"Bob Dylan and his lawyers are calling the sex abuse lawsuit filed against him in New York last summer a 'ludicrous' money grab by an unbalanced 'psychic' who once stated she had been 'abducted by aliens and piloted their spaceship....'"

"'According to her own website, plaintiff is a psychic who specializes in ‘channeling’ the deceased loved ones of grieving families — for a fee,' the new filing states. It alleges the accuser had not only claimed she had been abducted by aliens, she also purportedly claims that 'she speaks to cats, dogs and other animals — alive and dead — as well as insects and plants.'... [The plaintiff's lawyer said,] 'Some people refer to Bob Dylan as a prophet. People have labels. More than half of Americans believe in psychic phenomena. If you’re going to attack somebody for their beliefs, you’re encroaching upon very dangerous territory.... This is what this country is based on, freedom of beliefs. It shouldn’t divert our attention from the allegations. This case is about the facts.'"

From "Bob Dylan Brands Sex Abuse Lawsuit a ‘Brazen Shakedown’ by Unbalanced ‘Psychic’/'The allegation is false, malicious, reckless and defamatory,' Dylan’s lawyers said in a new response filed in state court in Manhattan" (Rolling Stone).

Shouldn't she have known ahead of time that he would abuse her, and so stayed away?

Is this another rape in a department store dressing room? Manhattan has a lot of those.

Some beliefs are obviously unsubstantiated by either physical, demonstrable facts or by how the belief helps shape the world in a positive way (such as Christianity creating Western Civilization).

We have gone too far along the path of relativism. Some people are insane, or at least divorced from reality. Those people are causing a lot of destruction in our society right now. I’m not saying this woman was not assaulted by Dylan. I’m just saying she makes a bad witness. Without more proof I wouldn’t take her word for it and I am a woman.

I suspect the accuser also has one of those "In this house we believe in science!" signs in her front yard and a Dr Fauci fangirl tea cup.

Google: "Believe women" is an American political slogan arising out of the #MeToo movement. It refers to the necessity of accepting women's allegations of sexual harassment or sexual assault at face value. Sady Doyle, writing for Elle, argues that the phrase means "don't assume women as a gender are especially deceptive or vindictive, and recognize that false allegations are less common than real ones."

A uncle of mine, who taught at UCLA, was a co-defendant with Bob Dylan and some other men in the late 70s. A female student, who he had spoken with on campus, accused him and the other male co-defendants of stealing her thoughts, through telepathy. UCLA handled the lawsuit for him and there was no trial. I assume it was dismissed by summary judgement.

I'm sure Dylan has been subjected to many such frivolous lawsuits over the years. The difference now is that if there is a sexual abuse angle it gets mentioned in the international press without even a cursory look at the merits.

It would be dangerous to build his entire defense around, "she's a kook." Maybe she is, but kooks have rights too. If I were on the jury and I got the message that Dylan's lawyers think it should be open season on people who are divorced from reality, I'd be more inclined to rule for her just to show that that defense won't work.

How is it possible to separate fact from fiction over events that occurred 67 years ago? Am I missing something here or does the plaintiff have solid rock (pun intended) facts to back up the claims?

Leland said...

The defense also points out that the accuser's original dates of sometime in April and May of 1965 in NYC don't match with times Dylan was actually in NYC. Dylan, unlike Kavanaugh, has a few more fans and historians that can vouch that he wasn't there. So perhaps Dylan is questioning whether he can be guilty of statutory rape if the victim had to channel his thoughts of sex from hundreds of miles aways.

Alas, the accuser is doing the Blasey Ford trick of changing the comparatively narrow time of April and May 1965 to "sometime in the Spring" of 1965. No word yet if Dylan stayed out of NYC during the entire Spring of 1965, and whether or not the groundhog failed to see its shadow thus expanding Spring a few weeks earlier into the year. Wait... this just in the groundhog did see its shadow in 1965, so the window is narrower.

