He pled guilty.

His lawyer argued to the court that Chansley had a long history of severe mental and psychological problems. That lawyer is the guy who suggested that many of the J6 defendants were "the short bus people."

After he was sentenced, Chansley expressed a desire to appeal, and requested a new lawyer. Then, he gave that up.

Last I heard he was awaiting assignment in the Federal Bureau of Prisons.

The January 6th committee lied. About everything!

There are judge, prosecutors, and politicians who need to be disbarred, and even jailed themselves for what they have done. The committee not only withheld the truth from the American people, but they deliberately lied about all the evidence. We are not supposed to have a justice system such as this in America. And, to make it worse, most BLM rioters were released with no punishments for their actions over the summer of 2020. Political prosecutions are NOT supposed to happen here!

The prosecutors withheld exculpatory evidence from the defense in the Jan 6th cases. And, they knew they were doing it. Defense attorneys should be filing motions to set aside the indictments, any convictions, and any guilty pleas based on deliberate malfeasance by the prosecution. No wonder they panicked at the thought of Tucker Carlson obtaining the video footage of that day.

Every Republican who has refused to denounce the the injustices perpetrated against the January 6 protesters need to be ousted. They all had to have known the truth and they allowed Pelosi & Co. to pretend there was an insurrection. The video shows two capital police escorting the so-called shaman through several areas of the Capital, opening doors for him, talking calmly with him, seeming to be very comfortable with him being there and going where he went. A significant amount was just him and the two policemen - he was not leading a mob looking to overthrow the government.

Was this video available to him at his trial, and if not, shouldn't that be grounds for a successful appeal?

The really funny video was the one that was shown in the committee hearing of Josh Hawley leaving the Capitol, trying to sell the story that he ran away as quickly as he could, all alone. Everyone in the audience in the hearing room laughed at him. The full video shows Capitol police guiding and escorting a group out of the Capitol and Hawley lagging behind, being the very last one to leave. Selective editing to make him look like a fool. That's pretty low.

Apparently, if Buffalo Shaman had had enough money to pay lawyers to look through the 16,000 hours of tape, he could have found that footage himself, since he did have a right to discovery, but the prosecutors didn't offer this evidence to him as potentially exculpatory, and he didn't have the money to pay to have the footage combed through.

That's all prosecutors had to say to force him to find the funds to comb through 16,000 hours of video. Justice is dead in America. The video is not exculpatory in the eyes of people who long before his trial decided that he was guilty, that is true enough. There is far too much Democrat prestige invested in his guilt to allow such a thing as evidence that he was a non violent protester get in the way of railroading him.

The Reichstag Fire was used to strip all protections of the accused, and led to the creation of the Gestapo. Lots of "good Germans" went along with it, too.

My favorite justification by the Democrats so far is that the proof that the protesters killed Officer Sidnick, is that a doctor opined that the stress of his job that day could conceivably have led to a stroke a week later. Not "beyond reasonable doubt" but "possibly." But "beyond reasonable doubt" is another standard that has been flushed by Democrats, along with attorney client privilege ("Oh, that doesn't apply to anything Trump related!") and demands that the press use the word "alleged" for unproven crimes.

They were following him, apparently reluctant to arrest him because they were surrounded by a few thousand maniacs who had already assaulted a bunch of cops in breaking through the police lines. This is the paragraph from Jake Shanley’s plea agreement covering what is shown in this video:

“The defendant then left the Gallery and proceeded down a staircase in an attempt to gain entry to the Senate floor. There, the defendant once again encountered Officer K.R., who again asked him to leave the building. The defendant insisted that others were already on the Senate floor and he was going to join them. Officer K.R. then followed the defendant on to the Senate floor.”

This video does show that after the rioters gained entry, the Capitol Police effectively surrendered the building to them. Tucker Carlson isn’t showing footage of how Jake Chansley got into the building, which Tucker only describes as “disputed to this day.” As I understand it, he is alleged to have climbed scaffolding and pushed past a line of police to gain access.

Neither one is incorrect, per The Grammarly Blog. Fascinating to me that the New Yorker has used both "pleaded" and "pled" in print.

I like "pled" the way that University of Michigan English Professor and linguist Ann Curzan does. Although -- this had special interest to me, being a fan of Justice Scalia's books -- noted Scalia co-author on legal writing Bryan Garner prefers "pleaded." But again, "pled" is not wrong.

What's the no-nonsense view from the internet age lovers of the law and language and usage over at Above the Law? There's actually been a pro-"pled" majority! It's been a subject of dispute, to be sure, but one without a clear correct answer.

And this brings up a legal issue that I would hope our host, with her background and expertise as a law professor, would want to explore. I've read that even the DOJ didn't have access to this video. This video was the property of Congress. Due to separation of powers the DOJ could not force Congress to turn over some videos.

If exculpatory evidence is essentially withheld by Congress in this manner is it a Brady violation? Does the defense have an obligation to detail in the record the amount of effort the DOJ took in obtaining potentially exculpatory video? Does it pass the smell test that they didn't seek video for Chansley's actions at the moments documented in the Tucker videos? If the did seek those videos and they were withheld from Congress, that in itself, should be an exculpatory fact. If DOJ didn't seek the Tucker vidoes, it should be exculpatory as to sentencing at a minimum.

