"Mr. Combs’s lawyers acknowledged that their client had assaulted women in his life, but they argued those actions did not suit the crimes he was charged with."
"Given the jury’s verdict, they have asserted that testimony about violence should play no role in the judge’s decision. 'The court cannot use acquitted conduct in any way to enhance Mr. Combs’s sentence,' they wrote in a recent filing, saying that referring to that conduct in determining the sentence would raise serious constitutional issues. Prosecutors have argued just the opposite. They asked the judge to consider the full evidence at trial when determining Mr. Combs’s sentence. 'Even with the conviction on just these two charges, there is serious, serious, relevant conduct here that will merit a lengthy period of incarceration,' Maurene Comey, one of the prosecutors, told Judge Subramanian during a bail hearing after the verdict was announced. (Ms. Comey was later fired from the Justice Department without explanation and has sued the Trump administration over her termination.)"

The prosecution wants at least 11 years and 3 months in prison, though the probation officials say the guidelines put the upper limit at 7 years and 3 months. The defense — which says that the crimes he was convicted of involved only consensual sex — is asking for 14 months at the most. He's already been in the detention center for a year.

As one who appreciates a judiciary that follows sentencing guidelines but recognizes the judiciary we have is corrupt to the core with the tacit blessing of a political bar I expect out for blood to be the prevailing guideline.
…like when you were little and knew enough to leave dad alone when he’d had a bad day at work? Sean is in dad’s face afrer dad’s been shit on all year…
I’m for the 7 years. Not sure why admitted acts can’t be used in any way either. Seems like he was acquitted of a specific act, not all of them. Still, I seem to recall he was acquitted of the act that enhanced criminal penalties. Admittedly, I didn’t follow this closely, so I’m pulling a Gadfly.
I find myself never caring about cases like these.
- Celebrities exploit their fame and wealth to do a lot of creepy stuff.
- Prosecutors exploit celebrities to gain fame and to assert their dominance.
If you’re not convicted of it, you shouldn’t be punished for it. Judges and prosecutors shouldn’t have the power to imprison those that they don’t like for additional years.
And by the way, why not let judges order people imprisoned when they’ve been acquitted of all charges?
Five years at least for the horrible music he made.
without explanation = she’s a corrupt Hawaiian hack from a family of corrupt Hawaiian hacks so no explanation needed…
The problem is that judges REALLY want to let celebrities off on all but the gravest charges, unless they are President Trump. But they can't actually do it here without totally imploding the Rats and their Epstein narrative. Which they never advanced at all after the pandemic, by the way.
Doesn't matter much the sentencing amount...
He'll be pardoned by Trump heading out the door in 2028/early 2029, so he does about 3 years at the most, plus time served.
Think ahead, prof.
I assume transactional sex is transactional sex, whoever this guy is.
The woman speculates on getting something and the guy speculates on getting something.
Fraud is another matter, say a broken promise. Nothing on the dresser in the morning.
The only detail of this story relevant to the rest of us is that Comey's nepo-baby fucked up the case and failed to get a conviction on a guy who the jury WATCHED beat a girl senseless over and over. Higher calling or what.
Still waiting for “The Big Chill” halftime show.
Combs, as I recall, was essentially convicted of pimping. He should be treated like any other pimp, and that is pretty leniently. Probably time served.
Wasn't he on video kicking the snot out of his girlfriend?
Change the defendant's name from Puff Daddy to MAGA Daddy and tell us what you think.
he was vote or die's minstrel act, now hes no longer of use,
Comey is now free to defend her father in court, at cut rates.
My recollection is that the alleged nonconsensual acts were state, not federal, crimes and thus were not pursued in this trial, and that Combs has basically admitted to the nonconsensual acts but (for who knows what reason) has not been charged with them, putting them in some weird judicial purgatory. Seems like admitted bad acts can/should be able to form a basis, but not acts on which he was acquitted.
Combs worked extensively with Jay Z, whose career ended up big enough that he got to pick Bad Bunny for the next Superbowl halftime show. I would enhance the sentence on this basis alone.
I don't know what the appropriate sentence is, but as for the arguments, the defense clearly has the better of it--if Comb's sentence were enhanced based on crimes he was found not guilty of, the whole trial becomes a farce. Guilt or innocence meaningless. The jury irrelevant.
I see for other commenters that he wasn't charged with these acts, so he wasn't found not guilty. But since they were not a part of the trial, my criticism of the prosecution's argument stands.
Does make you wonder if Combs legal problems began when David Geffen divorce proceedings began. Geffen married his 50 year younger boy-toy rent-boy, abused him too.
diddy deep doodie
baby oil in the slammer
just don’t drop teh soap
I didn't know his father had been a rival of frank lucas, the drug kingpin that denzel foolishly lionized,
It took me a second or two to realize who “Mr Combs” was. I think they should refer to him as “Mr Diddy”.
It is very common to rope in unproven related conduct at sentencing. This happened in my fraud cases all the time- we convict you of $10000 of credit card fraud, then bring in spreadsheets of another $200K at sentencing. If a rich defendant fights it and SCOTUS says he’s right, a lot of mofos are going to want resentencing. Really would be smart for the govt to compromise with Diddy, to preserve this tool. Unless Trump/Bondi really don’t want to preserve it and are begging not to be thrown in the briar patch. CC/JSM

Ooh ... oooh... how to hold my breath that long! Thanks NYT!
Epstein, Combs and Trump are/were fellow travelers. I’d imagine a presidential pardon is not off the table.
So beating Cassie Ventura in that hotel hallway was "acquitted conduct"?
Transportation charges have been used against celebrities for some time - going back to the early 20th century and were used notably against Charlie Chaplin for political speech and Chuck Berry for being a popular Black singer. I think Trump should pardon him. No one considered charging Hunter Biden for extremely similar behavior.
His main crime is offending the sensibilities of women. Well, one in particular who made bank on it. Justice
they looked the other way because he was an enabler of their voter registration scam
Why is their disagreement among the attorneys as to what the judge can consider in sentencing? Shouldn't this be clear? Can you serve additional jail time because of actions that you were not convicted of?
David Geffen - once you've had black, you never go back. I wonder how the Rubin - this month's zillionaire being arrested for sexual abuse crimes - will fare in court. Or maybe he'll just skip to Israel.
The Don''s pardon for Diddy is already written. Combs will not serve a day in prison.
