Was it "remarkable"? I'd like to think it's totally normal — the part about the grand jury.

I'm reading "Grand Jury Rebuffs Justice Dept. Attempt to Indict 6 Democrats in Congress The rejection was a remarkable rebuke, suggesting that ordinary citizens did not believe that the lawmakers had committed any crimes" (NYT).
Federal prosecutors in Washington sought and failed on Tuesday to secure an indictment against six Democratic lawmakers who posted a video this fall that enraged President Trump by reminding active-duty members of the military and intelligence community that they were obligated to refuse illegal orders, four people familiar with the matter said. It was remarkable that the U.S. attorney’s office in Washington — led by Jeanine Pirro, a longtime ally of Mr. Trump’s — authorized prosecutors to go into a grand jury and ask for an indictment of the six members of Congress, all of whom had served in the military or the nation’s spy agencies. But it was even more remarkable that a group of ordinary citizens sitting on the grand jury in Federal District Court in Washington forcefully rejected Mr. Trump’s bid to label their expression of dissent as a criminal act warranting prosecution.

I agree that it was remarkable (and awful) to seek this indictment. It was an ugly abnormality that needs to be rejected. But what the grand jury did was — or should be — the norm. 

You know what this made me think of? This post from 2010:

Someone in the comments questioned my use of quotation marks around "heroic father," but I absolutely meant to do that. I said the father "behaved instinctively and even if he thought about [it, he did] pretty much all the only thing he could do to avoid a life of terrible pain and shame if the girl had died after he let her fall in.."

The grand jury was like the father. Not remarkable. Normal.

That's quite a connection to make, but yes, that father was not heroic, he was normal. The story was sensationalizing the event.

I don't know enough about the laws around military readiness to know if these people should have been charged, but what they did was gross and at a minimum they should face public sanction. It was shameful, even if not illegal.

I would say, that they may well have violated the law, and the law is almost certainly unconstitutional. The jury may have agreed with me, which would mean that this is "jury nullification".

I am a little surprised that the defendants weren't more eager to have their day in court. Not a lot surprised, but a little.

I don't think the congress critters should have been indicted, but lets be clear about what they were really trying to do. I've been in the army and you get plenty of training on not obeying illegal orders, which mostly amounts to teaching soldiers about the Geneva convention. Don't shoot prisoners, don't shoot people trying to surrender, don't beat on people trying to get info from them, speed prisoners to the rear as quickly as possible where the intelligence guys will glean info and keep them as safe as possible while doing so. Don't shoot civilians, don't steal from civilians, etc. A lot of the training is role playing with some playing an officer using euphemisms like "we don't have time for prisoners, take care of them" and you "refusing" the order by asking for clarification.

What the six congress critters were doing was threatening higher ups in the military and intelligence services. "You cooperate with the bad orange man and when we get back in power we will find a way to punish you for it, including charging you with crimes." And considering what they have inflicted on Trump and members of his prior administration its a credible threat.

It could be "remarkable" was used because Gran Juries usually rubber stamp in these cases as the burden of proof to Govt. is just Probable Cause. A quick search on AI showed that Grand Juries only refused to indict 11 out of 162,000 cases in 2010. That's a very small fraction.

Taking the number for granted, one must assume prosecutors know when and when not to ask for an indictment from a jury made of a particular pool of residents. The Trump DoJ violated this condition- asked for an indictment that had zero chances of being handed down- literally zero chances.

What these Dems did was a sick stunt. My opinion of them and their stunt could not get any lower.
That said - they used careful language to keep them above a threshold. Specifically with the use of the word "If".

Again - battle spaces should be what we can win.

It is unclear why Trump and the DOJ are not in a deep dive (and perhaps they are) into the corruption under Gavin Newsum and Tim Walz. Billions of Tax Payer dollars lost to fraud. Billions and billions.

