"The Supreme Court on Friday rejected an audacious lawsuit by Texas that had asked the court to throw out the presidential election results in four battleground states..."

"The court, in a brief unsigned order, said Texas lacked standing to pursue the case, saying it 'has not demonstrated a judicially cognizable interest in the manner in which another state conducts its elections.' The move, coupled with a one-sentence order on Tuesday turning away a similar request from Pennsylvania Republicans, signaled that the court has refused to be drawn into President Trump’s losing campaign to overturn the results of the election last month. There will continue to be scattered litigation brush fires around the nation from Mr. Trump’s allies, but as a practical matter the Supreme Court’s action puts an end to any prospect that Mr. Trump will win in court what he lost at the polls."

I would therefore grant the motion to file the bill of complaint but would not grant other relief, and I express no view on any other issue.

Alito and Thomas are correct. The Court should have granted the motion to file the complaint. Under the statute, the Court has no discretion to reject a motion to file a complaint in a State v State case. That they continue to do so is a deflection of their duty.

Alito and Thomas should have added that the complaint should be dismissed for lack of standing.

The Parnell suit has a cert petition pending at SCOTUS. Despite what the NYT is reporting, SCOTUS only denied Parnell's application for emergency relief. Given today's order in the Texas case on standing, it's hard to imagine a petitioner with more standing than Parnell....

I don't know why anyone spends time reading or repeating the NYT about anything they publish.

Not going to lie, all of Trump's picks turning on him is a surprise. I thought Brett Kavanagh would, at minimum, say that there is standing to file.

But as I said in the previous post, this is just fine by me. If anything, the epic sense of betrayal in the Republican base will now reach critical mass that wouldn't happen if only 1 or 2 picks joined the Roberts liberals. I'd love to live in a society where "there's an authority besides Trump that we can trust," but who could that possibly be?

We are in the endgame, just not the one the Democrats think is happening.

Absent a confession by a high level Dem operative, there was no chance the election would be overturned. If the litigation stops after the election then the litigants’ claims of fraud were not made in good faith. If they continue the contours of any fraud will be outlined and can be prevented next election.

This is why poll watchers were told to leave or stand so far away as to be useless. This is why Biden's numbers shot up in unison and weird hours. They left knew which precincts to target, and they did so. Also, the media will not report any curious behavior. Not a single witness was given an opportunity on a mainstream D-Party source. 7 positively said Texas et al don’t have standing to bring these claims.

Thomas and Alito said they would grant the motion to file the complaint but would not grant the relief asked in the complaint (blocking state certifications of their electoral votes, declaring that these states violated the Electors Clause, etc) even if Texas had standing. They also said they are not giving their view on whether Texas has standing, whether any of the four defendant states violated the Electors Clause, the Equal Protection Clause, or the Due Process Clause.

I had the feeling that the court would not want to get embroiled in this fight. Being a non-lawyer I thought Texas made some pretty cogent arguments for the court to review. Standing is always a bugaboo and an easy out for the justices. I guess the question now is if a citizen of one of these states makes a claim similar to Texas would he have standing?

There are only two plaintiffs with standing to bring the Electors Clause claim in a federal district court — the state legislatures of the 4 states (each as an institution, not by individual members) and Trump.

The Court did not rule on the quality of the evidence. It ruled on the quality of the legal theory. The election can still be attacked in the States wherein it is being stolen, and the adverse rulings of corrupt Democrat judges can be appealed. The Law has not yet told us in so many words that we suffered no crime, and can expect no remedy. It is necessary to give it every possible opportunity, and to present the best available evidence.

I've been a registered Republican since I was 18. Only voted Democrat twice, McGovern and home boy Carter, in 52 years. The past 4 years of Trump has been an eye opener. The Republican party has no interest in effectively opposing radical Democratic legislation as long as they can participate in the grift. I plan to change my party registration to "Independent". The Repugs are dead to me. But, in a way, none of that means much anymore. The Democrats have openly cheated in a national presidential election, and they have gotten away with it. They have created a permanent one party state that will no longer be effectively challenged. As I see it, their absolute victory has made voting pointless and a waste of time. I always thought of Trump's presidency as an anomaly, not to be repeated. Apparently, one term is all the Swamp will allow. They will not underestimate their enemies again.

