IMO Jay Sekulow was the strongest Trump Lawyer by mixing a strong argument with underlying passion. The other two were debater types using an intentional downplay of passion. I suppose that comes from Jay being an attorney deep into the fights for our Judeo-Christian culture over the last 20 years.

Nadler was fighting with Trump over development projects on the West Side thirty years ago. He definitely wasn't going to pass up the opportunity to deliver the final blow.

Schiff, though, probably should have realized that there might be some blowback if he became the goggle-eyed, pencil-necked face of impeachment.

Sometimes less is more, but when you're a politician and you have the spotlight it's hard to give it up.

Well, actually, not THAT smart. Schiff could very well be getting away with this farce if Trump hadn't immediately released the transcript. The fact that Schiff didn't and couldn't change or abandon any of his strategy in light of that game changing event doesn't speak well as to his intelligence either. He basically proceeded exactly as if that had simply never happened, and his fake version of the call that he created and smeared Trump with was still the "official" version.

It's like once the Dem script was written, absolutely nothing could change it, with no ability to counter any of Trump's countermoves. Hence all the winning by Trump.

I don't agree, but I do think he is focused on ambitions at the expense of principles. Much like Kamala Harris. Schiff though has stuck it out in the Lower House for a lot of years. My guess is he's never seen a pathway to bigger things until now.

He was my US Rep until 2012. I don't know that I was embarrassed. I've just accepted that after 1982, I will always have a Dem rep.

I don't know if Schiff can win a Senate race in California. It would be fun to watch him beat down by a "minority" candidate whose only qualification is being a minority.

Whistleblower laws are designed specifically to bring people forward, with a guarantee of no retaliation. IOW - to bring accusations and accusers out into the open. If you send an anonymous tip that had specifics, for example - "The invoices for this date are fake, parts were never received, and payment was made to a phantom suppler." action can be taken as it describes something real and specific that can be investigated. If an anonymous complaint is filed "On this date I saw this happen!", it's worthless. Can't be admitted into court. And if you ask the people accused about it, well, they can dismiss it as a baseless allegation hiding behind anonymity. Not admissible as evidence in court or any kind of disciplinary proceedings.

Constitution guarantees a right to face an accuser. period. (Campus sexual harassment kangaroo courts have ignored this for years, and are now paying for it....) Whistleblower laws are designed to bring out those accusers. Claiming that whistleblower laws allow witnesses to remain anonymous is, well, an outright lie. A supreme court justice should be well aware of the 6th amendment that states In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; .

The House ran a star chamber proceeding. Witnesses couldn't be confronted. Witnesses were kept anonymous. Testimony was kept secret.

I very much disagree with the first, but agree with the second. He managed to gin up a two article impeachment, bought into by over half of the House and close enough to half of the Senate to makes things interesting, even suckering several Republican Senators, including another HLS grad (Romney). He had all of the Democrats, most of the MSM, and even some Republicans believing that he had discovered (instead of fabricating) horrible misuse of power, instead of the same sort of Presidential actions that have been routinely engaged in over the previous 220 years and 44 predecessors. He invented two colorably impeachable offenses out of thin air. At the bottom, he had nothing even questionable by Trump, but managed to make believers out of so many that he finally had caught Trump. That takes genius, not stupidity.

For some time now, I have questioned whether his failure to get delegation of subpoena power from the House as a whole until the end of October was inadvertence or advertence. Initially, I figured that he and his HPSCI were just sloppy. But that gave him his second article of impeachment. If he had actually done it the right way, getting subpoena power, issuing them, then having the President blocking him in court, and they would still probably be in court, with a significant chance of losing, but if he won instead, he probably wouldn’t have gotten his impeachment to the Senate for trial until maybe this summer. Not good timing for the Democrats. Moreover, he probably would have had only a single article of impeachment since Trump’s position in regards to the second article would have been confirmed by the courts. This way Trump never had a chance to assert Executive Privilege, and the courts never had a chance to intervene and affirm his claim of privilege. Both wins by Schifty and the Dems. Which is to say that I am leaning right now to advertence over inadvertence.

(One of my favorite Sci-fi author teams frequently uses “advertence” as the opposite of “inadvertence”, and I like that wording).

I am pretty sure that that issue was deliberately confused by Schifty and his Lawfare subordinates and hench people (I used a non sexist term there because one of the Lawfare group working for him was very likely disgraced former DOJ NSD AAG Mary McCord, (now IC IG) Michael Atkinson’s boss during the time that she was overseeing the filing of the four bogus (and at least two illegal) FISA warrants on Dr Carter Page).

Of course Schifty had to hide the “wistleblower’s” identity - disclosing it would have exposed that the entire whistleblower incident had been fabricated by Schifty, McCord, etc, and the “whistleblower” was actually a Brennan protégée, Deep State early Resistance operative, with close ties to former VP Biden. Exposing that the entire whistleblower episode had been contrived and fabricated by Schifty and his staff. The amazing thing is that he was able to suck so many bright people into his legal fable, including, apparently, probably the Republican nominated Chief Justice of the Supreme Court, as well as the Republicans’ Harvard LS and MBA educated previous Presidential candidate.

They did better than Pelosi. Pelosi convinced zero Republicans and one Democrat defected to the Repubs and a Dem presidental candidate refused to vote for impeachment.

What may be interesting is that Dr Page has (re)sued both the DNC, the law firm that they had hired as a cutout between them and Fusion GPS as well as Fusion GPS itself, for defamation. They are claiming actual malice, despite his being a public figure didn’t happen until a year or so after the defamations occurred (and their defamations were instrumental in making him a public figure). They are plausibly claiming economic losses on the part of Page as a result. The major goal of the law suit appears to be discovery. Should be interesting. Their original suit, filed in OK, was rejected based on venue. The new case was filed in IL, with their claim of venue there being more plausible.

Agree with Bruce Hayden, this impeachment farce/production was carefully planned by lawfare and allies, as a way to hurt Trump.

As usual with attacks against Trump, just like with Coyote and the Road Runner, the attacks backfired. The Democrats and allies, are still not used to an opponent that attacks back. This tweet is just another example of Trump counter attacking, and to judge from the responses above, it was VERY effective. It made it so the MSM was forced to cover the incident.

I listened to Schiff at today's discussion re calling witnesses. I do believe that the man has a couple of screws loose. Seems to lie with effortless ease.