To which I would respond which president has ignored the constitution, or committed more crimes (including trying to nullify the 2020 election) than Trump? Trump got away with all the shit he pulled because, if anything, the DOJ dragged their feet and let him run out the clock. Having his lackey in Florida in charge of judging the most easily proved (retention of classified documents) case let him get away with it.

And the idea that either of the shooters who targeted Trump were recruited by (shit I don't know who, make something up) is just bullshit. They were just two deluded lone actors who were able to get guns way too easily.

The Trump DOJ went to a DC grand jury to try to indict the six jerks who did the *wink wink* thing about "only trying to tell troops about their legal rights* and the GJ refused to indict. I guess this is a huge slam against the Trump DOJ...oh wait, it's not.

Grand juries almost always indict - there's no defense presented, and the standard is low. But the jury pool in DC is 93% Democrat. DC jurors indicted every single J6 person (and the judges helped the process with obnoxious decisions). There are groups out there encouraging them not to indict (or convict at trial) any Democrat. It's all a scam, yet another abuse of the system designed to keep Republicans from exercising the power they earned at the ballot box.

Don't fall for the okey-doke. This is not about DOJ incompetence. It is about politics. Everyone absolutely knows that if these were six Republicans doing the same thing to a Democrat admin, they would have been indicted. In fact, not a single leftist gloating about it has denied it. It's a pure power move by the left. Hey, if they want to change the rules...

They already tried 4 times to frame Trump - note that Democrat grand juries (and one red state GJ) were happy to comply. The idea that this reflects anything other than pure partisanship is a joke. But I think that if this continues, no one will be laughing when it plays out.

If I thought that attempting to indict the congress critters would help achieve the goal I would have been all for it. Its not a matter of civility, I just don't think it helps achieve the goal.

In addition, I have supported Trump since he announced his bid for the nomination in 2015. Voted for him every time. But that doesn't mean I have to agree with everything he says and does. Sometimes he makes mistakes.

Oh, I don't know... Was the willingness of these 6 members of Congress to get some airman or sailor or soldier to face mutiny charges in order to pat themselves on the back about Trump a rarity on the left? Because the organizers of the Minneapolis protests, including (of course) the teachers who, we are always assured, only ever think of The Children, have been ginning up kids' enthusiasm for placing their own young bodies between ICE agents and illegal immigrants. And giving the kids whistles so they can get those ICE agents properly stressed out.

The left often seems willing to put innocents into harm's potential way in order to create good - that is, terrible - press for their side. I don't find it remarkable at all.

I don't think that Trump or Bondi or Pirro were under any illusions as to the prospects for a successful indictment or prosecution in DC, notwithstanding the rather clear facial violation of a somewhat constitutionally dubious federal statute (especially after the Comey shenanigans). They were fulfilling a political obligation to take action. Had they done nothing a substantial portion of their base would have been very unhappy. And the rejection by the DC jury reinforces the political talking (and selling) point that DC remains a partisan Democrat "swamp," against which Trump is fighting the good fight.

I lived in or around the District of Columbia for 47 years. This was a DC jury and the defendants are leading Democrat politicians. Pardon my cynicism, but it would be amazing to me had the grand jury returned a true bill. Ergo, it’s normal, if not for the reason Althouse thinks.

Note that Senator Kelly may yet find himself in legal jeopardy because he is technically still under the UCMJ.

The biggest takeaway is that an Navy enlisted man, Yeoman Charles Radford, who worked in the White House, was a mole. No, not for the Soviets, but for the Joint Chiefs of Staff. He would routinely make copies of documents from Nixon administration officials and share them with people in the Pentagon. Radford would pilfer documents from Henry Kissinger and Alexander Haig and make copies of them.

Selected to accompany General Haig, Kissinger's deputy, on trips to Vietnam and Cambodia, Radford deployed all his gifts for theft, including raiding the general's briefcase. If that's the case, AG Barbie needs to say so. Chas Martin insisting that she "nuked" the Democrats aside, this is yet another failure from her DOJ, and President Trump really needs to fill the position with someone ready to pick winnable battles.