The Supreme Court's decisions in both the Pa. and Texas cases were completely predictable under the applicable legal rules and simple common sense. The rule of law prevailed.

The rule of law also prevailed in the more than 50 Trump court losses. No proof of any fraud, let alone fraud sufficient to swing the election, means that under our legal rules, you lose the lawsuit. You don't get to set aside a democratic election on the basis of BS statistics, stereotypes, or fantasies, or what "everyone knows" but no one can demonstrate. That's the way democratic elections work.

The failure of proof in more than 50 lawsuits is powerful evidence that there is no proof of result changing fraud in any state.

So is the testimony of the officials on your side of the aisle--Barr of Justice, Krebs of Homeland Security, Ducey and Kemp, and so many local election officials, many Trump supporters, who have testified under oath that there was no fraud.

The lawsuits are over. Trump and his supporters will now try to get Congress to throw out the results in these states on the basis of the same evidence that failed in the courts.

That would frustrate both democracy and the rule of law. It will be interesting to see how many Republicans are brave enough not to participate in that attempted coup.

We must all understand what sort of a position the vote fraud put the leadership of this country -- either they forced the losers to accept it, or the attempt to extricate the system from the fraud would 1) destroy one of the major political parties 2) piss off the "winning" Democratic voters as much as we the losers are pissed off now & 3) set off a wave of far-left & maybe a good dollop of moderate lefty unrest probably surpassing the 1968 riots. The Democrats went to the precipice & they left the Establishment no way out that wouldn't involve its own destruction.

So, now, to we, the losers, it's the Rubicon & Alia Jacta Est. Who knows how this will go. There's a good chance the majority will go quietly, but also a good chance that a sizable minority won't.

The election theft will almost certainly not be overturned unless lots of individuals in the suspicious swing states are indicted with probable cause for fraud. And that sort of thing does not happen quickly. Alito and Thomas were willing to overturn the election theft without that, but the other 3 normals on the Supreme Court have not yet shown a similar willingness. And of course, the 4 liberal failures: 2 appointed by Obama (the two boring childless single old women who support late term abortion), the loser appointed by Bush (the compromised Roberts) and the way long past his prime Breyer ---- none of them have yet given any thought to doing the right thing.

If there is political violence over this election, I hope it is a large scale popular uprising across large parts of the country. It is our only chance to have a restorative insurrection, rather than a destructive one.

This is not just about Trump, this is about the tens of millions of people whose votes were stolen, and about a country's attempt to avoid an Orwellian future.

Trust me, the drama of this election is not going to end because Texas is told by 7 mediocrities that it does not have standing. There is still time for those with standing to assert their rights. While I recognize that Alito and Thomas are the best, by far, of the 9 Supreme Court justices, and while I agree with their dissent, the fact remains that all of the other 7 will accept a suit filed by someone with standing. Be patient.

I predict Biden will be inaugurated if there are not multiple arrests and indictments of individuals for election fraud before the day the poor old sufferer from dementia is inaugurated. That will be a tragedy, but no greater of a tragedy than the day the abortion-loving Obama, with that phony smile, with his long history of Jew-hater friends and his longer history of election fraud, was inaugurated. I would like to be wrong, but that is my prediction. I cannot predict how quickly individual criminality will be discovered. I am hopeful. But remember, there is not a lot of talent among the people whose job is to prosecute election fraud. None of them are paid much compared to what they would get if they worked at real law firms, the law firms which are currently working to protect those who stole votes.

Another step would be for the legislatures of the disputed states to appoint their own slate of electors and send them to Washington either instead of, or with the ones generated by the current results. This would bring up an 1876 situation, and I would settle for a Biden presidency in return for true election reform.

- all voting done in person. No absent or mail in ballots except for military and diplomats serving overseas

- voting rolls purged every twenty years, everyone has to reregister

- show approved photo id before voting

- finger dipped in indelible ink after voting

- paper ballots, bubble in type (like every uses in school)

- ballots counted in public, with media and witnesses present

Anyone who suspected there was fraud has looked at the evidence and found it compelling, many times over.

The rest pretend there is literally zero evidence to look at, and are taunting and mocking the first group in an obvious bid to make them engage in violence. It's trolling on an epic level, deliberately trying to provoke a civil war that they think they will win handily.
