Actually, it is. Uber multiplies the fare to bring more drivers out. It was the middle of the night, and lots of people were coming home from parties on Halloween. They had the multiplier up to 9 and the user could not have ok'd the ride without directly seeing and accepting that huge increase. She didn't have to take it, but the reason there was a car for her at that time was because the incentive was put in there to increase the supply.
In NYC, if you want a cab at rush hour in the rain, you just won't get one.
I can think of some reasons why this product wouldn't catch on--discomfort, difficulty getting them off for the wearer, or in consensual sex (so that wearing them means deciding "no sex tonight" sort of like not shaving your legs) and of course while it might prevent rape in certain circumstances it certainly won't in others (like rape by threat, or where the wearer was coaxed to undress and then raped).
But rather than go into blaming of "victim blamers" (or "victim blaming blaming"?) as some critics have decided to do, why not let the free market decide if this is a good idea? If consumers want them, then so be it. No one's being forced to wear these, which is why the "chastity belt" comparison is weak.

I also believe it is not a defense to a contract action, particularly where the other party (Uber, here) did not cause the intoxication and did not even know about it.
A friend of a friend (not me, I swear!) I heard got blackout drunk at a strip club and ran his card all night, only to discover later he had a $21,000 charge (no typo) from the place. My understanding is he wasn't rich, so this wasn't a "hey, I can drop the cost of a new car at a strip club easy" case. He tried to argue later with the club about the charge, but they had security footage of him signing receipts and handing his card repeatedly, and basically being in the VIP room all night, even though he couldn't remember. He ultimately was on the hook for the whole amount.
To top it off, when he told his wife about it, she had a surprise for him as well--she was pregnant.
Good cautionary tale about either not being a drunk dumbass, or at least having a good semi-sober friend there when you are.

But government should not be in the business of shutting down innovators to protect rent seekers, and if anything the cabbies should be trying to meet the challenge by offering what Uber does--maybe an app where you can spot in real time the cabs in your area that are available for hailing, or pickup time guarantees, or upscale experiences for riders willing to pay extra. It's not as though Uber is doing something magical that will necessarily drive the cabbies out of business.
Part of the problem is so many big cities are run by undemocratic kleptocracies, and this is just one of the issues where it manifests itself in a way that the average citizen can see. A political party trying to upend that status quo would be wise to exploit such things.

People as a matter of course do have the right to be stupid such as the woman in question and people to have the right to be stupid in their charitable or "charitable" gifting which has nothing to do with governmental (politically motivated) entitlements.
