The problem is less that he joked about the death than that he premised the joke on the lie that the assassination was a MAGA person.

There are a number of very important differences between Kimmel's jokes about Kirk and his jokes about Trump.
For one, Kirk was not in power or seeking power. He was basically a teacher, he was a debater, an advocate of free speech and individual rights and a preacher.
For another, Kimmel made jokes about a actual death, a brutal murder, after the fact. His Melania widow joke was days before the attempted shooting.
I also think there is an important difference between an entertainer/comedian making jokes and those who present themselves as people to be taken seriously, like journalists, scholars, influencers or political figures, calling for violent action directly or indirectly. The latter is much more irresponsible.
