mocked. Then we elected Trump in response, to try and fix things. I think the Left is badly underestimating just how pissed off the American people are. If they were, they'd be going quietly. Right now, not only are they spiking the football, they are asking us to eat a shit sandwich with a smile on our face as they do it.

I'm scared. Overthrowing a government is a big thing, and not to be taken lightly. It rarely goes well, and we already got lucky once.

YoungHegelian ---- Every major media outlet has gone full swamp. Youtube bans people who support the lawsuit filed by the sovereign government of Texas. The Orwellian nature of this drama is intense.

This is not just about Trump, this is about the tens of millions of people whose votes were stolen, and about a country's attempt to avoid an Orwellian future.

Trust me, the drama of this election is not going to end because Texas is told by 7 mediocrities that it does not have standing. There is still time for those with standing to assert their rights. While I recognize that Alito and Thomas are the best, by far, of the 9 Supreme Court justices, and while I agree with their dissent, the fact remains that all of the other 7 will accept a suit filed by someone with standing. Be patient.

I predict Biden will be inaugurated if there are not multiple arrests and indictments of individuals for election fraud before the day the poor old sufferer from dementia is inaugurated. That will be a tragedy, but no greater of a tragedy than the day the abortion-loving Obama, with that phony smile, with his long history of Jew-hater friends and his longer history of election fraud, was inaugurated. I would like to be wrong, but that is my prediction. I cannot predict how quickly individual criminality will be discovered. I am hopeful. But remember, there is not a lot of talent among the people whose job is to prosecute election fraud. None of them are paid much compared to what they would get if they worked at real law firms, the law firms which are currently working to protect those who stole votes.

"If Biden is elected, and if fraud that stole an election is proven, to his satisfaction, beyond a reasonable doubt, he will certainly do the honest thing and resign" (sarcasm off).

Gahrie म्हणाले...

Another step would be for the legislatures of the disputed states to appoint their own slate of electors and send them to Washington either instead of, or with the ones generated by the current results. This would bring up an 1876 situation, and I would settle for a Biden presidency in return for true election reform.

- all voting done in person. No absent or mail in ballots except for military and diplomats serving overseas

- voting rolls purged every twenty years, everyone has to reregister

- show approved photo id before voting

- finger dipped in indelible ink after voting

- paper ballots, bubble in type (like every uses in school)

- ballots counted in public, with media and witnesses present

Everyone here is either absolutely 100% certain it was stolen, or pretending that there is "no credible evidence".

Anyone who suspected there was fraud has looked at the evidence and found it compelling, many times over.

The rest pretend there is literally zero evidence to look at, and are taunting and mocking the first group in an obvious bid to make them engage in violence. It's trolling on an epic level, deliberately trying to provoke a civil war that they think they will win handily.

And they might have an ace in the hole that will do that. Perhaps everyone that opposes them taking the vaccine will solve their problem. Perhaps everyone that opposes them *not* taking the vaccine will solve their problem. Perhaps they'll just ship us off to gulags.

But either way, they're determined to commit violence and practically forcing us to "fire the first shot" to justify their boots stomping on our heads forever. Unfortunately, aside from a negotiated dissolution of the Union and some massive migrations, I don't see a way out of this besides giving the communists the violence they're trying to provoke.