In a rape allegation case there is always the danger of backlash if the defense attacks the alleged victim too hard. But if someone is divorced from reality then how could you as a potential juror believe her version of what happened?

If the alleged victim is genuinely confused then the defense should bring this up in a gentle, sympathetic manner. But if the plaintiff is obviously malicious and opportunistic then a more aggressive approach can be correct. The website, Zeus News, has an email from Dylan's accuser in which she has counseled a vulnerable woman, after giving her a physic reading, to sue Dylan and some other Rock stars for abuse the did to her in a previous life. If the email is true, then this woman is more than just a kook, she's an exploitive, dangerous person and should be treated accordingly.

I can't vouch for Zeus News, but you can see for yourself here:

Pretty sure that Dylan's lawyer isn't questioning this loon's patriotism. He's questioning her grip on reality and her ability to correctly and accurately recall something that may or may not have happened in 1965 at some point.

What a weird non sequitur.

More than half of Americans are also Christian. If one of them starts telling me they are having two way conversations with God, I am going to be leery of anything they say. And if someone tells me they are having two way conversations with dead people and animals, or live animals, then their statement is suspect at best.

Somewhat important
"Her initial lawsuit said the alleged abuse took place between April and May of 1965 at the Chelsea Hotel in Manhattan. After Dylan historians and supporters argued the musician wasn’t even in New York during that timeframe, making her claims “chronologically impossible,” the unidentified woman filed an amended complaint changing the time period to “the spring” of the same year."

Oops! The Blasey Ford slip up

It's about time feminists realize how pathetic and weak historical accusations make women look. Even a 12 y.o. girl has enough brains to speak up, unless her parents whored her out, which is possible.

I noticed in films that Bob was particularly contemptuous of Baez in his treatment of her. I think he had no real use for somebody who sung on key. She noticed but swallowed the humiliation.

I don't think being a kook would be a deal breaker for Dylan, but the twelve year old part would be a huge stumbling block. I think the case should be thrown out, but I'll add a however. If a bunch of underage girls come forward and tell similar stories about Dylan, then maybe the trial should go forward.....I wanted to believe Cosby was innocent, but he either had the misfortune to encounter multiple liars or something was going on. Same thing with Cuomo. He wasn't a rapist, but if that many women think he had a hand problem, then he had a hand problem....I don't know about Woody Allen. His daughter tells a credible story. It could have happened. But what with presumption of innocence and all, I don't think it's fair to cancel him. A lot of women he worked with over the years, with the single exception of Mariel Hemingway, considered him a gentleman.....All the women who worked with Kavanaugh professed their support for him. Ditto with Clarence Thomas, although iirc, some other woman claimed that he flirted aggressively.....Men with active libidos are rather more likely to behave badly than women, but women are certainly capable of telling lies to advance their interests.

Why would he throw it away to screw a 12 year old.

A kink, a fetish, an orientation. #NoJudgment #NoLabels, I suppose. After all, a century, a millenia ago, and some jurisdictions today, religious (i.e. moral, ethical, legal) standards diverge. In fact, we still... vigorously defend rites for social, redistributive, and fair weather causes in several liberal "safe sanctuaries."

The case is "based on plaintiff’s alleged interactions with Bob Dylan more than 56 years ago". I assume there's some reason this case isn't barred by the statute of limitations, but REALLY is a claim like this plausible after more than half a century?

BTW, Eugene Volokh has been posting a lot of materials about whether parties to litigation should be allowed to proceed psuedonymously. This would seem like a clear case in which the plaintiff's name needs to be revealed.

I have seen him in an interview rave about Joan Baez's singing, and Bob is a pretty good singer too. But he did also make fun of her at times, even she admits it in her song about him, Diamonds and Rust: "My poetry was lousy, you said." Personally, I only like a few of her songs because of her, what I call "America Opera" style singing, with the piercing vibrato.