My take is that certainly Congress is beholden to the 14th Amendment as much as the Executive branch. Therefore, this is a Brady violation. While the video may not be exculpatory to the underlying crime, especially since he pled guilty, it would certainly be exculpatory for sentencing. Remember that Brady violations don't have to have an impact on guilt or innocence of the charge, but can also apply to the sentencing. The Brady in Brady v. Maryland didn't get a new trial, but he did get a new sentence. Chansley should at a minimum get a new hearing on his sentence. The argument would be that after the initial crime (entering the Capitol), the escalating factor (being on the floor of the Senate) was not resisted and potentially encouraged by law enforcement.

The machinery and personnel were in place, even if they stood down after 3 November 2020. They were ready when Trump announced he was going to hold a rally on 6 January 2021. The Democrats and Deep Staters realized they could repurpose the event they had planned by reskinning a few of their shock troops, and making sure the pro-Trump groups they 'invited' were still going to participate.

My theory is that they didn't care if Trump won reelection, because they expected to take the Senate outright, and to expand their control of the House. Trump would have spent four years battling investigations with nothing getting done, while Dems fundraised heavily off of it. Hence why they picked Biden as the nominee: he was the least likely to do damage downballot, and his loss wouldn't kill a viable political career like it would someone younger.

Instead, on election night, they watched as Trump had coattails, and were faced with the very real possibility that he'd pull the GOP into a slim majority in the House, while keeping the Senate. That would have been a disaster, and so the decision was made to flood ballots into a few states. It wouldn't surprise me if doing so also shifted a couple Senate races.

I automatically record Tucker Carlson, then keep the last 5 recordings. Until fairly recently, I hadn’t been watching him more than an episode every month ago. Now, I am glad that I do. I watched the whole show last night. Carlson is rapidly turning into the most watched, and most powerful journalist, on the air. It’s not just this, of course, but he has also been at the forefront of vaccine injuries too. Last week, I was reading that a lot of influential people were trying to reach out to Murdoch to get Carlson fired. I think that highly unlikely. Carlson is a ratings goldmine for Fox. Take him off the air, and they face a huge financial penalty, plus a ratings crash. He can pocket the massive penalty, and pull a Joe Rogan, opening up shop elsewhere, while many in Fox’s core audience defect in disgust.

McCarthy was heavily criticized for giving Carlson a preliminary exclusive here. But, in retrospect, I think that it was a shrewd move. I expect that ultimately, the entire cache of videos will be released, and crowd sourced. And at that point, those screaming cherry picking on the part of Carlson should, if they had any morals, eat crow, because it will just look worse. But by doing this this way, McCarthy has guaranteed the biggest possible audience for the video destruction of the 1/6 narrative.

Social media users attributed Brian Sicknick's death to being hit with a fire extinguisher. So did the New York Times, citing two law enforcement officers. The Capitol Police did say that Officer Sicknick “passed away due to injuries sustained while on duty,” but they didn't specify what injuries he had sustained.

Doctors said Sicknick did not die from blunt force trauma, and while Sicknick had been sprayed with something like pepper spray or bear repellent, it wasn't likely to have caused his death. At this point there is no "acknowledged" or accepted version of why he died.

We do know that Brian Sicknick had a stroke after the Jan. 6th events. The fire extinguisher story was much circulated but untrue. Nor is there much reason to believe the version of the Capitol Police, given how much they've gotten wrong or concealed.

I am not anti-Carlson but he is an openly partisan personality and the information released will automatically be discounted by large swaths of the public and the media regardless of the reality or the quality of the presentation.

Kevin McCarthy knew this.

Why is this not being handled by a select committee in the house with the resources and attention that would bring to the issues?

My son is Orthodox Christian. He and his parish are preparing to celebrate Easter. It is the most important festival in the Christian calendar. Knowing that, I'm reminded of Jesus scourging the Temple just prior to his crucifix, death and resurrection. As I see it, Jesus isn't in the picture just yet. But the Temple (as a metaphor) is in our picture. The original Temple was meant to be a place of sanctity and worship. Over time, the Pharisees and money-changers co-opted the Temple and debased its meaning and purpose. There is no like-to-like comparison to the Temple and us. But our institutions, all of which contribute to our culture and society have in my opinion been corrupted through simple human nature. That corruption impacted the people of two thousand years ago. A similar corruption is now impacting our societal and cultural agencies (government, business, journalism, academia, law, religion, medicine, etc.). History does not repeat itself. It does inform us, however. The people of Judaea had no say in their governance by Rome. And Rome was not a benevolent ruler. Fast forward to today and we see similar conditions of governance by a detached, directive and dictatorial elite. Two millennia ago the people could only pray for a heavenly savior to free them from tyranny. Today, we have not yet sunk to that point of misery. I wish I knew but I can only suppose that God expects us to fight for our families, our culture and ourselves. We have not yet earned the right for a heavenly savior to descend and resolve our issues as flawed human beings. We own this mess, either through acts of commission or omission. So I say deploy "en masse" the J6 tapes. Confront the Pharisees directly (I'm looking at you Chuck, et al). Challenge the imperial governors. Expose the Praetorians and those who command them. Maybe we can purge our Temple and delay Jesus' return. Because I'm pretty certain that should He return, no-one will like the result.
