Assistant U.S. Attorney Amanda Vaughn argued to the jury, quoted in "Prosecutor: Steve Bannon thumbed his nose at the law/Outside court, the defendant denounced the House Jan. 6 committee and the case against him" (WaPo).
Lawyers for Bannon dismissed Vaughn’s characterization, saying their client was still negotiating with the House Jan. 6 committee when he was accused of a crime. “No one ignored the subpoena,” said defense lawyer M. Evan Corcoran. “It’s called negotiation, it’s called accommodation.”... 
After Tuesday’s trial testimony ended, Bannon erupted outside the courthouse, blasting the head of the Jan. 6 committee, Rep. Bennie G. Thompson (D-Miss.) and repeating false claims that Trump, not Biden, was the true winner of the 2020 election.“They’re charging me with a crime?” Bannon fumed. “Have the guts and the courage to show up here and say exactly why it’s a crime.” 
It is highly unusual for a defendant to speak publicly outside court in the middle of his own trial, let alone criticize decisions about which witnesses appear. 
Bannon also predicted that Republicans would win back the House in November and create a new Jan. 6 committee that will function far differently than the existing panel, which he derided as a “show trial.” ...

Here's the description of how Bannon looked in court: "Wearing one dark button-down shirt over another, a black suit jacket and a black mask, Bannon, 68, leaned forward at the defense table and listened intently." He's "pugilistic," we're told.

The defense attorney urged jurors to question the motivation behind testimony or evidence presented by prosecutors. “My single request for you is to think about it and ask yourself: Is this piece of evidence affected by politics?” he said....

The two misdemeanor contempt charges Bannon faces are each punishable by at least 30 days and up to one year in jail.

But criminal trials over contempt of Congress are exceedingly rare, and serving time in jail for a conviction is even rarer. It has been about seven decades since someone went to jail for that offense — a seminal case in U.S. political and legal history involving the First Amendment, the Cold War and political efforts to publicly shame suspected communists. 
In 1947, 10 movie directors and screenwriters refused to answer questions from the House Un-American Activities Committee about their alleged ties to communists. The Hollywood Ten, as they were known, were convicted, and the Supreme Court ultimately rejected their appeals, sending them to jail in the early 1950s, in what many historians now consider one of the worst instances of red-baiting during the Cold War era.

In 1957, the Supreme Court sought to rein in what it had come to view as the excesses of the red-hunting days, ruling in favor of an Illinois labor official, John Watkins, who agreed to answer some questions about people he knew who were communists, but refused to answer questions about people whose communist associations or activities were in the past.

Through the Watkins case and other decisions, the high court discouraged the Justice Department from pursuing more contempt of Congress cases.....

In the last 24 hours we have Bannon and AOC each breaking the law for political reasons. I think neither's actions pose a threat to the Republic and neither should be prosecuted. Of course, only one will be prosecuted as he has the "wrong" politics, which results in him being pursued by the politicized Justice Department in support of a show trial. Certainly, this is a case for jury nullification.

Someone upthread gave the typical republican response. We shouldn't prosecute anyone. Well, that's nice. except the democrats want to prosecute Republicans and don't want to prosecute their side.

So, the whole gosh, we should be even-handed and follow precedent doesn't work. It Does.Not.Work. You want even-handed justice? Retaliate. Once the D's know they'll be harmed when they are NOT in power, they will think twice of doing it in the future.

Will McCarthy and McConnell do that? Of course not. Both of them have already said "off mic" that "The Democrats should take care of Trump (and his supporters)". And they have no guts anyway. As shown by how they acted in 2015 and 2016.

The judge has already ruled that any Bannon defense is inadmissible. Then issue of the validity of the "committee" for example. Was the subpoena legal ? Nope. Can't question that. Plus, of course, a DC jury that acquitted Sussmann a few weeks ago.

Two-tiered justice system- had Bannon been a Democrat and did the exact same thing, no charges at all would have been brought, as the article more or less concedes since the vast majority of referrals for contempt of Congress have been brought by Republicans over the last 40 years, and all of them were ignored by the DoJ. Add to that that all these trials take place in a jurisdiction where the Democrats are 95% of the population, and it is true, authentic due process violation on its face.

The judge, Carl Nichols, nominated by the previous president and appointed by Congress has basically said "SLOPPY STEVE'S" (previous presidents' term of endearment for the Bannon fellow) the Bannon team has no case. The penalty for conviction of the 2 charges of misdemeanor are up to 1 year on each charge. I am seeing about 2 months on each charge 4 months total and the Bannon fellow will use that as martyrdom for his podcast and his bloviating to present to his followers. I wager on many events(sporting) and issues and laying the odds at 3-1 for the judgment. My ROI has been below average with my losses on Breeders Cup, Kentucky Derby and some political wagers. I will look to see decision at trials end (probably Friday this week)

It wasn't Red-baiting: they caught the fish. Read Romerstein or Stan Evans. Once the Venona records were exposed, it turned out unambiguously that McCarthy was on the right track --- while the FBI was for some reason at the very least throwing up smokescreens. At least the DOJ was credible back then. Anyway, just a quibble.

