"These proceedings improperly threaten an open-ended, freewheeling inquiry into executive branch decision-making on matters of national security..."

"... that implicate ongoing military and diplomatic initiatives. This judicial intrusion into the autonomy of a coequal department cannot be remedied by a later appeal from a contempt conviction."

Wrote Judge Neomi Rao, for the majority, quoted in "Appeals Court Ends Contempt Inquiry Into Deportation Flights/A federal judge’s nearly yearlong effort to investigate whether the Trump administration had violated his order had become a point of contention in the president’s battles with the courts" (NYT):

Here's the opinion, from the District of Columbia court. The judge below was James E. Boasberg.

Boaseberg should be removed.

This 🤡 Boasberg has done the most damage to our justice system than any other outrage since the Jan6 outrage.

Should’ve written “more” not “the most”…

Thank heavens for the appellate courts!

Next month I argue - as the appellant - a super important race discrimination case before the 8th Circuit.

The funny thing is that I've been friends with the trial court judge for for about 40 years and I really like him. We had lots of laughs in KC.

The appeal is strictly business. And the trial court may well be correct. Kind of a close question on Indian law. The only thing bad about this case is that I couldn't cite a law review article by Professor Ann Althouse.

The process is the punishment and will continue as such until the process is changed. Boasberg is only one of many bad actors.

Now throw in a few more 8-1 USSC decisions with KBJ playing the clown. Lawfare will become a huge liability and go away for a generation or two.

I laughed at this Judicial Bullshit:

"Addressing contempt is an integral part of the trial court’s
sacred mystery; it is the key to maintaining the order and safety of the court when applying the law. It is a power so essential for the rule of law that it predates our system of separation of powers and judicial review.

It is because of the utmost respect I have for the trial court and the gift of our system of governance that I believe that mandamus should not be used to question a trial court’s inherent authority to protect its courtroom and the rule of law.

Mandamus, therefore, should only issue on days where it is needed to restore, and not upset, the balance of power in our government. But today is not one of those days."

What an insane Judicial tryanny we live under. Just because Boasberg went too far, doesnt mean they're on our side.

There's a new web site that uses publicly available data to collect and collate the instances when leftist judges set free a violent criminal and he goes on to do harm to some other innocent person. (Which the Left is outraged about, calling it intimidation.)

They need to expand its data collection to show how often judges' rulings are overturned by higher courts. I think this evil jackass Boasberg would be atop the leaderboard.

RCOCEAN II said...

Trump should start pardoning anyone held in contempt of Federal Court.

RCOCEAN II said...

Yeah, Boasberg is overturned a lot. So what? I guess he's "embarrassed" - maybe. We need more powder puff "shaming" to bring outlaw judges into line.

Boasberg should have been in jail years ago.

He is obviously conflicted and personally profits from the NGOs and the illegals he is trying to protect.

Boasberg supports corrupt theft from taxpayers that he personally benefits from.

He belongs in jail for decades.

Where's Trump on appeals so far- something like 97-3?

You are joking right?

There are only 2 decent people on the supreme court right now. Thomas and Alito would get overruled by the other 7 pharisees that believe in judicial branch dominance.

Comey and Roberts both clearly believe they run the country. Kavanaugh and Gorsuch are either cowards or colluding. The 3 "liberal" justices are just more honest than the "conservatives."

Yes. And they were both closely connected with the FISA court abuses that allowed Obama/Biden/Clinton to spy on Trump.

Roberts was personally responsible for allowing Obama to spy on the Trump campaign.

In over 40 states, a bartender can be held liable if a customer gets into an accident because they were intoxicated. At the same time, judges are never held legally accountable if someone they released harms someone else. Judges should be held to at least the same standard as bartenders.

And it is 100% chance that he and Roberts are working together to undermine Trump and the people that elected him.

The only reason Boasberg doesn't ignore the ruling is if Roberts decides he doesn't want to keep covering for him.

This judicial intrusion into the autonomy of a coequal department...

Interesting use of the word "department" there, where I would expect "branch" to be a more commonly known title.

Of course.

Lefties love to use the term “separation of Church and State” which is not in the Constitution. However, they hate the term “separation of powers” which is implicitly in the Constitution.

They are the ones threatening out democracy, but of course project that onto others.

To beat Christians over the head with, anyway. Other religions? Not so much.

The power of federal judges today is a threat to democracy, and like most other such threats, the Democrats support it.

people NEED to REALISE, that under our Living Constitution;
District Judge James E. Boasberg is the FINAL and ULTIMATE say, in ALL facets of our lives. This is what we, as a Nation; elected HIM to do.
Anyone that thinks that Their lives should NOT be fully controlled by this District judge is a TRAITOR to America!
we, as a Nation CHOSE this man to be our leader..

But somehow? Somehow? The democrat "judge" thinks Boasberg was actually in the right. This is why we can NEVER allow the democrat party into power. They only care about power.

Bob B said...

Why do people refer to Boasberg as a judge when he is acting as a king unburdened by the Supreme Court or the Constitution. Luckily, there are two judges that said, “No Kings.”

Skeptical Voter said...

Boasberg repeatedly got way out over his skis here. I think it's long past time for the appellate courts--in the Circuits and at the Supremes to slap down some of these district judges hard--very hard in Boasberg's case. They are interfering with the orderly administration of the executive function, for what appears to be no other reason than political or personal spite.

Mr. T. said...

Oh course it was Boasberg.

Time to freeze these judges bank accounts.

Because Boasberg isn't the King. Boasberg is just a generic corrupt local warlord living of the money he steals from taxes.

Roberts is the one acting like the king. ACB acts like the Queen.

How so? I thought the only remedy is impeachment, which will never happen.

Trump has accelerated the unmasking of judges, legislators, media personalities, deep state power players, governors, academia, fraudsters, and ethnicity hustlers. He's demonstrated the papier mache that is NATO, the UN, NGOs, and Chinese/Russian military might. Now let's all complain about Trump.

Boasberg's corruption makes him a hero to the left. It's kind of their thing.

For some reason I keep thinking about how, in the Old Testament, it was in part the chaotic rule of judges that made Israel ask God for a king. God warned them, too, but they ended up getting it good and hard, eventually.

Boasberg should adopt a modern DC version of Idi Amin's royal title: "His Excellency, President for Life, Field Marshal Al Hadji Doctor Idi Amin Dada, VC, DSO, MC, CBE, Lord of All the Beasts of the Earth and Fishes of the Sea and Conqueror of the British Empire in Africa in General and Uganda in Particular"
Something like "His Excellency, Chief Judge for Life, Field Marshal of the Black Robe, The Honorable Juris Doctor James Emanuel "Jeb" Boasberg, VC (Viceroy of Contempt), DSO (Defender of Sanctuary Orders), MNI (Master of Nationwide Injunctions), CBE (Checker of the Bureaucratic Executive in Washington in General and the Trump Administration in Particular), Lord of All the Bureaucrats of the Swamp and Fishes of the Potomac, Conqueror of the Elected Branches of Government in America in General and Article II in Particular."
