Interesting that Andrew McCarthy has a theory on Part 2 of the Mueller Report that is similar to the one I have been pushing here, though his is a bit more sophisticated: How Mueller’s Lawyers Spun the OLC Guidance on Indicting a Sitting President. The idea is that Mueller’s prosecutors used the OLC opinion on not being able to indict a sitting President as an excuse to not determine whether or not Trump had Obstructed Justice. If they had determined that Trump had, they would have been overridden by AG Barr, on the basis that their legal theory was not legally tenable. So, they got to throw all their dirt at Trump by pretending that that OLC opinion forbid determining that there was probable cause to believe that Trump had committed Obstruction. The thing that McCarthy added was his observation that AG Barr outflanked them by their actually making that determination- that there hadn’t been any Obstruction.

Yeah, I have written that exact same thought here multiple times- Mueller etal. underestimated Barr's fearlessness- they really did expect that Barr would be too afraid to make that determination, which is funny because he even pressed them to make the determination themselves. By making it for them, Barr really did deep six the impeachment plan right then and there- Mueller last week just put the sod on top.

Of course. The only reason Mueller gave for not charging is the OLC guideline, and the only "evidence", of obstruction I've seen, aside from Trump "wanting" to fire Mueller, and other similar shite, is that Trump could be charged after he leaves office. That's like saying Mueller could be charged with bestiality because there is a provision in the law for charging someone with bestiality.

Bruce, I read the NR article, and you're right, McCarthy's analysis is very sophisticated, and it makes perfect sense. It's both more nuanced and more to the point than my take, but mine has the added bonus of smearing Mueller by insinuating a charge of bestiality.

Doesn’t matter. The official conclusion is that the Mueller Report did not find enough evidence to legally indict Trump for Obstruction of Justice (as well as for Russian collusion).

This is quite possibly the stupidest thing I read this week, and that is a high bar to beat.

Barr quoted from the report itself when he did the determination, Readering. He made absolutely sure he accepted every single instance of possible obstruction cited by the Mueller Report, and then shot every one of them down- one after the other.

Decision makers in Congress include Republicans, and the general public includes people like me. It carried weight with all those. Who didn't carry weight with are the idiots who still think this can be used for impeachment. Good luck with that.

How do you know that? It would appear Barr read the report since he opined on the obstruction of justice issue. It was pretty clear Mueller hadn't read the Mueller report, based on his unfamiliarity with its contents.

I am guessing that readering is saying that Barr couldn’t have read the report or he would have found obstruction, but readering, who has also claimed to have the same level of elite education as Justice Kavanaugh, can’t give us any actual examples to chew on. In her teaching days AA might have used "whether an obstruction of justice charge may arise where there is no underlying crime" as an exam question, but "the man in the street" is not going to accept that as a normal procedure to pursue.

The charge of the "Russian collusion" is something like a UFO, or a "will-o'-the-wisp," an atmospheric ghost light seen by travelers at night, especially over bogs, swamps or marshes.
In this case, the most charitable assumption, a desperate hope by political opponents of the President that routing a hack through a server in Russia proves a Russian origin. And it has not even been shown that the hackers were the ones who passed the information to Wikileaks.

I went to bed last night just when Mockturtle and Roughcoat were talking about John Keegan.

He spoke at my school about 1992 or so, and I had a chance to converse with him afterwards.
I asked him point blank if he stood by his notion in Face of Battle that battle may have abolished itself. He grimaced and said someone asked that wherever he went, but allowed that he might have been too optimistic.

He could write well. But his WWI book is crap--he calls Moltke the Younger the son of Old Moltke; gives way too much attention to the first part of the war in France (IIRC), thereby slighting other important aspects. In his North America book he makes a hash of Grant's 1862 campaign in Tennessee--I think he had trouble with the concepts of up- and down-river.

His critique of Clausewitz is asinine--see Bassford and Byrne for detail. On Clausewitz, Keegan was all Colonel (Professor?) Blimp.