Bannon has little to answer to this perniciously selective prosecution: all he has is that it is selective, which I think is enough.

But he has a hell of a lot to answer to for telling conservatives to stay home from the senatorial elections in Georgia. Daily, for months, using pretend "different concerned citizens," many of whose voices sounded suspiciously like that grifter, Jenny Beth Martin, when she didn't openly appear on his show, he urged voters in Georgia to not let anyone steal their votes again - by staying home and not voting. He has a lot to answer to the people who worked hard to get Trump elected in Georgia. He sold us out for a Hong Kong billionaire and we lost ourselves the Senate. Why?

Now there's a question nobody's asking. And I used to like Bannon. He's been right about a lot of things. He uncovered the lab story and stuck with it while so-called professional journalists zipped their lips or opened them only to mock him. He was reporting on the virus daily long before any news outlet began to report at all, let alone craft their narratives.

So why did he then go on to throw the Senate? I get the money part. He was living very large, and people who knew him began to distrust him. He needed his billionaire, who wanted his audience. But why did his money people want to put the scare into conservatives in Georgia? We know who was snookered, but who was crooked?

It is my understanding that no J6 participant is being charged with "insurrection", "domestic terrorism", or "attempt to overthrow the government". Stipulating that that is true, why would the judge allow the prosecution to use these inflammatory terms in Bannon's case when he is only being charged with a nitpicking violation of failure to respond to a subpoena? I say nitpicking because even the prosecution admits that Bannon's lawyers were negotiating over terms of his testimony (standard practice) when the authoritarians decided to arrest him.

Can anyone make legal sense of my question?

Why does Bannon get treated differently? Is it because everyone knows Hilary et al are lying when they claim they actually won the election and nobody believes them? In that case the caveat is not necessary.

In the case of President Trump, many, perhaps the majority, of people believe that he actually won. Thus it is necessary to tell them they are wrong. Tell them often enough and maybe they will believe it. Doesn't seem to be working, though. More people believe Brandon lost today than a year ago.

And how does the WaPo know the claims are false? They may believe that President Trump lost but they have no way of knowing.

"I have the greatest respect for Congress as an institution, and that very respect is the reason for my utter contempt for greedy corrupt two-faced unAmerican swine like [pointing] you, you, you, and you, who pollute these halls by your very presence. That's not Contempt of Congress, it's contempt for specific individual members of Congress who richly deserve the contempt of every American. Would you like me to list the particular reasons for my contempt for each of you? Let's start with sleeping with a known agent of an openly genocidal tyranny that is already at war with us in an almost overt way . . . ."

I'm sure a skilled speech-writer could greatly improve my words, but something along these lines would be electrifying.

Amazon never had any desire to build a 2nd HQ anywhere, including NYC. The whole scam was just away to get hundreds of cities to pull down their panties and give Amazon all their most intimate demographic and planning data for free. Probably 10s of billions in free data, much not otherwise available at any price.

Once they got that, Amazon couldn't just say "Gee, thanks, but we've decided we don't need another HQ after all"

So they announced NYC then got AOC to kill it. You did notice that they never built it in their 2nd choice city, didn't you?

Today in a speech Brandon said that he "has" cancer.

The white house walked it back referring everyone WaPo journo and part time oncologist Glenn Kessler.

The glenster tells us that Brandon "had" cancer a few years ago. But since it was non-cancerous skin "cancer", nothing to worry about.

At least today.

Apparently, according to the speech, the non-cancerous cancer was caused by his mom using windshield wipers to scrape the oil off their cars windshield.

Trump 22? One can hope.

I think the appeal is gong to be interesting. The committee didn’t legally have subpoena power. So, what is being charged with? We have a runaway DOJ (duh!) that indicts and tries for non crimes. And a heavily biased DC court system and jury pool. Sure, the DOJ was operating in bad faith. But they do that with regularity with the J6 defendants. But maybe more important, he is being tried for contempt for refusing to comply with an illegal subpoena. Sure, the DC Circuit has a Dem bias. But it isn’t really that leftist. And judges there ignoring these technicalities are going to be called out by their Republican colleagues. It should be interesting.

I’m forced to defend Drago- he’s very familiar with criminal litigation due to that time he was charged with violating the Peeping Tom laws. He ended up copping a plea and picking up trash in the parks for several weekends

Jim: Bannon does not the Dems, or their Committee formed in violation of House rules, anything.

So he should go on his show and say what he wants, and tell the Dem to FOAD when they want him to come talk to them.

Since Dems like Adam Schiff have repeatedly showed that they will lie about unreleased testimony, giving them testimony to lie about is also quite stupid.

I'm sure Bannon would have been willing to go testify if it was required that it all be in public, and that he gets 3x the time a member spends on a "question" to answer it, with no cut-off allowed by the member or the Chair.

IOW, he might have agreed to appear if they agreed to not play bullshit games.

But since they weren't willing to do that, FOAD was the correct response.
