"For 123 years, our housing policy has been to house students by their anatomy..."

But the federal government's position says it's sex discrimination in violation of Title IX not to accede to the student's self-identification.
George Fox, a Quaker school southwest of Portland, asked the Department of Education for a religious exemption from Title IX....

“I think the fact that Jayce is choosing to stay at George Fox shows the university community has been supportive of him during his whole experience here,” [said Rob Felton, a university spokesman.] “We may have a difference of opinion on appropriate housing, but all indications are he has been treated well by his peers, professors and our student life staff.”...

“I want other transgender and L.G.B.T.Q. people to see that they can have a place in faith-based education,” [Jaycen] said. “The fact that I’m here is proof of that.”
So, one question is whether Title IX should determine what policy schools can have and another is whether there should be religion-based exemptions.

In college, we had what were referred to as psycho singles. Very nice single rooms to accommodate folks who had issues with their roommates (or whose roommates had issues with them).

Au contraire, it's a descent into inanity.

This reminds me of an incident from years ago. The Department of Education sent BYU a letter stating that Title IX required BYU to have co-ed dorms. Dalin Oaks, then BYU President, sent a telegram in reply: "RE: YOUR LETTER. GO TO HELL. STRONGLY WORDED LETTER TO FOLLOW."

BYU still has separate dorms for male and female students.

Title IX mission creep.

Of course there needs to be a religious exemption, which of course leads to a blurry line what is legitimate religion or religious beliefs.

You can't expect a good Muslim college not to prohibit TG folks from choosing a different dorm can you?

Lyssa म्हणाले...

I went to a public college, and lived in "apartment-style" campus housing - 4 girls or guys, two bedrooms, a shared kitchen/living area and bathroom. Much nicer than the usual dorm-room.

I'm trying to imagine what I would have felt if the university had assigned me to share that bedroom with someone who was biologically male. I have no idea what I would have done. But it sounds like we're going that way.

I am whatever I say I am, whenever I say it. I can define myself however I choose and everyone else must accept my current definition, despite any other objective evidence or basic logic. Anything contrary to this policy is bigotry.

How could this standard possibly have negative consequences?

No.

Religion-based exemptions are discriminatory, but are still better than nothing since everyone should be exempt.

It must be a violation of Title VII not to apply affirmative action to those who identify as minority. Hollywood needs to remake Soul Man

Richard Dolan म्हणाले...

It will turn on how specific the gov'tal interest is defined (eliminating discrimination in education against LGTB or eliminating discrimination in housing on campus), and whether there is a lesser restrictive alternative for achieving whatever part of the gov'tal objective is deemed compelling. The First Amend issue reserved in Hobby Lobby is also presented, but hard to see a court finding merit in that but not the RFRT act claim.

Well - the psycho singles are one way to deal with this. But there aren't those provisions everywhere.

The type of campus housing I had in college was double rooms, no privacy, and a communal bathroom on each floor. I can assure you I would have been out of there like a shot if an anatomical guy had showed up, whether he claimed he was a woman or not.

This is not bigotry - it's a safety issue, just like the use-whichever-bathroom-you-want claimants.

It is now obvious to me that I have been living a lie for a long time. The world has forced an identity upon me for which I am ill suited and I no longer wish to be oppressed in such a manner. For many years, my real self has been suppressed, but now it is time to come clean and publicly acknowledge my true identity.

I realize many people will criticize my decision as selfish behavior. They will say this isn't who I really am. I will be told I need psychiatric attention or that I should locked up. I will probably even be called unAmerican and unpatriotic by some. Those who criticize me may even claim they are only criticizing my actions, not my identity.

I don't care. I can't live this lie any longer. I will resist all future efforts to enforce societal norms upon me. You will accommodate me or you're a bigot.

I have decided to identify myself as Tax Exempt.

I am having trouble following your wording here. Do you mean that the student body will have trouble escaping from George Fox?

Unless they are being held in chains, they can pack their bags and leave at any time.

If you mean that somehow this horrendous TRANNYPHOBIA!!!! (cue the self-rightous outrage) will have some kind of impact against non-tranny students, could you explain how?

Lyssa said she would be uncomfortable with someone who is biologically male being foisted on her as a roommate. I'm with you Lyssa.

It raised another question in my mind. What does "biologically male" mean?

Seems to me that a man who gets his dick and balls chopped off and a simulacrum of a vagina built in its place is still "biologically male"

Or does the removal of one's dick somehow automatically make one biologically female?

I don't see it myself. Am I mistaken?

John Henry

John henry म्हणाले...

Lyssa,

Another thought, how would you feel about a transexual roommate (ostensibly female) who identified as heterosexual?

No threat to you, right? "She" would be going after guys rather than women so you would be safe.

Unless she started going after your boyfriend. And if that happened, dump him. Any guy that would go after a transexual is creepy or gay or both.

It's not just about sexuality or safety (though those are concerns); it's a privacy issue. In my college apartment, discussions were had and actions taken that involved bras and periods and things that just are the sort of things that you don't share with males (outside of an intimate relationship). I would feel uncomfortable sharing them with a gay male friend as well (and probably less uncomfortable with a lesbian). These are things that I'm more comfortable with now that I'm older, and of course, I'm comfortable sharing with my husband, but with a stranger? No.

Actual serious legal-type question: if one is biologically a man but declares oneself a woman prior to one's 18th birthday would one still be legally required to register with Selective Service? If so, why?

There is only one solution: open occupancy. Why discriminate by any arbitrary criteria? That is so 21st century. In one hundred years, the Earth will be warmer, and colder; the beachfronts will be closer, and further; and human-animal equivalency will finally be normalized. Oh, and the toilets will still be blocked with diverse clumps of cells.

I was referring to the corrosive effects of a blinkered, dogma-driven education. My nephew graduated from George Fox, after great expense to his parents. A lovely school that absolutely emanates good vibrations, but he couldn't think critically if his life depended on it. As for employment...

I'm defining myself as cross gender. Meaning, I get to,use the men's room and the women's room. And can be on either the women's sports team or the men's sports team. whichever gives me the better advantage.and I can vary my sex based on how I feel. if I'm on a sinking ship, and its women and children first, then I get first lifeboat.

Also, I plan on going to,Lucille Roberts gym, and they'll have to allow me to work out there since I'll be a woman while I'm there.
I don't plan on changing my sex, since gender is just a social construct, and I feel both genders equally. You should simply accept that I'm a woman even though I look like a man.

Seriously, gays, must you normalize completely un unscientific definitions of gender just to say you are tolerant of difference. Can't you tell your transgendered brothers that they're too crazy to be in the club? Since transgenderism actually makes a mockery of the concept of gayness. If you are gay you like men. But would you like a woman who has a fake penis who defines herself as a man? Then what do you in fact really like? if gender is not biological but a social construct, mthen wouldn't your sexual preference similarly be based on a social construct?

jr565 म्हणाले...

If a transgender woman is running a race and her time beats all other women, is she the fastest woman? Even though s/he would have all the biological advantages of a man since she was born as one? That would almost be like taking steroids. Shouldn't there be an asterisk next to any transgender playing sports?

William म्हणाले...

A transsexual who's bad at the role is comical. See Charley's Aunt. A transsexual who's good at it is kind of disturbing. See Norman Bates' mother......In real life, I have never had the acquaintance of any transsexuals. I would think they're kind of rare. I'm sure many of them are decent people, but it must be something of a challenge to relate to those parts of them that are normal versus those parts that are bizarre.
